New Hampshire Revised Statutes 263:50 – Grounds for Denial of License

The department may deny the application of any person for a license if, in its discretion, the department determines that:
I. Such applicant has made a material false statement or concealed a material fact in connection with his application;
II. Such applicant, any officer, director, stockholder or partner, or any other person directly or indirectly interested in the business, was the former holder of a license hereunder, or was an officer, director, stockholder or partner in a corporation or partnership which held a license under this subdivision and which license was revoked or suspended by the director;
III. Such applicant or any officer, director, stockholder, partner, employee, or any other person directly or indirectly interested in the business, has been convicted of a crime;
IV. Such applicant has failed to furnish satisfactory evidence of good character, reputation and fitness;
V. Such applicant does not have a place of business as required by this chapter;
VI. Such applicant is not the true owner of the drivers’ school;
VI-a. Such applicant, upon original application, has failed to submit a complete set of fingerprints taken by a qualified law enforcement agency;
VII. The application is not accompanied by a certificate of insurance endorsing a combined single limit for each accident in the amount of $500,000 suffered or caused by reason of negligence of the applicant or any agent or employee of the applicant, approved as to form and coverage by the director and issued by a company duly licensed to transact business in this state under the insurance laws of this state; or
VIII. Such applicant has failed to comply with any applicable rule adopted pursuant to N.H. Rev. Stat. § 21-P:14.

Terms Used In New Hampshire Revised Statutes 263:50
- Accident: shall mean any event that results in injury or property damage attributable directly or indirectly to the motion of a motor vehicle or its load. See New Hampshire Revised Statutes 259:1-a
- Certificate: shall mean :
I. See New Hampshire Revised Statutes 259:9 - Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
- Department: shall mean the department of safety of the state of New Hampshire. See New Hampshire Revised Statutes 259:19
- Director: shall mean the director of the division of motor vehicles of the department of safety. See New Hampshire Revised Statutes 259:20
- Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
- License: shall mean any driver's license or any other license or permit to drive a vehicle issued under the laws of this state or a reciprocating state including:

I. See New Hampshire Revised Statutes 259:72 - Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
- Person: shall mean the same as provided in N. See New Hampshire Revised Statutes 259:74
- Place of business: shall mean the site, location or building within this state at which a person conducts the business in which he is engaged. See New Hampshire Revised Statutes 259:76
- State: shall mean :
I. See New Hampshire Revised Statutes 259:106
II.
