Ohio Code 3905.05 – Application for resident insurance agent license
(A) A natural person shall apply for a resident insurance agent license by submitting to the superintendent of insurance the uniform application or any other application prescribed by the superintendent, any additional information required by the superintendent, and a declaration made under penalty of refusal, suspension, or revocation of the license, that the statements made in the application are true, correct, and complete to the best of the applicant’s knowledge and belief and paying any applicable fees required under this chapter.
Terms Used In Ohio Code 3905.05
- agent: means any person that, in order to sell, solicit, or negotiate insurance, is required to be licensed under the laws of this state, including limited lines insurance agents and surplus line brokers. See Ohio Code 3905.01
- Annuity: A periodic (usually annual) payment of a fixed sum of money for either the life of the recipient or for a fixed number of years. A series of payments under a contract from an insurance company, a trust company, or an individual. Annuity payments are made at regular intervals over a period of more than one full year.
- Business entity: means a corporation, association, partnership, limited liability company, limited liability partnership, or other legal entity. See Ohio Code 3905.01
- Insurance: means any of the lines of authority set forth in Chapter 1739. See Ohio Code 3905.01
- License: means the authority issued by the superintendent to a person to act as an insurance agent for the lines of authority specified, but that does not create any actual, apparent, or inherent authority in the person to represent or commit an insurer. See Ohio Code 3905.01
- Person: means an individual or a business entity. See Ohio Code 3905.01
- superintendent of insurance: means the superintendent of insurance of this state. See Ohio Code 3905.01
- Uniform application: means the NAIC uniform application for resident and nonresident agent licensing, as amended by the NAIC from time to time. See Ohio Code 3905.01
- Uniform business entity application: means the NAIC uniform business entity application for resident and nonresident business entities, as amended by the NAIC from time to time. See Ohio Code 3905.01
A person who applies for a resident insurance agent license with a variable life-variable annuity line of authority shall include in the person’s application the person’s individual central registration depository number.
The applicant shall also consent to a criminal records check pursuant to section 3905.051 of the Revised Code.
(B) A business entity acting as an insurance agent shall apply for a resident insurance agent license by submitting to the superintendent the uniform business entity application or any other application prescribed by the superintendent and paying any applicable fees required under this chapter.
(C) The superintendent may require an applicant to submit any document reasonably necessary to verify the information contained in an application.
