Terms Used In North Carolina General Statutes 28A-2-9
- Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
- Estate proceeding: means a matter initiated by petition related to the administration, distribution, or settlement of an estate, other than a special proceeding. See North Carolina General Statutes 28A-1-1
(a) With the exception of appeals of special proceedings heard by the clerk of superior court, appeals in estate matters shall be as provided in N.C. Gen. Stat. § 1-301.3
(b) Appeals in special proceedings shall be as provided in N.C. Gen. Stat. § 1-301.2
(c) Any party may appeal from a decision of the clerk of superior court in an estate proceeding or special proceeding to a superior court judge as provided for in N.C. Gen. Stat. § 1-301.3; provided that the appeals from orders of the clerk of superior court in special proceedings shall be as provided in N.C. Gen. Stat. § 1-301.2 (2011-344, s. 4.)
