- Accredited laboratory: means a DNA laboratory that has received formal recognition that it meets or exceeds a list of standards, including the FBI director's quality assurance standards, to perform specific tests, established by a nonprofit professional association of persons actively involved in forensic science that is nationally recognized within the forensic community in accordance with the provisions of the federal DNA identification act, 42 USC 14132, or subsequent laws. - Acquittal:
- Judgement that a criminal defendant has not been proved guilty beyond a reasonable doubt.
- A verdict of "not guilty."
- Adjourn: A motion to adjourn a legislative chamber or a committee, if passed, ends that day's session.
- Adult: means either of the following:
(i) An individual who is eligible to appeal a criminal conviction or exercise any other postconviction remedy. See Michigan Laws 780.711aAdult entertainment establishment: means either of the following:
(i) An adult entertainment establishment that holds a topless activity permit under section 916(3) of the Michigan liquor control code of 1998, 1998 PA 58, MCL 436. See Michigan Laws 752.1032Advice and consent: Under the Constitution, presidential nominations for executive and judicial posts take effect only when confirmed by the Senate, and international treaties become effective only when the Senate approves them by a two-thirds vote. Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths. Affirmed: In the practice of the appellate courts, the decree or order is declared valid and will stand as rendered in the lower court. Agency: means a board, official, or administrative agency empowered to make a decision, finding, ruling, assessment, determination, or order that is subject to review under the jurisdiction of the tribunal or that has collected a tax for which a refund is claimed. See Michigan Laws 205.703 Analyzed: means evaluating items for the presence of a body fluid, cellular material, or DNA followed by the testing of suitable items at forensic DNA regions for comparison purposes. See Michigan Laws 752.932 Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant. Appellate: About appeals; an appellate court has the power to review the judgement of another lower court or tribunal. Application assistant: means an employee or volunteer at an agency or organization that serves victims of domestic violence, stalking, human trafficking, or sexual assault who has received training and certification from the department of the attorney general to help individuals complete applications to become program participants. See Michigan Laws 780.853 Appraisal: A determination of property value. Arraignment: A proceeding in which an individual who is accused of committing a crime is brought into court, told of the charges, and asked to plead guilty or not guilty. Arrest: Taking physical custody of a person by lawful authority. Assaultive crime: includes any of the following:
(i) A violation described in section 9a of chapter X of the code of criminal procedure, 1927 PA 175, MCL 770. See Michigan Laws 780.621Attachment: A procedure by which a person's property is seized to pay judgments levied by the court. Attorney-at-law: A person who is legally qualified and licensed to practice law, and to represent and act for clients in legal proceedings. Bail: Security given for the release of a criminal defendant or witness from legal custody (usually in the form of money) to secure his/her appearance on the day and time appointed. Bequest: Property gifted by will. Board: means the human trafficking health advisory board created in section 3. See Michigan Laws 752.992 Board: means the organized retail crime advisory board created under section 6. See Michigan Laws 752.1083 Body-worn camera: means a device that is worn by a law enforcement officer that electronically records audio and video of his or her activities. See Michigan Laws 780.312 Chairperson: means the chairperson of the tribunal. See Michigan Laws 205.703 Chief judge: The judge who has primary responsibility for the administration of a court but also decides cases; chief judges are determined by seniority. Civil forfeiture: The loss of ownership of property used to conduct illegal activity. Claim: means any attempt to cause a health care corporation or health care insurer to make the payment of a health care benefit. See Michigan Laws 752.1002 Commission: means the sexual assault evidence kit tracking and reporting commission created in section 2. See Michigan Laws 752.961 Commission: means the human trafficking commission established in section 3. See Michigan Laws 752.972 Commission: means the Michigan commission on death and dying created in section 3. See Michigan Laws 752.1022 Commission: means the crime victim services commission described in section 2 of 1976 PA 223, MCL 18. See Michigan Laws 780.901 Common law: The legal system that originated in England and is now in use in the United States. It is based on judicial decisions rather than legislative action. Confidential address: means the address of a program participant's residence, as specified on an application to be a program participant or on a notice of change of information as provided under section 5 that is classified confidential by the department of the attorney general. See Michigan Laws 780.853 Contact point: means any electronic identification to which messages can be sent, including any of the following:
