72-38-416. Modification to achieve settlor‘s tax objectives. To achieve the settlor’s tax objectives, the court may modify the terms of a trust in a manner that is not contrary to the settlor’s probable intention. The court may provide that the modification has retroactive effect.

Terms Used In Montana Code 72-38-416

  • Settlor: means a person, including a testator, who creates or contributes property to a trust. See Montana Code 72-38-103
  • Terms of a trust: means :

    (a)except as otherwise provided in subsection (21)(b), the manifestation of the settlor's intent regarding a trust's provisions as:

    (i)expressed in the trust instrument; or

    (ii)established by other evidence that would be admissible in a judicial proceeding; or

    (b)the trust's provisions as established, determined, or amended by:

    (i)a trustee or trust director in accordance with applicable law;

    (ii)court order; or

    (iii)a nonjudicial settlement agreement under 72-38-111. See Montana Code 72-38-103
