- Adjourn: A motion to adjourn a legislative chamber or a committee, if passed, ends that day's session.
- Adjusted gross receipts: means the gross receipts less winnings paid to wagerers. See Michigan Laws 432.202
- Administrator: means the director of commerce or his or her designated representative. See Michigan Laws 429.31

- Affiliate: means a person who, directly or indirectly, through 1 or more intermediaries, controls a casino licensee under this act. See Michigan Laws 432.202
- Affiliate: means a person who, directly or indirectly, through 1 or more intermediaries, controls, is controlled by, or is under common control with; is in a partnership or joint venture relationship with; or is a co-shareholder of a corporation, a co-member of a limited liability company, or co-partner in a limited liability partnership with a person who holds or applies for a casino license under this act. - Affiliated company: means any form of business organization that controls, a casino licensee under this act. See Michigan Laws 432.202
- Affirmed: In the practice of the appellate courts, the decree or order is declared valid and will stand as rendered in the lower court.
- Agent: means any person who is employed by any agency of this state, other than the board, the state police, or the department of attorney general, who is assigned to perform full-time services on behalf of or for the benefit of the board regardless of the title or position held by that person. See Michigan Laws 432.202
- Agent orange: means that term as defined in section 5701 of the public health code, 1978 PA 368, MCL 333. See Michigan Laws 421.151
- Allegation: something that someone says happened.
- Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
- American aircraft: means an aircraft registered under the laws of the United States. See Michigan Laws 421.56
- American vessel: as used in this act means a vessel documented or numbered under the laws of the United States, or a vessel which is neither documented nor numbered under the laws of the United States nor documented under the laws of any foreign country, if its crew is employed solely by 1 or more citizens or residents of the United States or corporations organized under the laws of the United States or of any state. See Michigan Laws 421.56
- annual meeting: when applied to townships, mean the annual meeting required by law to be held on the Saturday immediately preceding the first Monday in April. See Michigan Laws 8.3d
- Annuity: A periodic (usually annual) payment of a fixed sum of money for either the life of the recipient or for a fixed number of years. A series of payments under a contract from an insurance company, a trust company, or an individual. Annuity payments are made at regular intervals over a period of more than one full year.
- Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
- Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
- Appellate: About appeals; an appellate court has the power to review the judgement of another lower court or tribunal.
- Appliance: means an item of equipment which provides heating, cooling, cleaning, washing, drying, entertainment, or other services by converting energy in the form of fossil fuels or electricity into thermal energy or work and is generally used in or around a permanent or temporary household or residence, or in a commercial establishment. See Michigan Laws 429.351
- Applicant: means the person filing an application for registration of a trademark or service mark under this act, his or her legal representatives, successors, or assigns. See Michigan Laws 429.31
- Applicant: means any person who applies for a license or for registration under this act. See Michigan Laws 432.202
- Appraisal: A determination of property value.
- Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
- Armed forces: means the United States Army, Air Force, Navy, Marine Corps, Space Force, or Coast Guard or other military force designated by Congress as part of the Armed Forces of the United States, including the reserve components. See Michigan Laws 333.16103
- Arrest: Taking physical custody of a person by lawful authority.
- Assessed value: means the taxable value as determined under section 27a of the general property tax act, 1893 PA 206, MCL 211. See Michigan Laws 125.4602

- Authority: means a corridor improvement authority created under section 604(1) or a joint authority created under section 604(2). See Michigan Laws 125.4602
- Authority: means a water resource improvement tax increment finance authority created under this part. See Michigan Laws 125.4702
- Authority: means a neighborhood improvement authority created under this part. See Michigan Laws 125.4802
- Automated payment: means an electronic payment method authorized by the state court administrative office at the direction of the supreme court, including, but not limited to, payments made with credit and debit cards. See Michigan Laws 600.1985
- Bail: Security given for the release of a criminal defendant or witness from legal custody (usually in the form of money) to secure his/her appearance on the day and time appointed.
- Bailiff: a court officer who enforces the rules of behavior in courtrooms.
- Balance: means :
(1) As applied to an employer's experience account or to the nonchargeable benefits account, the initial balance of that account plus the credits and minus the charges that are made in accordance with this act. See Michigan Laws 421.18Bankruptcy: Refers to statutes and judicial proceedings involving persons or businesses that cannot pay their debts and seek the assistance of the court in getting a fresh start. Under the protection of the bankruptcy court, debtors may discharge their debts, perhaps by paying a portion of each debt. Bankruptcy judges preside over these proceedings. Bargaining representative: means a labor organization recognized by an employer or certified by the commission as the sole and exclusive bargaining representative of certain employees of the employer. See Michigan Laws 423.201 Bed and breakfast: means that term as defined in section 4b of the Stille-DeRossett-Hale single state construction code act, 1972 PA 230, MCL 125. See Michigan Laws 427.301 Beneficiary: A person who is entitled to receive the benefits or proceeds of a will, trust, insurance policy, retirement plan, annuity, or other contract. Source: OCC Board: means the Michigan gaming control board created under section 4. See Michigan Laws 432.202 Board: means the governing body of an authority. See Michigan Laws 125.4602 Board: means the governing body of an authority. See Michigan Laws 125.4702 Board: means the governing body of an authority. See Michigan Laws 125.4802 Board: as used in this part means each board created in this article and as used in any other part covering a specific health profession means the board created in that part. See Michigan Laws 333.16103 Breaks: means the cents over any multiple of 10 otherwise payable to a patron on a wager of $1. See Michigan Laws 431.302 Bureau: means the bureau of state lottery created by this act. See Michigan Laws 432.3 Captured assessed value: means the amount in any 1 year by which the current assessed value of the development area, including the assessed value of property for which specific local taxes are paid in lieu of property taxes as determined in section 603(e), exceeds the initial assessed value. See Michigan Laws 125.4602 Captured assessed value: means the amount in any 1 year by which the current assessed value of the development area, including the assessed value of property for which specific local taxes are paid in lieu of property taxes as determined in section 803(d), exceeds the initial assessed value. See Michigan Laws 432.252 Casino enterprise: means the buildings, facilities, or rooms functionally or physically connected to a casino, including but not limited to any bar, restaurant, hotel, cocktail lounge, retail establishment, or arena or any other facility located in a city under the control of a casino licensee. See Michigan Laws 432.202 Casino enterprise: means the buildings, facilities, or rooms functionally or physically connected to a casino, including but not limited to any bar, restaurant, hotel, cocktail lounge, retail establishment, or arena, or any other facility located in a city under the control of a casino licensee or an affiliate of a casino licensee company. See Michigan Laws 432.272 casino gaming: means to deal, operate, carry on, conduct, maintain or expose or offer for play any gambling game or gambling operation. See Michigan Laws 432.202 Caucus: From the Algonquian Indian language, a caucus meant "to meet together." An informal organization of members of the legislature that exists to discuss issues of mutual concern and possibly to perform legislative research and policy planning for its members. There are regional, political or ideological, ethnic, and economic-based caucuses. Certificate of licensure: means a document issued as evidence of authorization to practice and use a designated title. See Michigan Laws 333.16103 Certificate of registration: means a document issued as evidence of authorization to use a designated title. See Michigan Laws 333.16103 Certified development agreement: means a development agreement that has been certified by a city and submitted to the board. See Michigan Laws 432.202 Chairperson: means the chairperson of the board. See Michigan Laws 432.202 Chambers: A judge's office. Charity: An agency, institution, or organization in existence and operating for the benefit of an indefinite number of persons and conducted for educational, religious, scientific, medical, or other beneficent purposes. Chief executive officer: means the mayor of a city, the president of a village, or the supervisor of a township. See Michigan Laws 125.4602 Chief executive officer: means the mayor or city manager of a city, the president or village manager of a village, or the supervisor of a township. See Michigan Laws 125.4702 Chief executive officer: means the mayor or city manager of a city or the president or village manager of a village. See Michigan Laws 125.4802 Chief judge: The judge who has primary responsibility for the administration of a court but also decides cases; chief judges are determined by seniority. City: means a local unit of government other than a county that meets all of the following criteria:
