Ohio Code 3314.353 – Publication of school closures and closure risks
Each year, the department of education and workforce shall publish separate lists of the following:
Terms Used In Ohio Code 3314.353
- Challenged school district: means any of the following:
(a) A school district that is part of the pilot project area;
(b) A school district that meets one of the following conditions:
(i) On March 22, 2013, the district was in a state of academic emergency or in a state of academic watch under section 3302. See Ohio Code 3314.02
- state: means the state of Ohio. See Ohio Code 1.59
(A) Community schools that have become subject to permanent closure under section 3314.35 or 3314.351 of the Revised Code;
(B) Community schools that are at risk of becoming subject to permanent closure under section 3314.35 or 3314.351 of the Revised Code if their academic performance, as prescribed in those sections, does not improve on the next state report cards issued under section 3302.03 or 3314.017 of the Revised Code.
The department of education and workforce shall not adopt any rules, enforce any procedures or policies, or otherwise restrict the establishment or sponsorship of a new start-up community school based upon whether the school’s proposed location is in a challenged school district.
