(A) Notwithstanding section 6111.31 of the Revised Code, regarding any proposed impact to an ephemeral feature that is a water of the state, the director shall not impose or require any mitigation standard, criteria, scientific method, process, or other procedure or policy that is not specified in sections 6111.313 to 6111.316 of the Revised Code.
Terms Used In Ohio Code 6111.312
- Ephemeral feature: means surface water flowing or pooling only in direct response to precipitation, such as rain or snow. See Ohio Code 6111.01
- state: means the state of Ohio. See Ohio Code 1.59
(B) Notwithstanding section 6111.31 of the Revised Code, the director shall not impose any requirements beyond those specified in sections 6111.31 to 6111.316 of the Revised Code with respect to any activity impacting an ephemeral feature that is a water of the state in the issuance of a section 401 water quality certification.