(i) Has a population of at least 800,000 at the time a license is issued. See Michigan Laws 432.202Civil action: means an action that is not a criminal case, a civil infraction action, a proceeding commenced in the probate court under section 3982 of the estates and protected individuals code, 1988 PA 386, MCL 700. See Michigan Laws 600.1985 Civil infraction: means an act or omission that is prohibited by a law and is not a crime under that law or that is prohibited by an ordinance, as defined in section 8701, and is not a crime under that ordinance, and for which civil sanctions may be ordered. See Michigan Laws 600.113 Class of appliances: means a group of appliances whose functions or features are similar, and whose range of energy use or energy efficiency may be of interest to consumers. See Michigan Laws 429.351 Clerk: means the clerk of the court referenced in the rules of the supreme court and includes the clerk of the supreme court, chief clerk of the court of appeals, county clerk, probate register, district court clerk, or clerk of the court of claims where the civil action is commenced, as applicable. See Michigan Laws 600.1985 Co-occurring disorder: means having 1 or more disorders relating to the use of alcohol or other controlled substances of abuse as well as any serious mental illness, serious emotional disturbance, or developmental disability. See Michigan Laws 600.1090 Co-occurring disorder: means having 1 or more disorders relating to the use of alcohol or other controlled substances of abuse as well as any serious mental illness, serious emotional disturbance, or developmental disability. See Michigan Laws 600.1099b Commission: means the employment relations commission created by section 3. See Michigan Laws 423.2 Commission: means the employment relations commission created in section 3 of 1939 PA 176, MCL 423. See Michigan Laws 423.201 Commission: means the Michigan public service commission. See Michigan Laws 429.351 Commissioner: means the commissioner of state lottery. See Michigan Laws 432.3 Common law: The legal system that originated in England and is now in use in the United States. It is based on judicial decisions rather than legislative action. Community-based organization: means a private, nonprofit organization that is representative of a community or of a significant segment of a community and which provides employment and job training services. See Michigan Laws 421.151 Company: means a sole proprietorship, corporation, partnership, limited liability partnership, limited liability company, trust, association, joint stock company, joint venture, tribal corporation, or other form of business organization. See Michigan Laws 432.202 Company union: includes any employee association, committee, agency, or representation plan, formed or existing for the purpose, in whole or in part, of dealing with employers concerning grievances or terms and conditions of employment, which in any manner or to any extent, and by any form of participation, interference, or assistance, financial or otherwise, either in its organization, operation, or administration, is dominated or controlled, sponsored or supervised, maintained, directed, or financed by the employer. See Michigan Laws 423.2 Compensation: means any money, thing of value, or financial benefit conferred on or received by a person in return for services rendered, or to be rendered, whether by that person or another. See Michigan Laws 432.202 Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant. Comprehensive job training and related services: includes recruitment, counseling, motivational prejob training, vocational training, job development, job placement, and other appropriate services enabling individuals to secure and retain employment at their maximum capacity. See Michigan Laws 421.151 Computation date: means June 30 of each year. See Michigan Laws 421.18 Concurrent resolution: A legislative measure, designated "S. Con. Res." and numbered consecutively upon introduction, generally employed to address the sentiments of both chambers, to deal with issues or matters affecting both houses, such as a concurrent budget resolution, or to create a temporary joint committee. Concurrent resolutions are not submitted to the President/Governor and thus do not have the force of law. Conflict of interest: means a situation in which the private interest of a member, employee or agent of the board may influence the judgment of the member, employee, or agent in the performance of his or her public duty under this act. See Michigan Laws 432.202 Consumer: means the first person who purchases a new appliance for purposes other than resale. See Michigan Laws 429.351 Continuance: Putting off of a hearing ot trial until a later time. Contract: A legal written agreement that becomes binding when signed. Control: means having a greater than 15% direct or indirect pecuniary interest in the casino gaming operation with respect to which the license is sought. See Michigan Laws 432.202 Controlled substance: means that term as defined in section 7104 of the public health code, 1978 PA 368, MCL 333. See Michigan Laws 431.302 Controlled substance: means that term as defined in section 7104. See Michigan Laws 333.16103 Conviction: A judgement of guilt against a criminal defendant. Conviction: means a judgment entered by a court on a plea of guilty, guilty but mentally ill, or nolo contendere or on a jury verdict or court finding that a defendant is guilty or guilty but mentally ill. See Michigan Laws 333.16103 Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name. Cost criterion: means the number arrived at as of each computation date through the following calculations:
(i) With respect to each period of 12 consecutive months starting after 1956, calculate the percentage ratio of the benefits paid during the 12 months to the aggregate amount of the payrolls paid by employers within the most recent calendar year completed before the start of the 12-month period. See Michigan Laws 421.18Counterclaim: A claim that a defendant makes against a plaintiff. counterclaim: as used in this act , includes setoff and recoupment. See Michigan Laws 600.111 Court funding unit: means that term as defined in section 151e of the revised judicature act of 1961, 1961 PA 236, MCL 600. See Michigan Laws 600.1090 Court funding unit: means that term as defined in section 151e. See Michigan Laws 600.1099b Court funding unit: means 1 of the following, as applicable:
(i) For circuit or probate court, the county. See Michigan Laws 600.1985Court reporter: A person who makes a word-for-word record of what is said in court and produces a transcript of the proceedings upon request. Credit bureau: An agency that collects individual credit information and sells it for a fee to creditors so they can make a decision on granting loans. Typical clients include banks, mortgage lenders, credit card companies, and other financing companies. (Also commonly referred to as consumer-reporting agency or credit-reporting agency.) Source: OCC Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries. Dating relationship: means that term as defined in section 2950. See Michigan Laws 600.1060 Day of operation: means a period of 24 hours beginning at 12 noon and ending at 11:59 a. See Michigan Laws 431.302 Decedent: A deceased person. Deed: The legal instrument used to transfer title in real property from one person to another. Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime. Department: means the department of labor. See Michigan Laws 421.222 Department: means the state department of labor. See Michigan Laws 423.321 Department: means the department of treasury. See Michigan Laws 432.202 Department: means the department of state. See Michigan Laws 432.272 Department: means the department of health and human services. See Michigan Laws 600.1099aa Department: means the state transportation department. See Michigan Laws 125.4507 Dependent: A person dependent for support upon another. Deposition: An oral statement made before an officer authorized by law to administer oaths. Such statements are often taken to examine potential witnesses, to obtain discovery, or to be used later in trial. Development agreement: means a written agreement between a city and a person naming the person as the designated developer of a casino in the city and covering certain subjects including, but not limited to, all of the following:
