As used in KRS § 363.900 to KRS § 363.908, unless the context clearly requires otherwise:
(1) “ASTM International” means the international standards developing organization that provides a forum for the development and publication of international voluntary consensus standards for materials, products, systems, and services;
(2) “Commissioner” means the Commissioner of Agriculture or a departmental employee designated by the Commissioner to act on his or her behalf for the purposes of KRS § 363.900 to KRS § 363.908;
(3) “Department” means the Kentucky Department of Agriculture;
(4) “Diesel” means a refined hydrocarbon suitable for use as a fuel in a compression- ignition internal combustion engine that may contain fuel additives and up to five percent (5%) by volume of biodiesel or biomass-based diesel;
(5) “Division” means the Division of Regulation and Inspection in the Kentucky
Department of Agriculture;
(6) “Gasoline” means gasoline as defined in KRS § 138.210;
(7) “Gasoline-oxygenate blend” means a fuel consisting primarily of gasoline blended with more than one percent (1%) by volume oxygenate or more than three-tenths of one percent (0.3%) by volume methanol. The term “gasoline-oxygenate blend” shall include gasoline-ethanol blends containing between one percent (1%) and fifteen percent (15%) ethanol by volume;
(8) “Motor fuel” means any product used for the generation of power in an internal combustion or turbine engine including but not limited to gasoline, gasoline- oxygenate blends, diesel fuel, and diesel fuel blended with biodiesel or biomass- based diesel; and
(9) “Retail facility” means a service station, garage, truck stop, or other outlet selling motor fuel from a retail dispensing device. The term “retail facility” shall not include an outlet using such motor fuel dispensers exclusively for company and fleet use and price contract sales.

- Company: may extend and be applied to any corporation, company, person, partnership, joint stock company, or association. See Kentucky Statutes 446.010
- Contract: A legal written agreement that becomes binding when signed.
