The director of environmental protection may issue orders in accordance with Chapter 3745 of the Revised Code directing the owner or operator of a reporting facility to abate a violation of any section of this chapter other than section 3752.11, 3752.111, or 3752.113 of the Revised Code, or a rule adopted under this chapter, within a specified, reasonable time.
Terms Used In Ohio Code 3752.16
- Facility: means all buildings, equipment, structures, and other stationary items that are located on a single site or on contiguous or adjacent sites and that are owned or operated by the same person. See Ohio Code 3752.01
- Issue: when used in connection with any order that the director of environmental protection is authorized to issue under this chapter, includes modify, suspend, or vacate. See Ohio Code 3752.01
- Operator: means the person responsible for the overall operation of a reporting facility. See Ohio Code 3752.01
- Owner: means the person who owns a reporting facility or part of a reporting facility. See Ohio Code 3752.01
- Person: includes an individual, corporation, business trust, estate, trust, partnership, and association. See Ohio Code 1.59
- Rule: includes regulation. See Ohio Code 1.59
No person shall violate a term or condition of an order issued under this section.
