Any person making a false statement under oath or a false affidavit shall be guilty of a fourth degree felony and upon conviction shall be sentenced in accordance with the Criminal Sentencing Act [N.M. Stat. Ann. Chapter 31, Article 18] to eighteen months imprisonment and, in the sentencing court’s discretion, to a fine of not more than five thousand dollars ($5,000).
