1. The department of insurance created by § 36(b) of Article IV of the Missouri Constitution shall operate under the name “Department of Commerce and Insurance”. Under the authority of the Omnibus State Reorganization Act of 1974 and executive order 06-04, the department shall administer and enforce the laws assigned to the department.

2. Unless otherwise clearly indicated by the context, the following words, as used in this chapter, mean:

Terms Used In Missouri Laws 374.005

  • Department: the department of commerce and insurance. See Missouri Laws 374.005
  • Director: the director of the department of commerce and insurance. See Missouri Laws 374.005
  • following: when used by way of reference to any section of the statutes, mean the section next preceding or next following that in which the reference is made, unless some other section is expressly designated in the reference. See Missouri Laws 1.020
  • order: as used in this chapter shall include a formal administrative direction or command of the director issued under this section or in any contested case subject to the provisions of section 536. See Missouri Laws 374.046
  • State: when applied to any of the United States, includes the District of Columbia and the territories, and the words "United States" includes such district and territories. See Missouri Laws 1.020

(1) “Department”, the department of commerce and insurance; and

(2) “Director”, the director of the department of commerce and insurance.

3. Wherever the laws, rules, or regulations of this state make reference to the “department of insurance” or the “department of commerce and insurance”, such references shall be deemed to refer to the department created by § 36(b) of Article IV of the Missouri Constitution and this chapter.