(i) An instant message identity. See Michigan Laws 752.1062Continuance: Putting off of a hearing ot trial until a later time. Conviction: means a judgment entered by a court upon a plea of guilty, guilty but mentally ill, or nolo contendere, or upon a jury verdict or court finding that a defendant is guilty or guilty but mentally ill. See Michigan Laws 780.621a Decedent: A deceased person. Decedent: means a deceased person and includes, but is not limited to, a testator, grantor, bargainor, vendor, donor, or person who dies intestate. See Michigan Laws 205.256 Deceptive: means making a claim to a health care corporation or health care insurer which contains a statement of fact or which fails to reveal a material fact, which statement or failure leads the health care corporation or health care insurer to believe the represented or suggested state of affair to be other than it actually is. See Michigan Laws 752.1002 Deed: The legal instrument used to transfer title in real property from one person to another. Department: means the department of state police, including its forensic science division. See Michigan Laws 752.932 Department: means the department of licensing and regulatory affairs. See Michigan Laws 752.1032 Department: means the department of labor and economic growth. See Michigan Laws 752.1062 Department: means the department of state police. See Michigan Laws 752.1083 Department: means the department of community health. See Michigan Laws 780.901 Department: means the bureau of revenue of the department of treasury. See Michigan Laws 205.256 Deposition: An oral statement made before an officer authorized by law to administer oaths. Such statements are often taken to examine potential witnesses, to obtain discovery, or to be used later in trial. Designated address: means the mailing address at which the department of technology, management, and budget receives mail to forward to program participants. See Michigan Laws 780.853 Devise: To gift property by will. Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial. Dismissal: The dropping of a case by the judge without further consideration or hearing. Source: Docket: A log containing brief entries of court proceedings. Domestic violence: means the occurrence of any of the following acts by a person that is not an act of self-defense:
(i) Causing or attempting to cause physical or mental harm to a family or household member. See Michigan Laws 780.853Donor: The person who makes a gift. Embezzlement: In most states, embezzlement is defined as theft/larceny of assets (money or property) by a person in a position of trust or responsibility over those assets. Embezzlement typically occurs in the employment and corporate settings. Source: OCC Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one. For example, a trial by jury is normally available in "law" cases but not in "equity" cases. Source: U.S. Courts Evidentiary audio and video recording: means an audio and video recording of an incident or encounter recorded by a body-worn camera, including a crime, arrest, citation, search, use of force incident, or confrontational encounter with a citizen, that may be materially useful for investigative or prosecutorial purposes, including for a criminal and internal investigation. See Michigan Laws 780.312 Extradition: The formal process of delivering an accused or convicted person from authorities in one state to authorities in another state. False: means wholly or partially untrue or deceptive. See Michigan Laws 752.1002 Family or household member: means that term as defined in section 1 of 1978 PA 389, MCL 400. See Michigan Laws 780.853 Federal generation-skipping transfer tax: means the tax imposed by chapter 13 of subtitle B of the internal revenue code. See Michigan Laws 205.256 Felony: means either of the following, as applicable:
(i) For purposes of the offense to be set aside, felony means a violation of a penal law of this state that is punishable by imprisonment for more than 1 year or that is designated by law to be a felony. See Michigan Laws 780.621Felony: means a violation of a penal law of this state for which the offender, upon conviction, may be punished by imprisonment for more than 1 year or an offense expressly designated by law to be a felony. See Michigan Laws 780.901 Fiduciary: A trustee, executor, or administrator. First violation operating while intoxicated offense: means a violation of any of the following committed by an individual who at the time of the violation has no prior convictions for violating section 625 of the Michigan vehicle code, 1949 PA 300, MCL 257. See Michigan Laws 780.621 Forensic laboratory: means a DNA laboratory that has received formal recognition that it meets or exceeds a list of standards, including the FBI