Terms Used In Maine Revised Statutes > Title 15 > Part 6 - Maine Juvenile Code

  • Adjudication: means a finding by a court that a person has committed a traffic infraction and includes the acceptance by the clerk of the violations bureau or any judicial division of an answer of not contested. See Maine Revised Statutes Title 29-A Sec. 101
  • Adjudicatory hearing: means a hearing to determine whether the allegations of a petition under chapter 507 are supported by evidence that satisfies the standard of proof required. See Maine Revised Statutes Title 15 Sec. 3003
  • Administration of juvenile justice: includes the collection, storage and dissemination of juvenile case records and juvenile intelligence and investigative record information relating to the administration of juvenile justice. See Maine Revised Statutes Title 15 Sec. 3003
  • Adult: means a person 18 years of age or over. See Maine Revised Statutes Title 15 Sec. 3003
  • Advanced emergency medical person: means an emergency medical services person licensed to perform advanced emergency medical treatment. See Maine Revised Statutes Title 32 Sec. 83
  • Advanced emergency medical treatment: means those portions of emergency medical treatment:

  • Advice and consent: Under the Constitution, presidential nominations for executive and judicial posts take effect only when confirmed by the Senate, and international treaties become effective only when the Senate approves them by a two-thirds vote.
  • Affordable housing: means decent, safe and sanitary dwellings, apartments or other living accommodations for low-income and moderate-income households. See Maine Revised Statutes Title 30-A Sec. 5002
  • Agency: means any office or any place of business of a foreign bank located in any state of the United States at which credit balances are maintained incidental to or arising out of the exercise of banking powers, checks are paid, or money is lent, but at which deposits may not be accepted from persons who are citizens or residents of the United States.   • Agency liquor store: means a person that is licensed by the bureau to sell spirits, wine and malt liquor to be consumed off the premises. See Maine Revised Statutes Title 28-A Sec. 2
  • Airport authority: means a quasi-municipal entity formed and chartered pursuant to this chapter to operate an airport and provide air transportation services. See Maine Revised Statutes Title 6 Sec. 172
  • Alcohol: means the substance known as ethyl alcohol, hydrated oxide of ethyl or spirit of wine which is commonly produced by the fermentation or distillation of grain, starch, molasses, sugar, potatoes or other substances, and includes all dilutions and mixtures of these substances.   • Ambulance: means any vehicle, whether an air, ground or water vehicle, that is designed, constructed or routinely used or intended to be used for the transportation of ill or injured persons. See Maine Revised Statutes Title 32 Sec. 83
  • Ambulance equipment: means those materials and devices which are carried in ambulances. See Maine Revised Statutes Title 32 Sec. 83
  • Ambulance service: means any person, persons or organization that holds itself out to be a provider of transportation of ill or injured persons or that routinely provides transportation for ill or injured persons. See Maine Revised Statutes Title 32 Sec. 83
  • Appellate: About appeals; an appellate court has the power to review the judgement of another lower court or tribunal.
  • Attendant: means an agent of a county sheriff or of the Department of Corrections who is authorized to provide temporary supervision of a juvenile alleged to have committed a juvenile crime or of a juvenile adjudicated as having committed a juvenile crime when supervision is appropriate as an interim measure pending the completion of a procedure authorized by law to be taken in regard to such juvenile.   • Auditorium: means a commercially operated indoor or outdoor facility designed or used for the gathering of an audience for speeches and live performances of theater, music, dance or other performing arts that charges a fee and has adequate facilities for the sale and consumption of liquor. See Maine Revised Statutes Title 28-A Sec. 2
  • Authority: means the Maine State Housing Authority. See Maine Revised Statutes Title 30-A Sec. 4991
  • Automobile: means a motor vehicle designed for the conveyance of passengers that has a seating capacity of not more than 15 persons, including the operator. See Maine Revised Statutes Title 29-A Sec. 101
  • Baitfish: means only those species in the following list:

  • Baitfish trap: means a device used to take baitfish fitted with rigid entrance or exit holes and having a volume no greater than 50 cubic feet. See Maine Revised Statutes Title 12 Sec. 10001
  • Bankruptcy: Refers to statutes and judicial proceedings involving persons or businesses that cannot pay their debts and seek the assistance of the court in getting a fresh start. Under the protection of the bankruptcy court, debtors may discharge their debts, perhaps by paying a portion of each debt. Bankruptcy judges preside over these proceedings.
  • Baseline: Projection of the receipts, outlays, and other budget amounts that would ensue in the future without any change in existing policy. Baseline projections are used to gauge the extent to which proposed legislation, if enacted into law, would alter current spending and revenue levels.
  • Basic emergency medical services person: means a person licensed to perform basic emergency medical treatment. See Maine Revised Statutes Title 32 Sec. 83

  • Bicycle: means a vehicle primarily propelled by human power, operated by a person usually seated on a seat and driven on the ground on wheels by the operator. See Maine Revised Statutes Title 29-A Sec. 2322
  • Bicycle helmet: means a piece of protective headgear intended for bicyclists that meets or exceeds the Consumer Products Safety Commission's standards. See Maine Revised Statutes Title 29-A Sec. 2322
  • Bicycle passenger: means any person who is traveling on a bicycle, a bicycle trailer or a similar product but is not an operator. See Maine Revised Statutes Title 29-A Sec. 2322
  • Bicycle passenger seat: means a seat separate from the saddle or seat for the operator of the bicycle or bicycle trailer or similar product that is securely fastened to the frame of the bicycle and is specifically designed for bicycle passenger use.   • Bicycle taxi: means a bicycle designed to carry passengers. See Maine Revised Statutes Title 29-A Sec. 2322
  • Bicycle taxi passenger: means a person who is traveling on a bicycle taxi but is not the operator of the bicycle taxi. See Maine Revised Statutes Title 29-A Sec. 2322
  • Bikeway: means a vehicle way, paved or unpaved, upon which bicycles, unicycles or other vehicles propelled by human power may be pedaled. See Maine Revised Statutes Title 29-A Sec. 2322
  • Bind-over hearing: means a hearing at which the Juvenile Court determines whether to permit the State to proceed against a juvenile as if the juvenile were an adult. See Maine Revised Statutes Title 15 Sec. 3003
  • Blind person: means a person having not more than 20/200 central visual acuity in the better eye after correction or an equally disabling loss of the visual field so that the widest diameter of the visual field subtends an angle no greater than 20 degrees.   • board: means the board of directors of an airport authority. See Maine Revised Statutes Title 6 Sec. 172

  • Brewery: means a person that engages in the activities under either paragraph A or B, or both:

  • Chief judge: The judge who has primary responsibility for the administration of a court but also decides cases; chief judges are determined by seniority.
  • Class A restaurant: means a place that is regularly used for the purpose of providing full meals for the public on the premises, that is equipped with a separate and complete kitchen and that maintains adequate dining room equipment and capacity for preparing and serving full meals upon the premises.   • Director: means the Director of Maine Emergency Medical Services. See Maine Revised Statutes Title 32 Sec. 83

  • Emergency medical services ambulance operator: means a person associated with a licensed ground ambulance service who operates an ambulance in emergency mode or transports patients and is not licensed under section 85. See Maine Revised Statutes Title 32 Sec. 83
  • Emergency medical treatment: means those skills, techniques and judgments, as defined by the board, which are directed to maintaining, improving or preventing the deterioration of the medical condition of the patient and which are appropriate to be delivered by trained persons at the scene of a patient's illness or injury outside the hospital and during transportation to the hospital.   • Entertainment district: means an area that is located within a municipality that is established by ordinance of the municipal legislative body in accordance with section 221. See Maine Revised Statutes Title 28-A Sec. 2
  • Entitlement: A Federal program or provision of law that requires payments to any person or unit of government that meets the eligibility criteria established by law. Entitlements constitute a binding obligation on the part of the Federal Government, and eligible recipients have legal recourse if the obligation is not fulfilled. Social Security and veterans' compensation and pensions are examples of entitlement programs.