(i) Approval by the city of the location of the casino. See Michigan Laws 432.202Development area: means that area described in section 605 to which a development plan is applicable. See Michigan Laws 125.4602 Development area: means that area described in section 805 to which a development plan is applicable. See Michigan Laws 125.4702 Development area: means that area described in section 805 to which a development plan is applicable. See Michigan Laws 125.4802 Development plan: means that information and those requirements for a development area set forth in section 621. See Michigan Laws 432.202 Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial. Dismissal: The dropping of a case by the judge without further consideration or hearing. Source: Distressed area: means a local governmental unit that meets all of the following:
(i) Has a population of 700,000 or more. See Michigan Laws 125.4603district: means 1 or more of the following:
(i) An inland body of water and land that is up to 1 mile from the shoreline of an inland lake that contains 1 or more public access points. See Michigan Laws 125.4703Docket: A log containing brief entries of court proceedings. Domestic violence offense: means any crime alleged to have been committed by an individual against his or her spouse or former spouse, an individual with whom he or she has a child in common, an individual with whom he or she has had a dating relationship, or an individual who resides or has resided in the same household. See Michigan Laws 600.1060 Domestic violence offense: means any crime alleged to have been committed by an individual against his or her spouse or former spouse, an individual with whom he or she has a child in common, an individual with whom he or she has had a dating relationship, or an individual who resides or has resided in the same household. (i) A substance intended for use in the diagnosis, cure, mitigation, treatment, or prevention of disease in humans or other animals. See Michigan Laws 431.302Drug treatment court: means a court supervised treatment program for individuals who abuse or are dependent upon any controlled substance or alcohol. See Michigan Laws 600.1060 Economically disadvantaged: means an individual who meets at least 1 of the following criteria:
(i) Receives, or is a member of a family which receives, cash welfare payments under a federal, state, or local welfare program. See Michigan Laws 421.151Electronic filing system: means a system authorized after the effective date of the amendatory act that added this chapter by the supreme court for the electronic filing of documents using a portal contracted for by the state court administrative office for the filing of documents in the supreme court, court of appeals, circuit court, probate court, district court, and court of claims. See Michigan Laws 600.1985 Electronic filing system fee: means the fee described in section 1986. See Michigan Laws 600.1985 Electronic funds transfer: The transfer of money between accounts by consumer electronic systems-such as automated teller machines (ATMs) and electronic payment of bills-rather than by check or cash. (Wire transfers, checks, drafts, and paper instruments do not fall into this category.) Source: OCC Emancipated minor: means a minor who is emancipated under section 4 of 1968 PA 293, MCL 722. See Michigan Laws 427.301 Embezzlement: In most states, embezzlement is defined as theft/larceny of assets (money or property) by a person in a position of trust or responsibility over those assets. Embezzlement typically occurs in the employment and corporate settings. Source: OCC Emergency medical service personnel: includes a person who provides assistance at dispatched or observed medical emergencies occurring outside a recognized medical facility including instances of heart attack, stroke, injury accidents, electrical accidents, drug overdoses, imminent childbirth, and other instances where there is the possibility of death or further injury; initiates stabilizing treatment or transportation of injured from the emergency site; and notifies police or interested departments of certain situations encountered including criminal matters, poisonings, and the report of contagious diseases. See Michigan Laws 423.232 Emergency telephone operator: includes a person employed by a police or fire department for the purpose of relaying emergency calls to police, fire, or emergency medical service personnel. See Michigan Laws 423.232 Employee: includes any employee, and is not limited to the employees of a particular employer, unless this act explicitly provides otherwise, and includes any individual whose work has ceased as a consequence of, or in connection with, any current labor dispute or because of any act that is illegal under this act, and who has not obtained any other regular and substantially equivalent employment, but does not include any individual employed as an agricultural laborer, or in the domestic service of any family or any person at the person's home, or any individual employed by the person's parent or spouse, or any individual employed as an executive or supervisor, or any individual employed by an employer subject to the railway labor act, 45 USC 151 to 188, or by any other person who is not an employer. See Michigan Laws 423.2 Employee: means an individual who as a volunteer or for compensation provides an employer with his or her labor. See Michigan Laws 423.451 Employee: means a person currently employed or formerly employed by an employer. See Michigan Laws 423.501 employer: includes an Indian tribe or tribal unit for which services are performed in employment as defined in subsection (9). See Michigan Laws 421.13l Employer: means an individual, partnership, corporation, or other legal entity that employs or plans to employ skilled workers. See Michigan Laws 421.222 Employer: means a person and includes any person acting as an agent of an employer, but does not include the United States or any corporation wholly owned by the United States; any federal reserve bank; any employer subject to the railway labor act, 45 USC 151 to 188; this state or a political subdivision of this state; or any labor organization, or anyone acting in the capacity of officer or agent of a labor organization, other than when acting as an employer. See Michigan Laws 423.2 Employer: means an individual, partnership, corporation, or other association, or a city, village, township, or county that employs 2 or more persons. See Michigan Laws 423.321 Employer: means a person who employs an individual for compensation or who supervises an individual providing labor as a volunteer. See Michigan Laws 423.451 Employer: means an individual, corporation, partnership, labor organization, unincorporated association, the state, or an agency or a political subdivision of the state, or any other legal, business, or commercial entity which has 4 or more employees and includes an agent of the employer. See Michigan Laws 423.501 employment: includes service performed in the employ of an Indian tribe or tribal unit, if the service is excluded from employment as that term is defined in the federal unemployment tax act, chapter 23 of subtitle C of the internal revenue code of 1986, 26 U. See Michigan Laws 421.13l Energy efficiency: means the energy use of a product relative to its output of services, as determined through test procedures contained or identified in a rule promulgated under this act. See Michigan Laws 429.351 Energy use: means the energy resources used by a product under conditions of use approximating actual operating conditions insofar as practical, as determined through test procedures contained or identified in a rule promulgated under this act. See Michigan Laws 429.351 Entitlement: A Federal program or provision of law that requires payments to any person or unit of government that meets the eligibility criteria established by law. Entitlements constitute a binding obligation on the part of the Federal Government, and eligible recipients have legal recourse if the obligation is not fulfilled. Social Security and veterans' compensation and pensions are examples of entitlement programs. Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one. For example, a trial by jury is normally available in "law" cases but not in "equity" cases. Source: U.S. Courts Escrow: Money given to a third party to be held for payment until certain conditions are met. Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other. Ex officio: Literally, by virtue of one's office. Ex parte communication: means any communication, direct or indirect, regarding a licensing application, disciplinary action, or a contested case under this act other than communication that takes place during a meeting or hearing conducted under this act. See Michigan Laws 432.202 Executor: A male person named in a will to carry out the decedent Experience account: means an account in the unemployment compensation fund showing an employer's experience with respect to contribution payments and benefit charges under this act, determined and recorded in the manner provided in this act. See Michigan Laws 421.3 Extradition: The formal process of delivering an accused or convicted person from authorities in one state to authorities in another state. Fair: means a county, district, or community fair or a state fair. See Michigan Laws 431.302 family: means all individuals whom the child and parent define as family. See Michigan Laws 600.1099aa Family treatment court: means either of the following:
(i) A court-supervised treatment program for individuals with a civil child abuse or neglect case and who are diagnosed with a substance use disorder. See Michigan Laws 600.1099aaFamily-centered: means a treatment approach that is designed to meet the needs of each member of a family, not just the individual diagnosed with a substance abuse disorder, and recognizes that families are diverse and can be made up of nuclear family members, extended family members, fictive kin, and nonblood relations. See Michigan Laws 600.1099aa Fiduciary: A trustee, executor, or administrator. financially interested: means any interest in investments, awarding of contracts, grants, loans, purchases, leases, sales, or similar matters under consideration or consummated by the board. See Michigan Laws 432.202 fire department: means lawfully organized fire fighting forces, however constituted, including personnel. See Michigan Laws 419.201 Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006. Fiscal year: means the fiscal year of the authority. See Michigan Laws 125.4602 Fiscal year: means the fiscal year of the authority. See Michigan Laws 125.4702 Foreclosure: A legal process in which property that is collateral or security for a loan may be sold to help repay the loan when the loan is in default. Source: OCC Foreign subpoena: means a subpoena issued under authority of a court of record of a foreign jurisdiction. See Michigan Laws 600.2202 Foreign substance: means a substance, or its metabolites, that does not exist naturally in an untreated horse or, if natural to an untreated horse, exists at an unnaturally high physiological concentration as a result of having been administered to the horse. See Michigan Laws 431.302 Fraud: Intentional deception resulting in injury to another. Freedom of Information Act: A federal law that mandates that all the records created and kept by federal agencies in the executive branch of government must be open for public inspection and copying. The only exceptions are those records that fall into one of nine exempted categories listed in the statute. Source: OCC Gambling game: means any game played with cards, dice, equipment or a machine, including any mechanical, electromechanical or electronic device including computers and cashless wagering systems, for money, credit, or any representative of value, including, but not limited to, faro, monte, roulette, keno, bingo, fan tan, twenty one, blackjack, seven and a half, klondike, craps, poker, chuck a luck, Chinese chuck a luck (dai shu), wheel of fortune, chemin de fer, baccarat, pai gow, beat the banker, panguingui, slot machine, any banking or percentage game, or any other game or device approved by the board. See Michigan Laws 432.202 Garnishment: Generally, garnishment is a court proceeding in which a creditor asks a court to order a third party who owes money to the debtor or otherwise holds assets belonging to the debtor to turn over to the creditor any of the debtor Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value. Governing body: means , except as otherwise provided in this subdivision, the elected body having legislative powers of a municipality creating an authority under this part. See Michigan Laws 125.4402 governing body of a municipality: means the elected body of a municipality having legislative powers or, for a joint authority created under section 604(2), the elected body of each municipality having legislative powers that is a member of the joint authority. See Michigan Laws 125.4602 governing body of a municipality: means the elected body of a municipality having legislative powers. See Michigan Laws 125.4702 governing body of a municipality: means the elected body of a municipality having legislative powers. See Michigan Laws 125.4802 governmental entity: means this state or any of its instrumentalities, a county, city, township, village, school district, community college district, community hospital district, any agency authorized to exercise a governmental function in a limited geographical area, or other political subdivision, any instrumentality of 1 or more of these units, or any of these units and 1 or more other states or political subdivisions of those states. See Michigan Laws 421.50a Grand jury: agreement providing that a lender will delay exercising its rights (in the case of a mortgage, Gross receipts: means the total of all sums including valid or invalid checks, currency, tokens, coupons, vouchers, or instruments of monetary value whether collected or uncollected, received by a casino licensee from gaming, including all entry fees assessed for tournaments or other contests, less a deduction for uncollectible gaming receivables not to exceed the uncollectible amounts owed as a result of wagers placed at or through a gambling game or 4% of the total gross receipts, whichever is less. See Michigan Laws 432.202 Guarantor: A party who agrees to be responsible for the payment of another party's debts should that party default. Source: OCC Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs. Habeas corpus: A writ that is usually used to bring a prisoner before the court to determine the legality of his imprisonment. It may also be used to bring a person in custody before the court to give testimony, or to be prosecuted. Hotel: means that term as defined in section 1 of 1913 PA 188, MCL 427. See Michigan Laws 427.301 Housing: means publicly owned housing, individual or multifamily. See Michigan Laws 125.4802 Impeachment: (1) The process of calling something into question, as in "impeaching the testimony of a witness." (2) The constitutional process whereby the House of Representatives may "impeach" (accuse of misconduct) high officers of the federal government for trial in the Senate. in writing: shall be construed to include printing, engraving, and lithographing; except that if the written signature of a person is required by law, the signature shall be the proper handwriting of the person or, if the person is unable to write, the person's proper mark, which may be, unless otherwise expressly prohibited by law, a clear and classifiable fingerprint of the person made with ink or another substance. See Michigan Laws 8.3q Indian tribe: means that term as defined in section 3306(u) of the federal unemployment tax act, chapter 23 of subtitle C of the internal revenue code of 1986, 26 U. See Michigan Laws 421.13l Indictment: The formal charge issued by a grand jury stating that there is enough evidence that the defendant committed the crime to justify having a trial; it is used primarily for felonies. Initial assessed value: means the assessed value, as equalized, of all the taxable property within the boundaries of the development area at the time the resolution establishing or amending the tax increment financing plan is approved, as shown by the most recent assessment roll of the municipality for which equalization has been completed at the time the resolution is adopted. See Michigan Laws 125.4602 Initial assessed value: means the assessed value of all the taxable property within the boundaries of the development area at the time the ordinance establishing the tax increment financing plan is approved, as shown by the most recent assessment roll of the municipality at the time the resolution is adopted. See Michigan Laws 125.4702 Initial assessed value: means the assessed value of all the taxable property within the boundaries of the development area at the time the ordinance establishing the tax increment financing plan is approved, as shown by the most recent assessment roll of the municipality at the time the resolution is adopted. See Michigan Laws 125.4802 Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury. Inland lake: means a natural or artificial lake, pond, or impoundment. See Michigan Laws 125.4702 Institution of higher education: means any of the following:
