Terms Used In Louisiana Revised Statutes 40:1257.1

  • Beneficiary: A person who is entitled to receive the benefits or proceeds of a will, trust, insurance policy, retirement plan, annuity, or other contract. Source: OCC
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Department: means the Louisiana Department of Health. See Louisiana Revised Statutes 40:1257.1
  • Medicaid: means the medical assistance program provided for in Title XIX of the Social Security Act. See Louisiana Revised Statutes 40:1257.1
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • person: includes a body of persons, whether incorporated or not. See Louisiana Revised Statutes 1:10

            As used in this Part, the following terms have the meaning ascribed in this Section:

            (1) “Department” means the Louisiana Department of Health.

            (2) “Healthcare provider” means a person, partnership, limited liability partnership, limited liability company, corporation, facility, or institution that provides healthcare or professional services to individuals enrolled in the Medicaid program.

            (3) “Medicaid” means the medical assistance program provided for in Title XIX of the Social Security Act.

            (4) “Nonemergency medical transportation” and “NEMT” mean transportation provided to a Medicaid beneficiary to or from a medically necessary Medicaid-covered service. The term shall not include any nonemergency or other type of transportation by ambulance.