director's quality assurance standards, to perform specific tests, established by a nonprofit professional association of persons actively involved in forensic science that is nationally recognized within the forensic community in accordance with the provisions of the federal DNA identification act, 42 USC 14132, or subsequent laws. See Michigan Laws 752.952 fresh pursuit: as used in this act shall include fresh pursuit as defined by the common law, and also the pursuit of a person who has committed a felony or who is reasonably suspected of having committed a felony. See Michigan Laws 780.105 Fund: means the crime victim's rights fund created under section 4. See Michigan Laws 780.901 Generation-skipping transfer: means every transfer subject to the federal generation-skipping transfer tax in which the original transferor is a resident of this state at the date of the transfer by the original transferor or the property transferred is real or personal property situated in this state. See Michigan Laws 205.256 Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value. Governmental entity: means this state, a local unit of government, or any department, agency, board, commission, or other instrumentality of this state or a local unit of government. See Michigan Laws 780.853 Grace period: The number of days you'll have to pay your bill for purchases in full without triggering a finance charge. Source: Federal Reserve Grand jury: agreement providing that a lender will delay exercising its rights (in the case of a mortgage, Grantor: The person who establishes a trust and places property into it. grantor: may be construed as including every person from or by whom any estate in lands passes in or by any deed. See Michigan Laws 8.3e Gross estate: The total fair market value of all property and property interests, real and personal, tangible and intangible, of which a decedent had beneficial ownership at the time of death before subtractions for deductions, debts, administrative expenses, and casualty losses suffered during estate administration. Gross estate: means the gross estate determined under the internal revenue code. See Michigan Laws 205.256 Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs. Guardian of a ward: means a person who has qualified as a guardian of a legally incapacitated individual under a court appointment. See Michigan Laws 780.853 Habeas corpus: A writ that is usually used to bring a prisoner before the court to determine the legality of his imprisonment. It may also be used to bring a person in custody before the court to give testimony, or to be prosecuted. Health care benefit: means the right under a contract or a certificate or policy of insurance to have a payment made by a health care corporation or health care insurer for a specified health care service. See Michigan Laws 752.1002 Health care corporation: means a nonprofit dental care corporation incorporated under Act No. See Michigan Laws 752.1002 Health care facility: includes a hospital, clinic, or urgent care center that is regulated under the public health code, 1978 PA 368, MCL 333. See Michigan Laws 752.932 Health care insurer: means any insurance company authorized to provide health insurance in this state or any legal entity which is self-insured and providing health care benefits to its employees. See Michigan Laws 752.1002 Health facility or agency: means a health facility or agency, as defined in section 20106 of the public health code, Act No. See Michigan Laws 752.1002 Human trafficking: means a violation of chapter LXVIIA of the Michigan penal code, 1931 PA 328, MCL 750. See Michigan Laws 752.972 Human trafficking: means a violation of chapter LXVIIA of the Michigan penal code, 1931 PA 328, MCL 750. See Michigan Laws 752.992 Human trafficking: means a violation of chapter LXVIIA of the Michigan penal code, 1931 PA 328, MCL 750. See Michigan Laws 780.853 Human trafficking notice: means the notice described in section 5. See Michigan Laws 752.1032 Human trafficking violation: means a violation of chapter LXVIIA of the Michigan penal code, 1931 PA 328, MCL 750. See Michigan Laws 780.621 Impeachment: (1) The process of calling something into question, as in "impeaching the testimony of a witness." (2) The constitutional process whereby the House of Representatives may "impeach" (accuse of misconduct) high officers of the federal government for trial in the Senate. Indian tribe: means an Indian tribe, Indian band, or Alaskan native village that is recognized by federal law or formally acknowledged by a state. See Michigan Laws 780.621 Indictment: The formal charge issued by a grand jury stating that there is enough evidence that the defendant committed the crime to justify having a trial; it is used primarily for felonies. Indigent: means that term as defined in section 3 of the Michigan indigent defense commission act, 2013 PA 93, MCL 780. See Michigan Laws 780.711a inflation rate: means the ratio of the general price level for the state fiscal year ending in the calendar year immediately preceding the current year divided by the general price level