Terms Used In North Dakota Code 16.1-06-12

  • Ballot: means a paper ballot from which the votes for candidates and questions are tabulated by hand or by a voting system. See North Dakota Code 16.1-06-12
  • Ballot marking device: means a device for marking ballots with ink or other substance, or any other method for recording votes on ballots such that the votes may be tabulated and counted by tabulation. See North Dakota Code 16.1-06-12
  • paper: means any flexible material upon which it is usual to write. See North Dakota Code 1-01-27
  • Voting system: means the system and devices authorized under this chapter which may employ a ballot marking device with use of a touchscreen or other data entry device to record and count votes in an election. See North Dakota Code 16.1-06-12

1.    “Ballot” means a paper ballot from which the votes for candidates and questions are tabulated by hand or by a voting system. The term includes the digital image of a marked ballot captured by a voting system.

2.    “Ballot marking device” means a device for marking ballots with ink or other substance, or any other method for recording votes on ballots such that the votes may be tabulated and counted by tabulation.

3.    “Counting center” means a location designated by the county auditor for the counting of ballots and tabulation of votes from the ballots.

4.    “Digital scan” means a procedure in which votes cast on a paper ballot are tabulated by examining marks made in voting response locations on the ballot and an image of the ballot is captured and retained.

5.    “Voting system” means the system and devices authorized under this chapter which may employ a ballot marking device with use of a touchscreen or other data entry device to record and count votes in an election.