(i) An institution of higher education described in section 4 or 6 of article VIII of the state constitution of 1963. See Michigan Laws 423.232Institutional investor: means any retirement fund administered by a public agency for the exclusive benefit of federal, state, or local public employees, an employee benefit plan, or pension fund that is subject to the employee retirement income security act of 1974, as amended, an investment company registered under the investment company act of 1940, 15 USC 80a-1 to 80a-64, a collective investment trust organized by a bank under part 9 of the rules of the comptroller of the currency, a closed end investment trust, a chartered or licensed life insurance company or property and casualty insurance company, a chartered or licensed financial institution, an investment advisor registered under the investment advisers act of 1940, 15 USC 80b-1 to 80b-21, or any other person as determined by the board for reasons consistent with this act. See Michigan Laws 432.202 Intangible property: Property that has no intrinsic value, but is merely the evidence of value such as stock certificates, bonds, and promissory notes. Interest rate: The amount paid by a borrower to a lender in exchange for the use of the lender's money for a certain period of time. Interest is paid on loans or on debt instruments, such as notes or bonds, either at regular intervals or as part of a lump sum payment when the issue matures. Source: OCC Intermediate school district: means that term as defined in section 4 of the revised school code, 1976 PA 451, MCL 380. See Michigan Laws 423.201 Investigative hearing: means any hearing conducted by the board or its authorized representative to investigate and gather information or evidence regarding pending license applications, applicants, licensees, or alleged or apparent violations of this act or rules promulgated by the board. See Michigan Laws 432.202 Job training partnership act: means the job training partnership act, Public Law 97-300, 96 Stat. See Michigan Laws 421.151 Job upgrading: means the specialized training that is given to an identified level of employees to enable them to advance to a higher level of employment. See Michigan Laws 421.222 Joint enterprise: means any lottery activity in which the bureau participates pursuant to a written agreement between the state of Michigan and any state, territory, country, or other sovereignty as executed by the commissioner. See Michigan Laws 432.3 judgment: as used in this act , includes decree. See Michigan Laws 600.112 Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases. Juror: A person who is on the jury. Juvenile mental health court: means all of the following:
(i) A court-supervised treatment program for juveniles who are diagnosed by a mental health professional with having a serious emotional disturbance, co-occurring disorder, or developmental disability. See Michigan Laws 600.1099bLabel: means an article of printed matter attached to an appliance or printed material appearing in a catalog from which a product may be purchased by order. See Michigan Laws 429.351 labor dispute: include , but are not limited to, any controversy concerning terms, tenure, or conditions of employment, or concerning the association or representation of employees in negotiating, fixing, maintaining, or changing terms or conditions of employment, regardless of whether the disputants stand in the proximate relation of employer and employee. See Michigan Laws 423.2 Labor organization: means any organization of any kind, or any agency or employee representation committee or plan, in which employees participate and that exists for the purpose, in whole or in part, of dealing with employers concerning grievances, labor disputes, wages, rates of pay, hours of employment, or conditions of work. See Michigan Laws 423.2 Land use plan: means a plan prepared under former 1921 PA 207, former 1943 PA 184, or a site plan under the Michigan zoning enabling act, 2006 PA 110, MCL 125. See Michigan Laws 125.4602 Land use plan: means a plan prepared under former 1921 PA 207, or a site plan under the Michigan zoning enabling act, 2006 PA 110, MCL 125. See Michigan Laws 125.4702 Law: includes the federal or a state constitution, a federal or state statute, a judicial decision or order, a court rule, an executive order, and an administrative rule, regulation, or order. See Michigan Laws 600.2182 Lawsuit: A legal action started by a plaintiff against a defendant based on a complaint that the defendant failed to perform a legal duty, resulting in harm to the plaintiff. Lawyer-guardian ad litem: means that term as defined in section 13a of chapter XIIA of the probate code of 1939, 1939 PA 288, MCL 712A. See Michigan Laws 600.1099aa Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC Legacy: A gift of property made by will. Legislative session: That part of a chamber's daily session in which it considers legislative business (bills, resolutions, and actions related thereto). Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity. License: except as otherwise provided in this subsection and section 17708(2), means an authorization issued under this article to practice where practice would otherwise be unlawful. See Michigan Laws 333.16106 Lien: A claim against real or personal property in satisfaction of a debt. Limitation: means an action by which a board imposes restrictions or conditions, or both, on a license. See Michigan Laws 333.16106 Limited license: means a license to which restrictions or conditions, or both, as to scope of practice, place of practice, supervision of practice, duration of licensed status, or type or condition of patient or client served are imposed by a board. See Michigan Laws 333.16106 Litigation: A case, controversy, or lawsuit. Participants (plaintiffs and defendants) in lawsuits are called litigants. Lockout: means the temporary withholding of work from a group of employees by shutting down the operation of the employer to bring pressure upon the affected employees or the bargaining representative, or both, to accept the employer's terms of settlement of a labor dispute. See Michigan Laws 423.201 Majority leader: see Floor Leaders Managerial employee: means a person who by virtue of the level of his or her remuneration or otherwise holds a management, supervisory, or policy making position with any licensee under this act, a vendor, or the board. See Michigan Laws 432.202 Manufacturer: means a person that prepares, produces, derives, propagates, compounds, processes, packages, or repackages a drug or device salable on prescription only, or otherwise changes the container or the labeling of a drug or device salable on prescription only, and that supplies, distributes, sells, offers for sale, barters, or otherwise disposes of that drug or device and any other drug or device salable on prescription only, to another person for resale, compounding, or dispensing. See Michigan Laws 333.17706 Mark: includes any trademark or service mark. See Michigan Laws 429.31 Member: means a board member appointed to the board under this act. See Michigan Laws 432.202 Member of the immediate family: means the spouse, child, parent, or sibling. See Michigan Laws 431.302 Mental health court: means any of the following:
(i) A court-supervised treatment program for individuals who are diagnosed by a mental health professional with having a serious mental illness, serious emotional disturbance, co-occurring disorder, or developmental disability. See Michigan Laws 600.1090Mental health professional: means an individual who is trained and experienced in the area of mental illness or developmental disabilities and who is 1 of the following:
(i) A physician. See Michigan Laws 600.1099bMental illness: means a substantial disorder of thought or mood that significantly impairs judgment, behavior, capacity to recognize reality, or ability to cope with the ordinary demands of life, including, but not limited to, post-traumatic stress disorder and psychiatric symptoms associated with traumatic brain injury. See Michigan Laws 600.1200 Michigan gaming control board: means the Michigan gaming control board created in the Michigan gaming control and revenue act, the Initiated Law of 1996, MCL 432. See Michigan Laws 432.252 Minor: means an individual under 18 years of age. See Michigan Laws 427.301 month: means a calendar month; the word "year" a calendar year; and the word "year" alone shall be equivalent to the words "year of our Lord". See Michigan Laws 8.3j Mortgage: The written agreement pledging property to a creditor as collateral for a loan. Mortgagee: The person to whom property is mortgaged and who has loaned the money. Municipality: means a city, village, or urban township. See Michigan Laws 125.4402 Municipality: means 1 of the following:
