Ohio Code 3956.16 – Immunity
There shall be no liability on the part of, and no cause of action of any nature shall arise against, any member insurer or its agents or employees, the Ohio life and health guaranty association or its agents or employees, the board of directors or any member of the board, or the superintendent of insurance or the superintendent’s representatives, for any action or omission by them pursuant to the purposes and provisions of this chapter or in the performance of their powers and duties under this chapter. Immunity under this section extends to the participation in any organization of one or more other state associations of similar purposes as provided in division (N)(7) of section 3956.08 of the Revised Code, and to any such organization and its agents and employees.
Terms Used In Ohio Code 3956.16
- Member insurer: includes any insurer or health insuring corporation that operates any of the entities described in division (I)(2) of this section as a line of business, and not as a separate, affiliated legal entity, and otherwise qualifies as a member insurer. See Ohio Code 3956.01
- state: means the state of Ohio. See Ohio Code 1.59
