10-3-1202. Purpose. It is the purpose of this part to:
Terms Used In Montana Code 10-3-1202
- Hazardous material: means a hazardous substance, a hazardous or deleterious substance as defined in 75-10-701, radioactive material, or a combination of a hazardous substance, a hazardous or deleterious substance, and radioactive material. See Montana Code 10-3-1203
- Hazardous material incident: means an event involving the release or threat of release involving hazardous material that may cause injury to persons, the environment, or property. See Montana Code 10-3-1203
- Plan: means the hazardous material response support plan. See Montana Code 10-3-1203
- State: when applied to the different parts of the United States, includes the District of Columbia and the territories. See Montana Code 1-1-201
(1)provide that adequate hazardous material emergency response capability exists in the state in order to protect the health and safety of Montana citizens and the environment;
(2)delineate those state agencies responsible for responding to a hazardous material incident;
(3)provide for the control and management of hazardous material incidents;
(4)provide for the cooperation of other state agencies and local governments in hazardous material incident management; and
(5)provide for the formulation of a comprehensive hazardous material response support plan.
