In the absence of fraud or bad faith, no monitoring organization that conducts the confidential monitoring program established under section 4731.25 of the Revised Code and no agent, employee, member, or representative of such organization shall be liable in damages in a civil action or subject to criminal prosecution for performing any of the duties required by that section, the contract with the state medical board, or sections 4731.251 to 4731.255 of the Revised Code.

In the absence of fraud or bad faith, no person or organization that has been approved as a treatment provider under section 4731.251 of the Revised Code, no member of such an organization, and no employee, representative, or agent of the treatment provider shall be held liable in damages to any person by reason of actions taken or recommendations made by the treatment provider or its employees, representatives, or agents.
