Notwithstanding the provisions of Sections 60-6B-1 and 60-6B-2 N.M. Stat. Ann., a person not a citizen of the United States may apply for and be granted, subject to other qualifications required by the Liquor Control Act [60-3A-1 N.M. Stat. Ann.], any license established by the provisions of the Domestic Winery and Small Brewery Act N.M. Stat. Ann. § 60-6A-21 to 60-6A-28; provided that the director of the department of alcoholic beverage control, in qualifying such licensees, may investigate the applicant’s background by contacting the appropriate state or foreign governmental agencies, including police and international police organizations, and may require the furnishing of such documentation as necessary to determine the applicant’s qualifications under the Liquor Control Act.