  • housing authority: means any of the public corporations created or authorized to be created by this chapter. See Maine Revised Statutes Title 30-A Sec. 4702
  • Incorporated civic organization: means an organization incorporated as a corporation without stock under Title 13, chapter 81 or Title 13?B with a civic or charitable purpose, including but not limited to relief of poverty, advancement of education and the arts, promotion of social health, safety and welfare, fostering community and economic development, protection against animal cruelty, combating community deterioration, lessening the burdens of government and providing assistance to the underprivileged and distressed.   • Independent living services: means services that promote or train people with significant disabilities in managing their personal affairs, participating in day-to-day life in the community, fulfilling a range of social roles and making decisions that lead to self-determination and the minimization of physical or psychological dependence on others.   • Informal adjustment: means a voluntary arrangement between a juvenile community corrections officer and a juvenile referred to the officer that provides sufficient basis for a decision by the juvenile community corrections officer not to file a petition under chapter 507.   • Inland waters: means all waters within the State above the rise and fall of the tide and wholly or partially within the territorial limits of the State, except private ponds as defined in subsection 51. See Maine Revised Statutes Title 12 Sec. 10001
  • Inspection: means access to and review of juvenile case records in a manner prescribed by the Supreme Judicial Court. See Maine Revised Statutes Title 15 Sec. 3003
  • Interim care: means the status of temporary physical control of a juvenile by a person authorized by section 3501. See Maine Revised Statutes Title 15 Sec. 3003
  • Joint committee: Committees including membership from both houses of teh legislature. Joint committees are usually established with narrow jurisdictions and normally lack authority to report legislation.

  • Juvenile case records: means all records, regardless of form or means of transmission, that comprise a juvenile court file of an individual case, including, but not limited to, court-generated information, information and documents filed by filers, transcripts of depositions, hearings, proceedings and interviews, documentary exhibits in the custody of the clerk of the court, electronic records, videotapes and records of other proceedings filed with the clerk of the court.   • Legal custodian: means a person who has legal custody of a juvenile. See Maine Revised Statutes Title 15 Sec. 3003
  • Legal custody: means the right to the care, custody and control of a juvenile and the duty to provide food, clothing, shelter, ordinary medical care, education and discipline for a juvenile, and, in an emergency, to authorize surgery or other extraordinary care. See Maine Revised Statutes Title 15 Sec. 3003
  • License: includes , but is not limited to, a nonresident operating privilege and the privilege of a person to apply for or obtain a license or permit to operate a motor vehicle. See Maine Revised Statutes Title 29-A Sec. 101
  • License: means a full, temporary, provisional or conditional license issued by the board under this chapter. See Maine Revised Statutes Title 32 Sec. 83
  • Licensed establishment: means premises to which a license for the sale of spirits, wine or malt liquor to be consumed on or off the licensed premises applies and any person or organization that is licensed to sell spirits, wine or malt liquor during the times and in the places and manners as specified in the license. See Maine Revised Statutes Title 28-A Sec. 2
  • Licensee: includes , but is not limited to, agency liquor stores and certificate of approval holders. See Maine Revised Statutes Title 28-A Sec. 2
  • Licensing agency: means the Division for the Blind and Visually Impaired, which is the state agency designated by the Rehabilitation Services Administration in the United States Department of Education to issue licenses to blind persons for the operation of vending facilities. See Maine Revised Statutes Title 26 Sec. 1418
  • Liquor: means spirits, wine, malt liquor or hard cider, or any substance containing liquor, intended for human consumption, that contains more than 1/2 of 1% of alcohol by volume. See Maine Revised Statutes Title 28-A Sec. 2
  • Low-alcohol spirits product: means a product containing spirits that has more than 1/2 of 1% of alcohol by volume but no more than 8% of alcohol by volume. See Maine Revised Statutes Title 28-A Sec. 2
  • Lower income households: means low-income and very low-income households as defined by the United States Department of Housing and Urban Development under the United States Housing Act of 1937, Public Law 75-412, 50 Stat. See Maine Revised Statutes Title 30-A Sec. 5002
  • Maine agency: means an agency of a foreign bank located in this State and established and operating pursuant to the provisions of this chapter. See Maine Revised Statutes Title 9-B Sec. 1311
  • Maine branch: means a branch of a foreign bank located in this State and established and operating pursuant to the provisions of this chapter. See Maine Revised Statutes Title 9-B Sec. 1311
  • Maine Emergency Medical Services: means the board, the emergency medical services director and staff within the Department of Public Safety responsible for carrying out the purposes of this chapter. See Maine Revised Statutes Title 32 Sec. 83
  • Maine Emergency Medical Services protocol: means the written statement, developed by the Medical Direction and Practices Board and filed with the board, specifying the conditions under which some form of emergency medical care is to be given by emergency medical services persons. See Maine Revised Statutes Title 32 Sec. 83
  • Maine representative office: means a representative office located in this State and established and operating pursuant to the provisions of this chapter. See Maine Revised Statutes Title 9-B Sec. 1311
  • Malt liquor: means liquor:

