Terms Used In Nevada Revised Statutes > Chapter 87A - Uniform Limited Partnership Act (2001)

  • Acquittal:
    1. Judgement that a criminal defendant has not been proved guilty beyond a reasonable doubt.
    2. A verdict of "not guilty."
     
  • Adjourn: A motion to adjourn a legislative chamber or a committee, if passed, ends that day's session.
  • Administrative file: means any file of a peace officer containing information, comments or documents about the peace officer. See Nevada Revised Statutes 289.010
  • Administrator: means the Administrator of the Division. See Nevada Revised Statutes 284.015
  • Adult use of cannabis: has the meaning ascribed to it in Nevada Revised Statutes 289.010
  • Advice and consent: Under the Constitution, presidential nominations for executive and judicial posts take effect only when confirmed by the Senate, and international treaties become effective only when the Senate approves them by a two-thirds vote.
  • Amortization: Paying off a loan by regular installments.
  • Attorney-in-fact: A person who, acting as an agent, is given written authorization by another person to transact business for him (her) out of court.
  • Bailiff: a court officer who enforces the rules of behavior in courtrooms.
  • Bequest: Property gifted by will.
  • Certificate of limited partnership: means the certificate referred to in Nevada Revised Statutes 88.315
  • Chambers: A judge's office.
  • Commission: means the Human Resources Commission. See Nevada Revised Statutes 284.015
  • Common disaster: A sudden and extraordinary misfortune that brings about the simultaneous or near-simultaneous deaths of two or more associated persons, such as husband and wife.
  • Contribution: means any cash, property, services rendered, or a promissory note or other binding obligation to contribute cash or property or to perform services, which a partner contributes to a limited partnership in his or her capacity as a partner. See Nevada Revised Statutes 88.315
  • controlled substance: means a drug, immediate precursor or other substance which is listed in schedule I, II, III, IV or V for control by the State Board of Pharmacy pursuant to Nevada Revised Statutes 0.031
  • Deposition: An oral statement made before an officer authorized by law to administer oaths. Such statements are often taken to examine potential witnesses, to obtain discovery, or to be used later in trial.
  • Disability: includes , but is not limited to, physical disability, intellectual disability and mental or emotional disorder. See Nevada Revised Statutes 284.015
  • Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial.
  • Division: means the Division of Human Resource Management of the Department of Administration. See Nevada Revised Statutes 284.015
  • Essential functions: has the meaning ascribed to it in Nevada Revised Statutes 284.015
  • Event of withdrawal of a general partner: means an event that causes a person to cease to be a general partner as provided in Nevada Revised Statutes 88.315
  • Ex officio: Literally, by virtue of one's office.
  • Forbearance: A means of handling a delinquent loan. A
  • Foreign limited partnership: means a partnership formed under the laws of a jurisdiction other than this State and having as partners one or more general partners and one or more limited partners. See Nevada Revised Statutes 88.315
  • Foreign registered limited-liability limited partnership: means a foreign limited-liability limited partnership:

    (a) Formed pursuant to an agreement governed by the laws of another state; and

    (b) Registered pursuant to and complying with Nevada Revised Statutes 88.315

  • Garnishment: Generally, garnishment is a court proceeding in which a creditor asks a court to order a third party who owes money to the debtor or otherwise holds assets belonging to the debtor to turn over to the creditor any of the debtor
  • General partner: means a person who has been admitted to a limited partnership as a general partner in accordance with the partnership agreement and named in the certificate of limited partnership as a general partner. See Nevada Revised Statutes 88.315
  • Grand jury: agreement providing that a lender will delay exercising its rights (in the case of a mortgage,
  • Grantor: The person who establishes a trust and places property into it.
  • Impeachment: (1) The process of calling something into question, as in "impeaching the testimony of a witness." (2) The constitutional process whereby the House of Representatives may "impeach" (accuse of misconduct) high officers of the federal government for trial in the Senate.
  • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
  • Intangible property: Property that has no intrinsic value, but is merely the evidence of value such as stock certificates, bonds, and promissory notes.
  • Joint session: When both chambers of a legislature adopt a concurrent resolution to meet together.
  • Juror: A person who is on the jury.
  • Law enforcement agency: means any agency, office, bureau, department, unit or division created by any statute, ordinance or rule which:

    (a) Has a duty to enforce the law; and

    (b) Employs any person upon whom some or all of the powers of a peace officer are conferred pursuant to Nevada Revised Statutes 289.010

  • Legatee: A beneficiary of a decedent
  • Legislative session: That part of a chamber's daily session in which it considers legislative business (bills, resolutions, and actions related thereto).
  • Limited partner: means a person who has been admitted to a limited partnership as a limited partner in accordance with the partnership agreement. See Nevada Revised Statutes 88.315

