Ohio Code 3314.28 – Plan by computer-based schools for services to disabled students
(A) Each internet- or computer-based community school established under this chapter shall submit to the school’s sponsor a plan for providing special education and related services to disabled students enrolled in the school in accordance with division (A)(1) or (2) of this section.
Terms Used In Ohio Code 3314.28
- Internet- or computer-based community school: means a community school established under this chapter in which the enrolled students work primarily from their residences on assignments in nonclassroom-based learning opportunities provided via an internet- or other computer-based instructional method that does not rely on regular classroom instruction or via comprehensive instructional methods that include internet-based, other computer-based, and noncomputer-based learning opportunities unless a student receives career-technical education under section 3314. - Sponsor: means the board of education of a school district or the governing board of an educational service center that agrees to the conversion of all or part of a school or building under division (B) of this section, or an entity listed in division (C)(1) of this section, which has been approved by the department of education and workforce to sponsor community schools or is exempted by section 3314. See Ohio Code 3314.02
(1) If the school was established prior to June 30, 2005, the plan shall be submitted to the sponsor on or before September 1, 2005, and on or before the first day of September in each year thereafter that the school is in operation.
(2) If the school is established after June 30, 2005, the plan shall be submitted to the sponsor prior to the school’s receipt of its first payment under this chapter and on or before the first day of September in each year thereafter that the school is in operation.
(B) Within thirty days after receiving the plan prescribed in division (A) of this section, the sponsor of each internet- or computer-based community school shall certify all of the following to the department of education and workforce:
(1) A statement of whether the plan received is satisfactory to the sponsor;
(2) If the plan received is not satisfactory to the sponsor, the sponsor’s assurance that it will promptly assist the school in developing a plan that is satisfactory to the sponsor;
(3) The sponsor’s assurance that it will monitor the implementation of the plan;
(4) The sponsor’s assurance that it will take any necessary corrective action to ensure that the school’s plan is properly and fully implemented.
(C) The department shall develop guidelines for the content and format of the plan required under this section.