  • Manager: means the blind person, duly licensed by the division, who personally operates the vending facility. See Maine Revised Statutes Title 26 Sec. 1418
  • Manufacturer: means a person who distills, rectifies, brews, ferments, bottles or otherwise produces liquor. See Maine Revised Statutes Title 28-A Sec. 2
  • Medical control physician: means a physician who supervises emergency medical services persons. See Maine Revised Statutes Title 32 Sec. 83
  • Medical Direction and Practices Board: means the board consisting of each regional medical director, an emergency physician representing the Maine Chapter of the American College of Emergency Medicine Physicians, an at-large member, a toxicologist or licensed pharmacist, a person licensed under section 85 to provide basic emergency medical treatment, a person licensed under section 85 to provide advanced emergency medical treatment, a pediatric physician, the statewide associate emergency medical services medical director and the statewide emergency medical services medical director. See Maine Revised Statutes Title 32 Sec. 83
  • Minor: means a person who has not reached the age of 21 years. See Maine Revised Statutes Title 28-A Sec. 2
  • Moderate income households: means households in which gross income does not exceed 150% of the median income of the county or metropolitan statistical area in which the household is located. See Maine Revised Statutes Title 30-A Sec. 5002
  • Motor carrier: means a contract carrier, a common carrier or a private carrier of property or passengers by motor vehicle. See Maine Revised Statutes Title 29-A Sec. 101
  • Motor vehicle: means a self-propelled vehicle not operated exclusively on railroad tracks, but does not include:

  • Municipal officers: means :