(i) A city. See Michigan Laws 125.4602Municipality: means a city, village, or township. See Michigan Laws 125.4702 Municipality: means a city or a village. See Michigan Laws 125.4802 Net commission: means the amount determined under section 17(3), after first deducting from the licensee's statutory commission the applicable state tax on wagering due and payable under section 22 and the actual verified fee paid by the licensee to the sending host track to receive the simulcast signal. See Michigan Laws 431.302 Nolo contendere: No contest-has the same effect as a plea of guilty, as far as the criminal sentence is concerned, but may not be considered as an admission of guilt for any other purpose. Nonprofit corporation: means that term as defined under section 108 of the nonprofit corporation act, 1982 PA 162, MCL 450. See Michigan Laws 125.4507 Oath: A promise to tell the truth. oath: shall be construed to include the word "affirmation" in all cases where by law an affirmation may be substituted for an oath; and in like cases the word "sworn" shall be construed to include the word "affirmed". See Michigan Laws 8.3k Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period. Occupational license: means a license issued by the board to a person to perform in a casino or a casino enterprise an occupation that directly impacts the integrity of gaming and that the board has identified as requiring a license to perform the occupation in a casino or casino enterprise in this state. See Michigan Laws 432.202 Office of the racing commissioner: means the horse racing section of the horse racing, audit, and gaming technology division of the Michigan gaming control board created by section 4 of the Michigan gaming control and revenue act, 1996 IL 1, MCL 432. See Michigan Laws 431.302 Operating license agreement: means an agreement entered into under section 513 by and among a street railway and each road authority with jurisdiction over public streets and highways upon which the street railway operates or seeks to operate a street railway system, including, but not limited to, each city, village, or township road authority in the city, village, or township in which the street railway operates or seeks to operate a street railway system. See Michigan Laws 125.4507 Oversight: Committee review of the activities of a Federal agency or program. Parcel: means an identifiable unit of land that is treated as separate for valuation or zoning purposes. See Michigan Laws 125.4603 Parcel: means an identifiable unit of land that is treated as separate for valuation or zoning purposes. See Michigan Laws 125.4703 Parcel: means an identifiable unit of land that is treated as separate for valuation or zoning purposes. See Michigan Laws 125.4803 Participant: means an individual who is admitted into a drug treatment court. See Michigan Laws 600.1060 Participant: means an individual who is admitted into a mental health court. See Michigan Laws 600.1090 Participant: means a juvenile who is admitted into a juvenile mental health court. See Michigan Laws 600.1099b Participant: means an individual who is admitted into a family treatment court. See Michigan Laws 600.1099aa Participant: means an individual who is admitted into a veterans treatment court. See Michigan Laws 600.1200 Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses. Party: means the person or entity commencing a civil action. See Michigan Laws 600.1985 Payroll: means remuneration paid by a contributing employer for employment. See Michigan Laws 421.18 Person: includes an individual, partnership, association, corporation, business trust, labor organization, or any other private entity. See Michigan Laws 423.2 Person: means any individual, firm, partnership, corporation, association, union, or other organization. See Michigan Laws 429.31 Person: means an individual, corporation, partnership, association, consortium, or an entity organized for a common business purpose. See Michigan Laws 429.351 Person: means an individual, firm, partnership, corporation, association, or other legal entity. See Michigan Laws 431.302 Person: means an individual, corporation, limited liability company, association, partnership, limited liability partnership, trust, or other legal entity. See Michigan Laws 432.202 Person: means an individual, limited liability company, proprietorship, firm, partnership, joint venture, syndicate, business trust, labor organization, company, corporation, association, committee, governmental entity, or other legal entity. See Michigan Laws 432.272 Person: means an individual, corporation, business trust, estate, trust, partnership, limited liability company, association, joint venture, public corporation, government, or governmental subdivision, agency, or instrumentality, or any other legal or commercial entity. See Michigan Laws 600.2202 person: may extend and be applied to bodies politic and corporate, as well as to individuals. See Michigan Laws 8.3l Person holding a casino interest: includes all of the following:
(i) A person who holds at least a 1% interest in a casino licensee or casino enterprise. See Michigan Laws 432.272Personal identification cardholder list: means a compilation of names of individuals who are 18 years of age or older, addresses, zip codes, dates of birth, and sexes of Michigan residents who have received an official state personal identification card under Act No. See Michigan Laws 600.1300 Personal property: All property that is not real property. Personnel record: means a record kept by the employer that identifies the employee, to the extent that the record is used or has been used, or may affect or be used relative to that employee's qualifications for employment, promotion, transfer, additional compensation, or disciplinary action. See Michigan Laws 423.501 Plaintiff: The person who files the complaint in a civil lawsuit. Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court. Pleadings: Written statements of the parties in a civil case of their positions. In the federal courts, the principal pleadings are the complaint and the answer. Precedent: A court decision in an earlier case with facts and law similar to a dispute currently before a court. Precedent will ordinarily govern the decision of a later similar case, unless a party can show that it was wrongly decided or that it differed in some significant way. Presiding officer: A majority-party Senator who presides over the Senate and is charged with maintaining order and decorum, recognizing Members to speak, and interpreting the Senate's rules, practices and precedents. Probable cause: A reasonable ground for belief that the offender violated a specific law. Probate: Proving a will Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed. Program: means the Michigan business and industrial training program established pursuant to section 3. See Michigan Laws 421.222 Prosecute: To charge someone with a crime. A prosecutor tries a criminal case on behalf of the government. Prosecutor: means the prosecuting attorney of the county, the city attorney, the village attorney, or the township attorney. See Michigan Laws 600.1060 Prosecutor: means the prosecuting attorney of the county, attorney general, or attorney retained by the department. See Michigan Laws 600.1099aa Prosecutor: means the prosecuting attorney of the county, the city attorney, the village attorney, or the township attorney. See Michigan Laws 600.1200 Prospective employer: means a person to whom an employee or former employee has submitted an application for employment. See Michigan Laws 423.451 Public employee: means , except as otherwise provided in subdivisions (f) and (g), an individual holding a position by appointment or employment in the government of this state, in the government of 1 or more of the political subdivisions of this state, in the public school service, in a public or special district, in the service of an authority, commission, or board, or in any other branch of the public service. See Michigan Laws 423.201 Public facility: means a street, plaza, pedestrian mall, and any improvements to a street, plaza, or pedestrian mall including street furniture and beautification, sidewalk, trail, lighting, traffic flow modification, park, parking facility, recreational facility, right-of-way, structure, waterway, bridge, lake, pond, canal, utility line or pipe, transit-oriented development, transit-oriented facility, or building, including access routes, that are either designed and dedicated to use by the public generally or used by a public agency, or that are located in a qualified development area and are for the benefit of or for the protection of the health, welfare, or safety of the public generally, whether or not used by 1 or more business entities, provided that any road, street, or bridge shall be continuously open to public access and that other property shall be located in public easements or rights-of-way and designed to accommodate foreseeable development of public facilities in adjoining areas. See Michigan Laws 125.4603 Public facility: means a street, and any improvements to a street, including street furniture and beautification, park, parking facility, recreational facility, right-of-way, structure, waterway, bridge, lake, pond, canal, utility line or pipe, or building, including access routes designed and dedicated to use by the public generally, or used by a public agency, that is related to access to inland lakes or a water resource improvement, or means a water resource improvement. See Michigan Laws 125.4703 Public facility: means housing, a street, plaza, pedestrian mall, and any improvements to a street, plaza, or pedestrian mall including street furniture and beautification, park, parking facility, recreational facility, right-of-way, structure, waterway, bridge, lake, pond, canal, utility line or pipe, or building, including access routes designed and dedicated to use by the public generally, or used by a public agency. See Michigan Laws 125.4803 Public law: A public bill or joint resolution that has passed both chambers and been enacted into law. Public laws have general applicability nationwide. Public police or fire department employee: means any employee of a city, county, village, township, or institution of higher education, or of any authority, district, board, or any other entity created in whole or in part by the authorization of 1 or more cities, counties, villages, townships, or institutions of higher education, whether created by statute, ordinance, contract, resolution, delegation, or any other mechanism, who is engaged as a police officer or in firefighting or who is subject to the hazards thereof; a corrections officer employed by a county sheriff in a county jail, work camp, or other facility maintained by a county and that houses adult prisoners; emergency medical service personnel employed by a public police or fire department; or an emergency telephone operator, but only if directly employed by a public police or fire department. See Michigan Laws 423.232 Public school academy: means a public school academy or strict discipline academy organized under the revised school code, 1976 PA 451, MCL 380. See Michigan Laws 423.201 Public school employer: means a public employer that is any of the following:
