1. Unauthorized conduct. Except as otherwise provided in this chapter, in the rules adopted pursuant to this chapter, in chapter 3 or in the Maine Medical Use of Cannabis Act or as specifically authorized pursuant to a license issued under this chapter, a person may not:
A. Cultivate, manufacture or test cannabis or cannabis products; [PL 2017, c. 409, Pt. A, §6 (NEW); PL 2021, c. 669, §5 (REV).]
B. Sell or offer for sale cannabis or cannabis products; [PL 2023, c. 6, §13 (AMD).]
C. Use, possess, transport, transfer, furnish or purchase cannabis or cannabis products; or [PL 2023, c. 6, §14 (AMD).]
D. Sell, offer for sale or furnish any products containing tobacco, nicotine or synthetic nicotine to any person without first obtaining a retail tobacco license in accordance with Title 22, chapter 262?A. [PL 2023, c. 6, §15 (NEW).]

Terms Used In Maine Revised Statutes Title 28-B Sec. 103
- Cannabis: includes cannabis concentrate but does not include hemp as defined in Title 7, section 2231, subsection 1?A, paragraph D or a cannabis product. See Maine Revised Statutes Title 28-B Sec. 102
- manufacture: means the production, blending, infusing, compounding or other preparation of cannabis and cannabis products, including, but not limited to, cannabis extraction or preparation by means of chemical synthesis. See Maine Revised Statutes Title 28-B Sec. 102
- Person: means a natural person or a business entity. See Maine Revised Statutes Title 28-B Sec. 102
- test: includes the collection of samples of cannabis and cannabis products for testing purposes, but does not include cultivation or manufacturing. See Maine Revised Statutes Title 28-B Sec. 102
2. Penalties. In addition to any penalties that may be imposed pursuant to this chapter or chapter 3, a person that violates any other provision of law or rule governing the conduct prohibited under subsection 1 is subject to any criminal or civil penalties that may be imposed pursuant to that other law or rule.
