1. Registration and records. Registration and other records of treatment facilities must remain confidential and are privileged to the patient.

Terms Used In Maine Revised Statutes Title 5 Sec. 20047
- Commissioner: means the Commissioner of Health and Human Services. See Maine Revised Statutes Title 5 Sec. 20003
- Treatment: means the broad range of emergency, outpatient, intermediate and inpatient services and care, including career counseling, diagnostic evaluation, employment, health, medical, psychiatric, psychological, recreational, rehabilitative, social service care, treatment and vocational services, that may be extended to a drug user, a person with substance use disorder or a person in need of assistance due to the use of a dependency-related drug. 2. Information for research. Notwithstanding subsection 1, the commissioner may make available information from patients’ records for purposes of research into the causes and treatment of substance use disorder. Information under this subsection may not be published in a way that discloses patients’ names or other identifying information.

3. (TEXT EFFECTIVE ON CONTINGENCY: See PL 2017, c. 243, §5) Medical emergency; methadone. Notwithstanding subsection 1, records relating to methadone treatment of a patient for the treatment of opioid dependency that have been entered into the Controlled Substances Prescription Monitoring Program established under Title 22, section 7248 may be disclosed in an emergency setting only to the extent necessary to meet a bona fide medical emergency in which the patient’s prior informed consent cannot be obtained and only to the health care professionals involved in treating the patient. Any disclosure of records pursuant to this subsection must be documented as described in Title 22, section 7250, subsection 7.
