1. Definitions. As used in this section, unless the context otherwise indicates, the following terms have the following meanings.
A. “Credentialing” means obtaining, verifying and assessing the qualifications of a health practitioner to provide treatment, care or services in or for a health facility. [PL 2017, c. 396, §5 (NEW).]
B. “Privileging” means the authorizing by an appropriate authority, such as a governing body, of a health practitioner to provide specific treatment, care or services at a health facility subject to limits based on factors that include license, education, training, experience, competence, health status and specialized skill. Terms Used In Maine Revised Statutes Title 37-B Sec. 949-F
- Emergency: means an event or condition that is an actual or imminent civil emergency or disaster or an actual or threatened epidemic or public health threat that is the subject of an emergency proclamation pursuant to section 742 or an emergency declaration pursuant to Title 22, section 802. - Health facility: means an entity licensed under the laws of this State or another state to provide health services or veterinary services. See Maine Revised Statutes Title 37-B Sec. 949-A
- Health practitioner: means an individual licensed under the laws of this State or another state to provide health services or veterinary services. See Maine Revised Statutes Title 37-B Sec. 949-A
- License: includes authorization under the laws of this State to an individual to provide health services or veterinary services based upon a national certification issued by a public or private entity. See Maine Revised Statutes Title 37-B Sec. 949-A
2. Health facility autonomy over credentialing and privileging. This chapter does not affect credentialing or privileging standards of a health facility and does not preclude a health facility from waiving or modifying those standards while an emergency declaration is in effect.