  • Municipal officers: means the mayor and aldermen or councillors of a city, the members of the select board or councillors of a town and the assessors of plantations. See Maine Revised Statutes Title 28-A Sec. 2
  • Municipality: means a city, town or plantation. See Maine Revised Statutes Title 28-A Sec. 2
  • Nondepository trust company: means any financial institution organized under chapter 121 with powers generally limited to trust or fiduciary matters. See Maine Revised Statutes Title 9-B Sec. 131
  • Nonresident: means a person whose legal residence is not in the State. See Maine Revised Statutes Title 29-A Sec. 101
  • Nontransporting emergency medical service: means any organization, person or persons who hold themselves out as providers of emergency medical treatment and who do not routinely provide transportation to ill or injured persons, and who routinely offer or provide services to the general public beyond the boundaries of a single recreational site, business, school or other facility. See Maine Revised Statutes Title 32 Sec. 83
  • Officer of the court: means a judicial officer, including a judge, an attorney or an employee of the court including a clerk or a marshal. See Maine Revised Statutes Title 15 Sec. 3003
  • Online medical control: means the online physician, physician assistant or nurse practitioner, licensed by the State, authorized by a hospital to supervise and direct the actions of emergency medical services persons. See Maine Revised Statutes Title 32 Sec. 83
  • Operator: means an individual who drives or is in control of a vehicle or who is exercising control over or steering a towed vehicle. See Maine Revised Statutes Title 29-A Sec. 101
  • Operator: means a person who travels on and controls a bicycle or roller skis. See Maine Revised Statutes Title 29-A Sec. 2322
  • Order of adjudication: means any document, including but not limited to a judgment and commitment order including conditions of juvenile probation if imposed, any dismissal form or any written order that constitutes the final disposition of a juvenile petition. See Maine Revised Statutes Title 15 Sec. 3003
  • Outdoor stadium: means a commercially operated outdoor facility with 3,000 or more fixed seats that is designed or used for the playing of a sport or for an event, that is open to the public for a fee and that has adequate facilities for the sale and consumption of wine, malt liquor and spirits. See Maine Revised Statutes Title 28-A Sec. 2
  • Owner: means a person holding title to a vehicle or having exclusive right to the use of the vehicle for a period of 30 days or more. See Maine Revised Statutes Title 29-A Sec. 101
  • Parent: means either a natural parent or the adoptive parent of a juvenile. See Maine Revised Statutes Title 15 Sec. 3003
  • Permit: means the nontransferable permission granted by the commissioner pursuant to section 227?A to hold a display. See Maine Revised Statutes Title 8 Sec. 221-A
  • Person: means an individual, corporation, firm, partnership, joint venture, association, fiduciary, trust, estate or any other legal or commercial entity. See Maine Revised Statutes Title 29-A Sec. 101
  • Person: means any individual, combination of individuals, association, municipality, amusement park or other legal or commercial entity. See Maine Revised Statutes Title 8 Sec. 221-A
  • Person: means an individual, partnership, corporation, firm, association or other legal entity. See Maine Revised Statutes Title 28-A Sec. 2
  • Person: means a human being or an organization. See Maine Revised Statutes Title 12 Sec. 10001
  • Person with a disability: means an individual who has a physical or mental disability that constitutes a substantial barrier to employment but who can benefit in terms of an employment outcome from the provision of vocational rehabilitation services. See Maine Revised Statutes Title 26 Sec. 1411-A
  • Physician: has the meaning set forth in Title 24, section 2502, subsection 3. See Maine Revised Statutes Title 32 Sec. 83
  • Possession: means the intentional or knowing possession of what the possessor knows or believes to be fireworks. See Maine Revised Statutes Title 8 Sec. 221-A
  • Premises: includes the place where an incorporated civic organization sells or serves spirits, wine and malt liquor under a license obtained under section 1071. See Maine Revised Statutes Title 28-A Sec. 2
  • Probable cause: A reasonable ground for belief that the offender violated a specific law.
  • Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
