(1). A person may file in the filing office an information statement with respect to a record indexed there under the person’s name if the person believes that the record is inaccurate or was wrongfully filed.

Terms Used In Maine Revised Statutes Title 11 Sec. 9-1518

  • Debtor: means :
(a). See Maine Revised Statutes Title 11 Sec. 9-1102
  • File number: means the number assigned to an initial financing statement pursuant to section 9?1519, subsection (1). See Maine Revised Statutes Title 11 Sec. 9-1102
  • Filing office: means an office designated in section 9?1501 as the place to file a financing statement. See Maine Revised Statutes Title 11 Sec. 9-1102
  • Financing statement: means a record or records composed of an initial financing statement and any filed record relating to the initial financing statement. See Maine Revised Statutes Title 11 Sec. 9-1102
  • Secured party: means :
  • (2). An information statement under subsection (1) must:
    (a). Identify the record to which it relates by:

    (i) The file number assigned to the initial financing statement to which the record relates; and
    (ii) If the information statement relates to a record recorded in the county registry of deeds, the book and page in which the initial financing statement was recorded, the name of the debtor and the secured party and the information specified in section 9-1502, subsection (2); [PL 2013, c. 317, Pt.     (b). Indicate that it is an information statement; and [PL 2013, c. 317, Pt. A, §26 (AMD).]
    (c). Provide the basis for the person’s belief that the record is inaccurate and indicate the manner in which the person believes the record should be amended to cure any inaccuracy or provide the basis for the person’s belief that the record was wrongfully filed.     (2-A). A person may file in the filing office an information statement with respect to a record filed there if the person is a secured party of record with respect to the financing statement to which the record relates and believes that the person that filed the record was not entitled to do so under section 9-1509, subsection (4).

    (2-B). An information statement under subsection (2-A) must:
    (a). Identify the record to which it relates by:

    (i) The file number assigned to the initial financing statement to which the record relates; and
    (ii) If the information statement relates to a record recorded in the county registry of deeds, the book and page in which the initial financing statement was recorded, the name of the debtor and the secured party and the information specified in section 9-1502, subsection (2); [PL 2013, c. 317, Pt.     (3). The filing of an information statement does not affect the effectiveness of an initial financing statement or other filed record.