(i) The board of a school district, an intermediate school district, or a public school academy. See Michigan Laws 423.201Public street or highway: means any state trunk line highway, county road, or city or village street maintained by a road authority. See Michigan Laws 125.4507 Purse pool: means an amount of money allocated or apportioned to pay prizes for horse races and from which payments may be made to certified horsemen's organizations as provided in this act. See Michigan Laws 431.302 Qualified development area: means a development area that meets 1 of the following:
(i) All of the following:
(A) Is located within a city with a population of 700,000 or more. See Michigan Laws 125.4603Qualified vendor: means a private vendor selected by the state court administrative office by a competitive bidding process to effectuate the purpose of section 1991(3). See Michigan Laws 600.1985 Quorum: The number of legislators that must be present to do business. racing commissioner: means the executive director of the Michigan gaming control board appointed under section 4 of the Michigan gaming control and revenue act, 1996 IL 1, MCL 432. See Michigan Laws 431.302 Railroad: means that term as defined under section 109 of the railroad code of 1993, 1993 PA 354, MCL 462. See Michigan Laws 125.4507 railroad company: as used in this act , shall be taken to embrace any company, association, corporation, or person managing, maintaining, operating, or in possession of a common carrier railroad in whole or in part within this state, whether as owner, contractor, lessee, mortgagee, trustee, assignee or receiver. See Michigan Laws 419.53 rating account: shall be construed to include reference to the employer's experience account. See Michigan Laws 421.3 Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land. Recess: A temporary interruption of the legislative business. Record: means information that is inscribed on a tangible medium or that is stored in an electronic or other medium and is retrievable in perceivable form. See Michigan Laws 600.2182 Registrant: means the person to whom the registration of a trademark or service mark under this act is issued, his or her legal representatives, successors, or assigns. See Michigan Laws 429.31 Registration: means an authorization only for the use of a designated title which use would otherwise be prohibited under this article. See Michigan Laws 333.16108 Reinstatement: means the granting of a license or certificate of registration, with or without limitations or conditions, to an individual whose license or certificate of registration has been suspended or revoked. See Michigan Laws 333.16108 Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant. Remand: When an appellate court sends a case back to a lower court for further proceedings. Reporter: Makes a record of court proceedings and prepares a transcript, and also publishes the court's opinions or decisions (in the courts of appeals). Rescission: The cancellation of budget authority previously provided by Congress. The Impoundment Control Act of 1974 specifies that the President may propose to Congress that funds be rescinded. If both Houses have not approved a rescission proposal (by passing legislation) within 45 days of continuous session, any funds being withheld must be made available for obligation. Residential district: means an area of a municipality where 75% or more of the area is zoned for residential housing. See Michigan Laws 125.4803 Restitution: The court-ordered payment of money by the defendant to the victim for damages caused by the criminal action. Road authority: means each governmental agency with jurisdiction over public streets and highways. See Michigan Laws 125.4507 School district: means that term as defined in section 6 of the revised school code, 1976 PA 451, MCL 380. See Michigan Laws 423.201 seal: shall be construed to include any of the following:
(a) The impression of the seal on the paper alone. See Michigan Laws 8.3nSentencing guidelines: A set of rules and principles established by the United States Sentencing Commission that trial judges use to determine the sentence for a convicted defendant. Source: U.S. Courts Serious emotional disturbance: means that term as defined in section 100d of the mental health code, 1974 PA 258, MCL 330. See Michigan Laws 600.1090 Serious emotional disturbance: means that term as defined in section 100d of the mental health code, 1974 PA 258, MCL 330. See Michigan Laws 600.1099b Serious mental illness: means that term as defined in section 100d of the mental health code, 1974 PA 258, MCL 330. See Michigan Laws 600.1090 Serious mental illness: means that term as defined in section 100d of the mental health code, 1974 PA 258, MCL 330. See Michigan Laws 600.1099b Service mark: means any word, name, symbol, or device, or any combination thereof, other than a trade name in its entirety, adopted and used by a person in the sale or advertising of services to identify his or her services and distinguish them from the similar services of others. See Michigan Laws 429.31 Service of process: The service of writs or summonses to the appropriate party. Service provider: means a person, organization, or other entity that receives job training partnership act funds, either directly or indirectly from the governor, for the purpose of providing job training or other related services pursuant to the job training partnership act. See Michigan Laws 421.151 Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims. shall not apply: means that the pertinent provision is not operative as to certain persons or things or in conjunction with a particular date or dates. See Michigan Laws 8.4c Specific local tax: means a tax levied under 1974 PA 198, MCL 207. See Michigan Laws 125.4603 Specific local tax: means a tax levied under 1974 PA 198, MCL 207. See Michigan Laws 125.4703 Specific local tax: means a tax levied under 1974 PA 198, MCL 207. See Michigan Laws 125.4803 Standardbred: means a horse registered with the United States Trotting Association that races on designated gaits of pace or trot. See Michigan Laws 431.302 State: means this state or an agency, department, division, bureau, board, commission, council, authority, or other body of this state. See Michigan Laws 423.321 State: means a state of the United States, the District of Columbia, Puerto Rico, the United States Virgin Islands, or any territory or insular possession subject to the jurisdiction of the United States. See Michigan Laws 600.2182 State: means a state of the United States, the District of Columbia, Puerto Rico, the United States Virgin Islands, a federally recognized Indian tribe, or any territory or insular possession subject to the jurisdiction of the United States. See Michigan Laws 600.2202 state: when applied to the different parts of the United States, shall be construed to extend to and include the District of Columbia and the several territories belonging to the United States; and the words "United States" shall be construed to include the district and territories. See Michigan Laws 8.3o state lottery: means the lottery created pursuant to this act and operated exclusively by or under the exclusive control of the bureau of state lottery. See Michigan Laws 432.3 Statute: A law passed by a legislature. Street railway: means a nonprofit corporation organized under this part for the purpose of operating a street railway system other than a railroad train for transporting individuals or property. See Michigan Laws 125.4507 Street railway system: means the facilities, equipment, and personnel required to provide and maintain a public transportation system operated on rails at grade or above or below ground within a city, village, or township utilizing streetcars, trolleys, light rail vehicles, or trams for the transportation of individuals or property. See Michigan Laws 125.4507 Strike: means the concerted failure to report for duty, the willful absence from one's position, the stoppage of work, or the abstinence in whole or in part from the full, faithful, and proper performance of the duties of employment for the purpose of inducing, influencing, or coercing a change in employment conditions, compensation, or the rights, privileges, or obligations of employment. See Michigan Laws 423.201 Subpoena: A command to a witness to appear and give testimony. Subpoena: means a document, however denominated, issued under authority of a court of record requiring a person to do any of the following:
