75-10-757. Civil penalty. (1) A district court may assess a civil penalty of not more than $1,000 per day upon a person that violates the provisions of 75-10-756.

Terms Used In Montana Code 75-10-757

  • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
  • Person: means an individual, trust, firm, joint-stock company, joint venture, consortium, commercial entity, partnership, association, corporation, commission, state or state agency, political subdivision of the state, interstate body, or the federal government, including a federal agency. See Montana Code 75-10-701
  • Property: means real and personal property. See Montana Code 1-1-205

(2)An action under this section is not a bar to enforcement by injunction or other appropriate civil remedy.

(3)The penalty provided for in subsection (1) is recoverable in an action brought by the property owner. The action must be filed in the district court of the county in which the violation occurred.