  • Probation: means a legal status created by court order in cases involving a juvenile adjudicated as having committed a juvenile crime that permits the juvenile to remain in the juvenile's own home or other placement designated by the Juvenile Court subject to revocation for violation of any condition imposed by the court. See Maine Revised Statutes Title 15 Sec. 3003
  • Proximate audience technician: means a person licensed pursuant to section 231 who, by examination, experience and training, has demonstrated the required skill and competence in the use and discharge of fireworks proximate to an audience to conduct a display or special effects display proximate to an audience. See Maine Revised Statutes Title 8 Sec. 221-A
  • Public building or property: means a building or land owned, leased or occupied by a department, agency or authority of the State or a county or a municipality of the State. See Maine Revised Statutes Title 26 Sec. 1418
  • Public roadway: means a right-of-way under the jurisdiction and control of the State or a local political subdivision of the State for the use primarily by motor vehicular traffic. See Maine Revised Statutes Title 29-A Sec. 2322
  • Public way: means a way, owned and maintained by the State, a county or a municipality, over which the general public has a right to pass. See Maine Revised Statutes Title 29-A Sec. 101
  • Regional council: means a business entity recognized by the board that represents a geographical area of the State, as designated by the board, with respect to matters subject to this chapter. See Maine Revised Statutes Title 32 Sec. 83
  • Regions: means those geographical areas of the State designated by the board to be represented by a regional council. See Maine Revised Statutes Title 32 Sec. 83
  • Registration: means the registration certificate, plates and renewal devices pertaining to the registration of a vehicle, including temporary registered gross weight increases. See Maine Revised Statutes Title 29-A Sec. 101
  • Remand: When an appellate court sends a case back to a lower court for further proceedings.
  • Representative office: means any office of a foreign bank that is located in any state and is not a federal branch, federal agency, state branch, state agency or subsidiary of a foreign bank. See Maine Revised Statutes Title 9-B Sec. 1311
  • Reselling agent: means an agency liquor store with a federal and state license permitting the agency liquor store to sell spirits to a retail licensee licensed for on-premises consumption. See Maine Revised Statutes Title 28-A Sec. 2
  • residence: refer to an individual's place of domicile. See Maine Revised Statutes Title 30-A Sec. 2001
  • Resident: means a person who has declared or established residency in this State or has been domiciled in this State for a period of at least 30 days, except for persons in compliance with section 109, subsection 1. See Maine Revised Statutes Title 29-A Sec. 101
  • Restaurant: means a place that is regularly used for the purpose of providing food for the public and that has adequate and sanitary kitchen and dining room equipment and capacity for preparing and serving suitable food for the public. See Maine Revised Statutes Title 28-A Sec. 2
  • Restitution: The court-ordered payment of money by the defendant to the victim for damages caused by the criminal action.
  • Retail employee: means any person employed by a retailer to sell liquor in a licensed establishment or agency liquor store. See Maine Revised Statutes Title 28-A Sec. 2
  • retail licensee: means a person licensed by the bureau to engage in the purchase and resale of liquor in the original container or by the drink for on-premises or off-premises consumption. See Maine Revised Statutes Title 28-A Sec. 2
  • Secure detention facility: means a facility characterized by physically restrictive construction that is intended to prevent a person who is placed in or admitted to the facility from departing at will. See Maine Revised Statutes Title 15 Sec. 3003
  • sell: means any transfer or delivery of fireworks to a person for consideration. See Maine Revised Statutes Title 8 Sec. 221-A
  • sell: means any transfer or delivery of liquor for a consideration. See Maine Revised Statutes Title 28-A Sec. 2
  • Semitrailer: includes , but is not limited to, so-called pole dollies and pole dickeys and wheels commonly used as a support for the ends of logs or other long articles. See Maine Revised Statutes Title 29-A Sec. 101
  • Service of process: The service of writs or summonses to the appropriate party.
  • Shelter: means the temporary care of a juvenile in physically unrestricting facilities. See Maine Revised Statutes Title 15 Sec. 3003
  • Small distillery: means a person that engages in the activities under either paragraph A or B, or both:

  • Special effects display: includes the indoor use of pyrotechnics before a proximate audience. See Maine Revised Statutes Title 8 Sec. 221-A
  • Specialized customer communications equipment: includes but is not limited to teletypewriters, artificial larynges, signaling devices, amplified handsets, telecoil technology, large number dial overlays, direct telephone dialing and fax machines. See Maine Revised Statutes Title 26 Sec. 1419
  • Speech-impaired person: means a person whose speech is nonfunctional or defective for the purpose of ordinary communication. See Maine Revised Statutes Title 26 Sec. 1419
  • Spirits: means any liquor produced by distillation or, if produced by any other process, strengthened or fortified by the addition of spirits of any kind. See Maine Revised Statutes Title 28-A Sec. 2
  • Spirits supplier: means a person that provides spirits for sale by the bureau in the State, including:
  • A. See Maine Revised Statutes Title 28-A Sec. 2
  • state authority: means the Maine State Housing Authority. See Maine Revised Statutes Title 30-A Sec. 5002
  • State board: means the State Board of Education. See Maine Revised Statutes Title 20-A Sec. 1
  • Statewide associate emergency medical services medical director: means a licensed physician appointed by the board pursuant to section 84, subsection 1, paragraph C. See Maine Revised Statutes Title 32 Sec. 83
  • Temporary holding resource: means an area not in a jail or other secure detention facility intended or primarily used for the detention of adults that may be used to provide secure supervision for a juvenile for a period not to exceed 72 hours, excluding Saturday, Sunday and legal holidays, pending the completion of a procedure authorized by law to be taken in regard to a juvenile. See Maine Revised Statutes Title 15 Sec. 3003
  • Temporary supervision: means that supervision provided by an attendant delivering attendant care as defined in subsection 2?A. See Maine Revised Statutes Title 15 Sec. 3003
  • Tenant winery: means a person who has been issued an approved application for an alternating proprietorship from the United States Department of the Treasury, Alcohol and Tobacco Tax and Trade Bureau authorizing the winery to engage in an alternating proprietorship as defined by federal regulation and is licensed by the bureau to produce wine or hard cider at a manufacturing facility of another winery who is licensed by the bureau. See Maine Revised Statutes Title 28-A Sec. 2
  • Tractor: means a motor vehicle used primarily off the highway for farming, forestry or other similar types of activities. See Maine Revised Statutes Title 29-A Sec. 101
  • Traffic: means pedestrians, ridden or herded animals, vehicles, bicycles and other conveyances either singly or together using public way for travel. See Maine Revised Statutes Title 29-A Sec. 101
  • Traffic infraction: means any violation of any provision of this Title, or of any rules established under this Title, not expressly defined as a crime or as a civil violation and otherwise not punishable by incarceration. See Maine Revised Statutes Title 29-A Sec. 101
  • Trailer: means a vehicle without motive power, designed to carry persons or property and to be drawn by a motor vehicle, not operated on railroad tracks, and so constructed that no part of its weight rests upon the towing vehicle. See Maine Revised Statutes Title 29-A Sec. 101
  • Transcript: A written, word-for-word record of what was said, either in a proceeding such as a trial or during some other conversation, as in a transcript of a hearing or oral deposition.
  • Trap: means a device that is designed primarily to catch or hold wild animals, including, but not limited to, a foothold trap, a killer-type trap, a cage-type trap or a snare. See Maine Revised Statutes Title 12 Sec. 10001
  • Trauma: means a single or multisystem life-threatening or limb-threatening injury requiring immediate medical or surgical intervention or treatment to prevent death or permanent disability. See Maine Revised Statutes Title 32 Sec. 83
  • Trauma care system: means a subsystem within the emergency medical services system, consisting of an organized arrangement of personnel, equipment and facilities, designed to manage the treatment of the trauma patient. See Maine Revised Statutes Title 32 Sec. 83
  • Truck: means a motor vehicle designed and used primarily to carry property. See Maine Revised Statutes Title 29-A Sec. 101
  • Unincorporated place: means a place which is not incorporated as a municipality. See Maine Revised Statutes Title 28-A Sec. 2
  • Uphold: The decision of an appellate court not to reverse a lower court decision.
  • User fees: Fees charged to users of goods or services provided by the government. In levying or authorizing these fees, the legislature determines whether the revenue should go into the treasury or should be available to the agency providing the goods or services.
  • Vehicle: means a device for conveyance of persons or property on a way. See Maine Revised Statutes Title 29-A Sec. 101
  • Vending facility: means a restaurant, a cafeteria, including the cafeteria located in the State Office Building in Augusta, a snack bar, a vending machine for food and beverages and goods and services customarily offered in connection with a restaurant, a cafeteria, a snack bar or a vending machine. See Maine Revised Statutes Title 26 Sec. 1418
  • Way: means the entire width between boundary lines of a road, highway, parkway, street or bridge used for vehicular traffic, whether public or private. See Maine Revised Statutes Title 29-A Sec. 101
  • Wholesale licensee: means a person licensed by the bureau under section 1401 as an in-state wholesaler. See Maine Revised Statutes Title 28-A Sec. 2
  • Wholesale spirits provider: means a person that has a contract under section 90 to serve as an agent of the State for the purpose of providing wholesale spirits to establishments licensed by the State to sell spirits for off-premises consumption. See Maine Revised Statutes Title 28-A Sec. 2
  • Wholesaler: means a person that engages in the purchase and resale of malt liquor or wine, or both, in sealed bottles, containers or original packages, as prepared for the market by the manufacturer at the place of manufacture, but not for consumption, except during a taste-testing event conducted in accordance with the requirements of this Title. See Maine Revised Statutes Title 28-A Sec. 2
  • Wine: includes , but is not limited to, hard cider, wine coolers, table wine, still wine, sparkling wine, champagne and fortified wine that do not contain more than 24% alcohol by volume. See Maine Revised Statutes Title 28-A Sec. 2
  • Winery: means a person that ferments and ages wine. See Maine Revised Statutes Title 28-A Sec. 2
