(A) Any person who has been charged under section 5121.33 or 5121.35 of the Revised Code may petition the department of mental health and addiction services to do the following:

- in writing: includes any representation of words, letters, symbols, or figures; this provision does not affect any law relating to signatures. See Ohio Code 1.59
- Person: includes an individual, corporation, business trust, estate, trust, partnership, and association. See Ohio Code 1.59
(1) Release the person from a charge;
(2) Modify or cancel a charge.
(B) The department shall respond to a petition in writing and inform the petitioner of whether a release, modification, or cancellation has been approved.