(i) Attend and give testimony at a deposition. See Michigan Laws 600.2202Subpoena duces tecum: A command to a witness to produce documents. Summons: Another word for subpoena used by the criminal justice system. Supplier: means a person who the board has identified under rules promulgated by the board as requiring a license to provide casino licensees with goods or services regarding the business of a proposed or existing casino or casino enterprise on a regular or continuing basis. See Michigan Laws 432.202 Sworn declaration: means a declaration in a signed record given under oath. See Michigan Laws 600.2182 Tax increment revenues: means the amount of ad valorem property taxes and specific local taxes attributable to the application of the levy of all taxing jurisdictions upon the captured assessed value of real and personal property in the development area. See Michigan Laws 125.4603 Tax increment revenues: means the amount of ad valorem property taxes and specific local taxes attributable to the application of the levy of all taxing jurisdictions upon the captured assessed value of real and personal property in the development area. See Michigan Laws 125.4703 Tax increment revenues: means the amount of ad valorem property taxes and specific local taxes attributable to the application of the levy of all taxing jurisdictions upon the captured assessed value of real and personal property in the development area. See Michigan Laws 125.4803 Termination: means removal from the family treatment court due to a new offense, noncompliance, absconding, voluntary withdrawal, medical discharge, or death. See Michigan Laws 600.1099aa Testify: Answer questions in court. Testimony: Evidence presented orally by witnesses during trials or before grand juries. Thoroughbred: means a thoroughbred, quarter, paint, Arabian, or other breed horse. See Michigan Laws 431.302 Tort: A civil wrong or breach of a duty to another person, as outlined by law. A very common tort is negligent operation of a motor vehicle that results in property damage and personal injury in an automobile accident. Trade name: means a word or group of words used by any person to identify a sole proprietorship, firm, partnership, corporation, association, union, or other organization. See Michigan Laws 429.31 Trademark: means any word, name, symbol, or device, or any combination thereof, other than a trade name in its entirety, adopted and used by a person to identify goods made or sold by him or her and to distinguish them from similar goods made or sold by others. See Michigan Laws 429.31 Traffic offense: means a violation of the Michigan vehicle code, 1949 PA 300, MCL 257. See Michigan Laws 600.1060 Traffic offense: means a violation of the Michigan vehicle code, 1949 PA 300, MCL 257. See Michigan Laws 600.1200 Training: means custom-designed training given to prospective employees of new businesses and industries within this state; to employees, prospective employees, or both, of expanding businesses and industries within this state; and to employees, prospective employees, or both, of businesses and industries within this state that possibly would relocate without this training. See Michigan Laws 421.222 Transcript: A written, word-for-word record of what was said, either in a proceeding such as a trial or during some other conversation, as in a transcript of a hearing or oral deposition. Transit-oriented development: means infrastructional improvements that are located within 1/2 mile of a transit station or transit-oriented facility that promotes transit ridership or passenger rail use as determined by the board and approved by the municipality in which it is located. See Michigan Laws 125.4603 Transit-oriented facility: means a facility that houses a transit station in a manner that promotes transit ridership or passenger rail use. See Michigan Laws 125.4603 Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence. Trial jury: A group of citizens who hear the evidence presented by both sides at trial and determine the facts in dispute. Federal criminal juries consist of 12 persons. Federal civil juries consist of six persons. Tribal unit: includes any subdivision, subsidiary, or business enterprise, wholly owned by an Indian tribe. See Michigan Laws 421.13l Trustee: A person or institution holding and administering property in trust. Underemployed: means the individual is working part time or full time, but is receiving wages less than 70% of the lower living standard income level as determined by the United States department of labor, bureau of labor statistics. See Michigan Laws 421.151 Unemployed: means an individual who is without a job and who wants and is available for work. See Michigan Laws 421.151 United States: shall be construed to include the district and territories. See Michigan Laws 8.3o Unsworn declaration: means a declaration or other affirmation of truth in a signed record that is not given under oath, but is given under penalty of perjury. See Michigan Laws 600.2182 Vendor: means a person who is not licensed under this act who supplies any goods or services to a casino licensee or supplier licensee. See Michigan Laws 432.202 Venue: The geographical location in which a case is tried. Verdict: The decision of a petit jury or a judge. Veteran: means an individual who meets both of the following:
(i) Is a veteran as defined in section 1 of 1965 PA 190, MCL 35. See Michigan Laws 600.1200veterans court: means a court adopted or instituted under section 1201 that provides a supervised treatment program for individuals who are veterans and who abuse or are dependent upon any controlled substance or alcohol or suffer from a mental illness. See Michigan Laws 600.1200 Veterinarian: means an individual licensed to practice veterinary medicine under part 188 of the public health code, 1978 PA 368, MCL 333. See Michigan Laws 431.302 Veto: The procedure established under the Constitution by which the President/Governor refuses to approve a bill or joint resolution and thus prevents its enactment into law. A regular veto occurs when the President/Governor returns the legislation to the house in which it originated. The President/Governor usually returns a vetoed bill with a message indicating his reasons for rejecting the measure. In Congress, the veto can be overridden only by a two-thirds vote in both the Senate and the House. Victim advocate: work with prosecutors and assist the victims of a crime. Violent offender: means an individual who is currently charged with or has pled guilty to, or, if the individual is a juvenile, is currently alleged to have committed or has admitted responsibility for, an offense involving the death of or serious bodily injury to any individual, whether or not any of the circumstances are an element of the offense, or an offense that is criminal sexual conduct of any degree. See Michigan Laws 600.1060 Violent offender: means an individual who is currently charged with, or has been convicted of, an offense involving the death of, or a serious bodily injury to, any individual, whether or not any of these circumstances are an element of the offense, or with criminal sexual conduct in any degree. See Michigan Laws 600.1090 Violent offender: means a juvenile who is adjudicated on or has been, within the preceding 5 years, adjudicated on 1 or more of the following offenses:
(i) First degree murder. See Michigan Laws 600.1099bViolent offender: means an individual who is currently charged with or has pled guilty to an offense involving the death of or serious bodily injury to any individual, whether or not death or serious bodily injury is an element of the offense, or an offense that is criminal sexual conduct of any degree. See Michigan Laws 600.1099aa Violent offender: means an individual who is currently charged with or has pled guilty to an offense involving the death of, or a serious bodily injury to, any individual, whether or not any of these circumstances are an element of the offense, or an offense that is criminal sexual conduct in any degree. See Michigan Laws 600.1200 Voir dire: The process by which judges and lawyers select a petit jury from among those eligible to serve, by questioning them to determine knowledge of the facts of the case and a willingness to decide the case only on the evidence presented in court. "Voir dire" is a phrase meaning "to speak the truth." Wagerer: means a person who plays a gambling game authorized under this act. See Michigan Laws 432.202 Water resource improvement: means enhancement of water quality and water dependent natural resources, including, but not limited to, the following:
(i) The elimination of the causes and the proliferation of aquatic nuisance species, as defined in section 3101 of the natural resources and environmental protection act, 1994 PA 451, MCL 324. See Michigan Laws 125.4703Winnings: means the total cash value of all property or sums including currency, tokens, or instruments of monetary value paid to wagerers as a direct result of wagers placed at or through a gambling game. See Michigan Laws 432.202 Writ: A formal written command, issued from the court, requiring the performance of a specific act. Writ of certiorari: An order issued by the Supreme Court directing the lower court to transmit records for a case for which it will hear on appeal.