  • Medical use of cannabis: has the meaning ascribed to it in Nevada Revised Statutes 289.010
  • Minority leader: See Floor Leaders
  • National Bank: A bank that is subject to the supervision of the Comptroller of the Currency. The Office of the Comptroller of the Currency is a bureau of the U.S. Treasury Department. A national bank can be recognized because it must have "national" or "national association" in its name. Source: OCC
  • Nolo contendere: No contest-has the same effect as a plea of guilty, as far as the criminal sentence is concerned, but may not be considered as an admission of guilt for any other purpose.
  • Oral argument: An opportunity for lawyers to summarize their position before the court and also to answer the judges' questions.
  • Partner: means a limited or general partner. See Nevada Revised Statutes 88.315
  • Partnership agreement: means any valid agreement, written or oral, of the partners as to the affairs of a limited partnership and the conduct of its business. See Nevada Revised Statutes 88.315
  • Partnership interest: means a partner"s share of the profits and losses of a limited partnership and the right to receive distributions of partnership assets. See Nevada Revised Statutes 88.315
  • Peace officer: means any person upon whom some or all of the powers of a peace officer are conferred pursuant to Nevada Revised Statutes 289.010
  • Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court.
  • Pleadings: Written statements of the parties in a civil case of their positions. In the federal courts, the principal pleadings are the complaint and the answer.
  • Power of attorney: A written instrument which authorizes one person to act as another's agent or attorney. The power of attorney may be for a definite, specific act, or it may be general in nature. The terms of the written power of attorney may specify when it will expire. If not, the power of attorney usually expires when the person granting it dies. Source: OCC
  • Precedent: A court decision in an earlier case with facts and law similar to a dispute currently before a court. Precedent will ordinarily govern the decision of a later similar case, unless a party can show that it was wrongly decided or that it differed in some significant way.
  • Presiding officer: A majority-party Senator who presides over the Senate and is charged with maintaining order and decorum, recognizing Members to speak, and interpreting the Senate's rules, practices and precedents.
  • Probation officers: Screen applicants for pretrial release and monitor convicted offenders released under court supervision.
  • Public defender: Represent defendants who can't afford an attorney in criminal matters.
  • Public law: A public bill or joint resolution that has passed both chambers and been enacted into law. Public laws have general applicability nationwide.
  • Public officer: means a person elected or appointed to a position which:

    (a) Is established by the Constitution or a statute of this State, or by a charter or ordinance of a political subdivision of this State; and

    (b) Involves the continuous exercise, as part of the regular and permanent administration of the government, of a public power, trust or duty. See Nevada Revised Statutes 281.005

  • Public service: means positions providing service for any office, department, board, commission, bureau, agency or institution in the Executive Department of the State Government operating by authority of the Constitution or law, and supported in whole or in part by any public money, whether the money is received from the Government of the United States or any branch or agency thereof, or from private or any other sources. See Nevada Revised Statutes 284.015
  • Punitive action: means any action which may lead to dismissal, demotion, suspension, reduction in salary, written reprimand or transfer of a peace officer for purposes of punishment. See Nevada Revised Statutes 289.010
  • Quorum: The number of legislators that must be present to do business.
  • Race: includes traits associated with race, including, without limitation, hair texture and protective hairstyles. See Nevada Revised Statutes 284.015
  • Recess: A temporary interruption of the legislative business.
  • Registered agent: has the meaning ascribed to it in Nevada Revised Statutes 88.315
  • Registered limited-liability limited partnership: means a limited partnership:

    (a) Formed pursuant to an agreement governed by this chapter; and

    (b) Registered pursuant to and complying with Nevada Revised Statutes 88.315

  • Registered office: means the office maintained at the street address of the registered agent. See Nevada Revised Statutes 88.315
  • Reporter: Makes a record of court proceedings and prepares a transcript, and also publishes the court's opinions or decisions (in the courts of appeals).
  • Rescission: The cancellation of budget authority previously provided by Congress. The Impoundment Control Act of 1974 specifies that the President may propose to Congress that funds be rescinded. If both Houses have not approved a rescission proposal (by passing legislation) within 45 days of continuous session, any funds being withheld must be made available for obligation.
  • Restitution: The court-ordered payment of money by the defendant to the victim for damages caused by the criminal action.
  • Restricted limited partnership: means a limited partnership organized and existing under this chapter that elects to include the optional provisions permitted by Nevada Revised Statutes 88.315
  • Screening test: means a test of a person"s blood, urine, hair or saliva to detect the general presence of a controlled substance or other drug. See Nevada Revised Statutes 289.010
  • special district: means any water district, sanitation district, water and sanitation district, municipal power district, mosquito abatement district, public cemetery district, swimming pool district, television maintenance district, weed control district, general improvement district, or any other quasi-municipal corporation organized under the local improvement and service district laws of this State as enumerated in this title, but excludes:

    (a) All parks, trails and open space districts created pursuant to chapter 318A of NRS; and

    (b) All housing authorities. See Nevada Revised Statutes 308.020

  • State: means a state, territory or possession of the United States, the District of Columbia or the Commonwealth of Puerto Rico. See Nevada Revised Statutes 88.315
  • Trust account: A general term that covers all types of accounts in a trust department, such as estates, guardianships, and agencies. Source: OCC
  • Venue: The geographical location in which a case is tried.
  • Verdict: The decision of a petit jury or a judge.
  • Veteran: means a person who:

    (a) Was regularly enlisted, drafted, inducted or commissioned in the:

    (1) Armed Forces of the United States and was accepted for and assigned to active duty in the Armed Forces of the United States;

    (2) National Guard or a reserve component of the Armed Forces of the United States and was accepted for and assigned to duty for a minimum of 6 continuous years; or

    (3) Commissioned Corps of the United States Public Health Service or the Commissioned Corps of the National Oceanic and Atmospheric Administration of the United States and served in the capacity of a commissioned officer while on active duty in defense of the United States; and

    (b) Was separated from such service under conditions other than dishonorable. See Nevada Revised Statutes 284.015

  • Veteran with a service-connected disability: has the meaning ascribed to it in Nevada Revised Statutes 284.015
  • Writ: A formal written command, issued from the court, requiring the performance of a specific act.
