Terms Used In North Carolina General Statutes 143B-181.23
- Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
- Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
- Long-term care facility: means any skilled nursing facility and intermediate care facility as defined in N. See North Carolina General Statutes 143B-181.16
- Regional Ombudsman: means a person employed by an Area Agency on Aging who is certified and designated by the State Ombudsman to carry out the functions of the Regional Ombudsman Office established by this Article, 42 U. See North Carolina General Statutes 143B-181.16
- Resident: means any person who is receiving treatment or care in any long-term care facility. See North Carolina General Statutes 143B-181.16
- State Ombudsman: means the State Ombudsman as defined by the Older Americans Act of 1965, as amended, 42 U. See North Carolina General Statutes 143B-181.16
No person shall discriminate or retaliate in any manner against any resident or relative or guardian of a resident, any employee of a long-term care facility, or any other person because of the making of a complaint or providing of information in good faith to the State Ombudsman or Regional Ombudsman. The Department shall determine instances of discrimination or retaliation and assess a monetary penalty in the amount of two thousand five hundred dollars ($2,500) per incident. The Department shall adopt rules pertaining to this determination of discrimination or retaliation. (1989, c. 403, s. 1; 2015-220, s. 2.)
