(A) This chapter shall be construed liberally for the accomplishment of its purposes, and any law inconsistent with any provision of this chapter shall not apply. Nothing contained in this chapter shall be considered to repeal any of the provisions of any law of this state relating to discrimination because of race, color, religion, sex, military status, familial status, disability, national origin, age, or ancestry.

Terms Used In Ohio Code 4112.08

  • age: means an individual aged forty years or older. See Ohio Code 4112.01
  • Common law: The legal system that originated in England and is now in use in the United States. It is based on judicial decisions rather than legislative action.
  • Disability: means a physical or mental impairment that substantially limits one or more major life activities, including the functions of caring for one's self, performing manual tasks, walking, seeing, hearing, speaking, breathing, learning, and working; a record of a physical or mental impairment; or being regarded as having a physical or mental impairment. See Ohio Code 4112.01
  • Employee: means an individual employed by any employer but does not include any individual employed in the domestic service of any person. See Ohio Code 4112.01
  • Employer: means the state, any political subdivision of the state, or a person employing four or more persons within the state, and any agent of the state, political subdivision, or person. See Ohio Code 4112.01
  • Familial status: means either of the following:

    (a) One or more individuals who are under eighteen years of age and who are domiciled with a parent or guardian having legal custody of the individual or domiciled, with the written permission of the parent or guardian having legal custody, with a designee of the parent or guardian;

    (b) Any person who is pregnant or in the process of securing legal custody of any individual who is under eighteen years of age. See Ohio Code 4112.01

  • Military status: means a person's status in "service in the uniformed services" as defined in section 5923. See Ohio Code 4112.01
  • Person: includes one or more individuals, partnerships, associations, organizations, corporations, legal representatives, trustees, trustees in bankruptcy, receivers, and other organized groups of persons. See Ohio Code 4112.01
  • state: means the state of Ohio. See Ohio Code 1.59
  • Unlawful discriminatory practice: means any act prohibited by section 4112. See Ohio Code 4112.01

However, no person has a cause of action or claim based on an unlawful discriminatory practice relating to employment described in division (A)(24)(a) of section 4112.01 of the Revised Code against a supervisor, manager, or other employee of an employer unless that supervisor, manager, or other employee is the employer. Nothing in this division abrogates statutory claims outside this chapter or any claims of liability that exist against an individual at common law.

(B) The procedures and remedies for unlawful discriminatory practices relating to employment in this chapter are the sole and exclusive procedures and remedies available to a person who alleges such discrimination actionable under this chapter.
