New Hampshire Revised Statutes 263:51 – Grounds for Revoking or Suspending School License or Driver Education Certificate

Any employee of the department authorized by the commissioner to hold hearings in such cases may suspend or revoke any school license or driver education certificate issued under the provisions of this subdivision or refuse to issue a renewal thereof if:
I. The licensee or certificate holder has made a material false statement or concealed a material fact in connection with the application for a license or the renewal thereof;
II. The licensee or certificate holder has been convicted of a crime or of any offense under N.H. Rev. Stat. § 265:79 or RSA 265-A, or his or her license or privilege to drive a motor vehicle has been suspended or revoked;
III. The licensee or certificate holder has been charged with an offense under N.H. Rev. Stat. § 265:79 or RSA 265-A, RSA 630, RSA 631, or N.H. Rev. Stat. Chapter 632-A and it appears to the commissioner, after a hearing, that an immediate license suspension pending the outcome of the criminal proceeding is required in the interest of public safety;
IV. The licensee or certificate holder has failed to comply with any of the provisions of this subdivision or any applicable rule adopted pursuant to N.H. Rev. Stat. § 21-P:14;
V. The licensee or any partner or officer of such licensee has been guilty of fraud or fraudulent practices in relation to the business conducted under the license, or guilty of inducing another person to resort to fraud or fraudulent practices in relation to securing for himself, herself, or another the license to drive a motor vehicle or motorcycle;
VI. The licensee has knowingly employed, as an instructor, a person who has been convicted of a crime or has retained such a person in such employ after knowledge of his or her conviction; or
VII. The licensee has failed to maintain satisfactory insurance to meet damage claims required by N.H. Rev. Stat. § 263:50.

Terms Used In New Hampshire Revised Statutes 263:51
- Certificate: shall mean :
I. See New Hampshire Revised Statutes 259:9 - Commissioner: shall mean the commissioner of safety. See New Hampshire Revised Statutes 259:13
- Department: shall mean the department of safety of the state of New Hampshire. See New Hampshire Revised Statutes 259:19
- Driver: shall mean a person who drives or is in actual physical control of a motor vehicle as defined in N. See New Hampshire Revised Statutes 259:25
- Fraud: Intentional deception resulting in injury to another.
- Fraudulent practices: when used in reference to drivers' schools, shall mean, but not be limited to:
I. See New Hampshire Revised Statutes 259:36 - License: shall mean any driver's license or any other license or permit to drive a vehicle issued under the laws of this state or a reciprocating state including:

See New Hampshire Revised Statutes 259:60 - Motorcycle: shall mean every motor vehicle having a seat or saddle for the use of the rider and designed to travel on not more than 3 wheels in contact with the ground, but excluding electric bicycles, tractors, and mopeds. See New Hampshire Revised Statutes 259:63
- Person: shall mean the same as provided in N. See New Hampshire Revised Statutes 259:74
- Suspension: shall mean the temporary withdrawal by formal action of the department or of a court of competent jurisdiction of a person's driver's license or privilege to drive a vehicle on the ways of this state, or any other license, registration or permit issued by the department, which temporary withdrawal shall be for a period specifically designated by the department or court and until the reissuance of the license, registration, permit or privilege. - Vehicle: shall mean :
I. See New Hampshire Revised Statutes 259:122
II. The licensee or certificate holder has been convicted of a crime or of any offense under N.H. Rev. Stat. § 265:79 or RSA 265-A, or his or her license or privilege to drive a motor vehicle has been suspended or revoked;
