Terms Used In Louisiana Revised Statutes 42:78

  • Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.

Service shall be made in the cases provided for in La. Rev. Stat. 42:76 and 42:77, the same as in other civil suits, and the answer of the defendant shall be filed within the legal delays as in other suits.  These cases shall be tried by preference over all other cases, without being fixed for trial after issue joined.