for the state fiscal year ending in the calendar year before the year immediately preceding the current year. See Michigan Laws 205.762 Interest rate: The amount paid by a borrower to a lender in exchange for the use of the lender's money for a certain period of time. Interest is paid on loans or on debt instruments, such as notes or bonds, either at regular intervals or as part of a lump sum payment when the issue matures. Source: OCC Internal revenue code: means the United States internal revenue code of 1986, in effect on January 1, 1998 or, at the option of the personal representative, in effect on the date of the decedent's death. See Michigan Laws 205.256 Internet domain name: means a globally unique, hierarchical reference to an internet host or service, assigned through centralized internet authorities, comprising a series of character strings separated by periods, with the right-most string specifying the top of the hierarchy. See Michigan Laws 752.1062 Interrogatories: Written questions asked by one party of an opposing party, who must answer them in writing under oath; a discovery device in a lawsuit. Intestate: Dying without leaving a will. Investigating law enforcement agency: means the local, county, or state law enforcement agency with the primary responsibility for investigating an alleged sexual assault offense case and includes the employees of that agency. See Michigan Laws 752.952 Joint meeting: An occasion, often ceremonial, when the House and Senate each adopt a unanimous consent agreement Juror: A person who is on the jury. Juvenile offense: means an offense committed by a juvenile under the jurisdiction of the juvenile division of the probate court or the family division of circuit court under section 2(a)(1) of chapter XIIA of the probate code of 1939, 1939 PA 288, MCL 712A. See Michigan Laws 780.901 knowingly: means that a person is in possession of facts under which he or she is aware or should be aware of the nature of his or her conduct and that his or her conduct is substantially certain to cause the payment of a health care benefit. See Michigan Laws 752.1002 Law enforcement agency: means the local, county, or state law enforcement agency with the primary responsibility for investigating an alleged sexual assault offense case and includes the employees of that agency. See Michigan Laws 752.932 Law enforcement agency: means the local, county, or state law enforcement agency and includes the employees of that agency. See Michigan Laws 752.952 Law enforcement agency: means that term as defined in section 2 of the Michigan commission on law enforcement standards act, 1965 PA 203, MCL 28. See Michigan Laws 780.853 Legislative council: means the legislative council established under section 15 of article IV of the state constitution of 1963. See Michigan Laws 752.1022 Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity. Lien: A claim against real or personal property in satisfaction of a debt. Local contribution: means an indigent defense system's average annual expenditure for attorney fees and expenses during the first 3 full fiscal years in which the system has complied with the standard procedure established under section 8a(2), excluding expenditures reimbursed under section 8a(4). See Michigan Laws 780.711a Local unit of government: means a city, village, township, or county in this state. See Michigan Laws 780.853 Majority leader: see Floor Leaders Mediation: means a voluntary process in which a mediator facilitates communication between parties, assists in identifying issues, and helps explore solutions to promote a mutually acceptable settlement. See Michigan Laws 205.703 Mediator: means a neutral third party who is certified by the tribunal under section 47 as a mediator in a proceeding before the tribunal or as a facilitator in the court of claims, and who is agreed to by the parties. See Michigan Laws 205.703 Michigan domestic and sexual violence prevention and treatment board: means the Michigan domestic and sexual violence prevention and treatment board created under EO 2012-17. See Michigan Laws 752.961 Minor: means an individual under the age of 18 years. See Michigan Laws 752.1062 Minor: means an individual under the age of 18 who is not emancipated under 1968 PA 293, MCL 722. See Michigan Laws 780.853 Minority leader: See Floor Leaders Misdemeanor: means a violation of any of the following:
(i) A penal law of this state, another state, an Indian tribe, or the United States that is not a felony. See Michigan Laws 780.621month: means a calendar month; the word "year" a calendar year; and the word "year" alone shall be equivalent to the words "year of our Lord". See Michigan Laws 8.3j Mortgage: The written agreement pledging property to a creditor as collateral for a loan. Municipally owned utility: means electric, gas, or water services provided by a municipality. See Michigan Laws 780.853 Nolo contendere: No contest-has the same effect as a plea of guilty, as far as the criminal sentence is concerned, but may not be considered as an admission of guilt for any other purpose. Operating while intoxicated: means a violation of any of the following that is not a first violation operating while intoxicated offense:
(i) Section 625 or 625m of the Michigan vehicle code, 1949 PA 300, MCL 257. See Michigan Laws 780.621Organized retail crime: means the theft of retail merchandise from a retail merchant with the intent or purpose of reselling, distributing, or otherwise reentering the retail merchandise in commerce, including the transfer of the stolen retail merchandise to another retail merchant or to any other person personally, through the mail, or through any electronic medium, including the internet, in exchange for anything of value. See Michigan Laws 752.1083 Original transferor: means any grantor, donor, trustor, testator, or person who by grant, gift, trust, will, or otherwise, makes a transfer of real or personal property that results in a federal generation-skipping transfer tax. See Michigan Laws 205.256 Owner: means a person who owns the sounds fixed in a master recording on which sound is recorded and from which the transferred sounds are directly or indirectly derived, or the person who owns the rights to record or authorize the recording of a live performance. See Michigan Laws 752.1051 Patient: means a person who engages in an act of voluntary self-termination. See Michigan Laws 752.1022 Penal institutions: includes a jail, prison, penitentiary, house of correction or other place of penal detention. See Michigan Laws 780.112 Person: means an individual, corporation, partnership, association, or any other legal entity. See Michigan Laws 752.1002 Person: means an individual, partnership, corporation, association, limited liability company, or other legal entity. See Michigan Laws 752.1051 Person: means an individual, corporation, association, partnership, or any other legal entity. See Michigan Laws 752.1062 Person: means an individual, sole proprietorship, partnership, cooperative, association, corporation, limited liability company, personal representative, receiver, trustee, assignee, or other entity. See Michigan Laws 752.1083 Person: means an individual, firm, partnership, joint venture, association, corporation, limited liability company, company, estate, or any other group or combination acting as a unit. See Michigan Laws 205.256 Personal property: All property that is not real property. Personal representative: means the personal representative appointed by the probate court, including an independent personal representative, or, if a personal representative is not acting, then any person who is in the actual or constructive possession of any property included in the gross estate of the decedent or any other person who is required to file a return or pay the taxes due under any provision of this act. See Michigan Laws 205.256 Plaintiff: The person who files the complaint in a civil lawsuit. Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court. Pleadings: Written statements of the parties in a civil case of their positions. In the federal courts, the principal pleadings are the complaint and the answer. Power of attorney: A written instrument which authorizes one person to act as another's agent or attorney. The power of attorney may be for a definite, specific act, or it may be general in nature. The terms of the written power of attorney may specify when it will expire. If not, the power of attorney usually expires when the person granting it dies. Source: OCC Precedent: A court decision in an earlier case with facts and law similar to a dispute currently before a court. Precedent will ordinarily govern the decision of a later similar case, unless a party can show that it was wrongly decided or that it differed in some significant way. Private place: means a place where an individual may reasonably expect to be safe from casual or hostile intrusion or surveillance but does not include a place to which the public or a substantial group of the public has access. See Michigan Laws 780.312 Probate: Proving a will Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed. Proceeding: means an appeal taken under this act. See Michigan Laws 205.703 Program: means the address confidentiality program created under this act. See Michigan Laws 780.853 Program participant: means an individual who is certified by the department of the attorney general as a program participant under section 5. See Michigan Laws 780.853 property: means the property or interest in property of the testator, intestate, grantor, bargainor, or vendor, passing or transferred to those not specifically exempted from this act, and not as the property or interest in property passing or transferred to the individual legatees, devisees, heirs, next of kin, grantees, donees, or vendees, and includes all property or interest in property whether situated within or without this state and including all property represented or evidenced by note, certificate, stock, land, contract, mortgage or other kind or character of evidence thereof, and regardless of whether that evidence of property is owned, kept or possessed within or without this state. See Michigan Laws 205.221 Prosecute: To charge someone with a crime. A prosecutor tries a criminal case on behalf of the government. Public health code: means Act No. See Michigan Laws 752.1022 Quorum: The number of legislators that must be present to do business. Recess: A temporary interruption of the legislative business. Recording: means the tangible medium upon which sounds or images are recorded or otherwise stored. See Michigan Laws 752.1051 Registry: means the child protection registry created under section 3. See Michigan Laws 752.1062 Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant. Remand: When an appellate court sends a case back to a lower court for further proceedings. Resident: means that term as defined in section 18 of the income tax act of 1967, 1967 PA 281, MCL 206. (a) Real property exempt under section 7cc of the general property tax act, 1893 PA 206, MCL 211. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims. Sexual assault: means a violation, attempted violation, or solicitation or conspiracy to commit a violation of section 520b, 520c, 520d, 520e, or 520g of the Michigan penal code, 1931 PA 328, MCL 750. See Michigan Laws 780.853 Sexual assault evidence kit: means that term as defined in section 21527 of the public health code, 1978 PA 368, MCL 333. Surety: means one who executes a bail bond and binds himself to pay the bail if the person in custody fails to comply with all conditions of the bail bond. (i) The local unit of government that funds a trial court. See Michigan Laws 780.711aTestator: A male person who leaves a will at death. Testify: Answer questions in court. Tort: A civil wrong or breach of a duty to another person, as outlined by law. A very common tort is negligent operation of a motor vehicle that results in property damage and personal injury in an automobile accident. Transcript: A written, word-for-word record of what was said, either in a proceeding such as a trial or during some other conversation, as in a transcript of a hearing or oral deposition. Transfer: includes the passing of property or an interest in property in possession or enjoyment, present or future, by inheritance, descent, devise, bequest, grant, deed, bargain, sale, or gift in the manner prescribed in this act. See Michigan Laws 205.221 Transfer tax: includes an estate, generation-skipping, inheritance, legacy, or succession tax for residents and nonresidents, including aliens. See Michigan Laws 205.256 Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence. Tribunal: means the tax tribunal created under section 21. See Michigan Laws 205.703 Trustee: A person or institution holding and administering property in trust. Trustor: The person who makes or creates a trust. Also known as the grantor or settlor. United States: when used in a geographical sense includes only the 50 states and the District of Columbia. See Michigan Laws 205.256 Venue: The geographical location in which a case is tried. Verdict: The decision of a petit jury or a judge. Victim: means , for the purposes of making communications and receiving notices under this act, an individual who was subjected to a sexual assault offense. See Michigan Laws 752.932 victim: means a victim of a violation of chapter LXVIIA of the Michigan penal code, 1931 PA 328, MCL 750. See Michigan Laws 752.982 Victim: means that term as defined in sections 2, 31, and 61 of the William Van Regenmorter crime victim's rights act, 1985 PA 87, MCL 780. See Michigan Laws 780.621 Victim: means an individual who suffers direct or threatened physical, financial, or emotional harm as the result of a commission of a crime. See Michigan Laws 780.853 Victim advocate: work with prosecutors and assist the victims of a crime. Victim advocate: means an employee of the department of the attorney general, the department of state, or the department of technology, management, and budget, or an employee of a county prosecutor's office, who has received training and certification from the department of the attorney general to help individuals complete applications to become program participants, and who is available to help individuals complete the applications and is responsible for assisting program participants in navigating through and accessing all aspects of the program. See Michigan Laws 780.853 Violent felony: means that term as defined in section 36 of the corrections code of 1953, 1953 PA 232, MCL 791. See Michigan Laws 780.621 Ward: means that term as defined in section 1108 of the estates and protected individuals code, 1998 PA 386, MCL 700. See Michigan Laws 780.853 Witness: means a person who is confined in a penal institution in any state and whose testimony is desired in another state in any criminal proceeding or investigation by a grand jury or in any criminal action before a court. See Michigan Laws 780.112 Writ: A formal written command, issued from the court, requiring the performance of a specific act. Youth: means an individual who is eligible to appeal an order issued under section 2(a), (d), or (h) of chapter XIIA of the probate code of 1939, 1939 PA 288, MCL 712A. See Michigan Laws 780.711a
