Terms Used In Ohio Code > Chapter 3718 - Sewage Treatment Systems

  • agriculture: includes farming; ranching; aquaculture; algaculture meaning the farming of algae; apiculture and related apicultural activities, production of honey, beeswax, honeycomb, and other related products; horticulture; viticulture, winemaking, and related activities; animal husbandry, including, but not limited to, the care and raising of livestock, equine, and fur-bearing animals; poultry husbandry and the production of poultry and poultry products; dairy production; the production of field crops, tobacco, fruits, vegetables, nursery stock, ornamental shrubs, ornamental trees, flowers, sod, or mushrooms; timber; pasturage; any combination of the foregoing; the processing, drying, storage, and marketing of agricultural products when those activities are conducted in conjunction with, but are secondary to, such husbandry or production; and any additions or modifications to the foregoing made by the director of agriculture by rule adopted in accordance with Chapter 119 of the Revised Code. See Ohio Code 1.61
  • Alter: means to change by making substantive replacements of, additions to, or deletions in the design or materials or to change the location of an existing sewage treatment system. See Ohio Code 3718.01
  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • Another: when used to designate the owner of property which is the subject of an offense, includes not only natural persons but also every other owner of property. See Ohio Code 1.02
  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Bedrock: means hard stratum that underlies unconsolidated surface materials or soil. See Ohio Code 3718.01
  • Board of health: means the board of health of a city or general health district or the authority having the duties of a board of health in any city as authorized by section 3709. See Ohio Code 3718.01
  • Bond: includes an undertaking. See Ohio Code 1.02
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Contract: A legal written agreement that becomes binding when signed.
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Domestic septage: means the liquid or solid material removed from a sewage treatment system, portable toilet, or type III marine sanitation device as defined in 33 C. See Ohio Code 3718.01
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Household sewage treatment system: means any sewage treatment system, or part of such a system, that receives sewage from a single-family, two-family, or three-family dwelling. See Ohio Code 3718.01
  • in writing: includes any representation of words, letters, symbols, or figures; this provision does not affect any law relating to signatures. See Ohio Code 1.59
  • Infiltrative surface: means the point or area of application of treated or partially treated sewage to the soil or sand fill for purposes of treatment, dispersal, or both. See Ohio Code 3718.01
  • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
  • Inspection: means the on-site evaluation or analysis of the design, installation, and operation of a sewage treatment system. See Ohio Code 3718.01
  • Installer: means any person who engages in the business of installing or altering or who, as an employee of another, installs or alters any sewage treatment system. See Ohio Code 3718.01
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Limiting condition: means a restrictive soil layer, bedrock, a water table, or ground water that limits or precludes the treatment or dispersal of sewage in the soil of a property where a household sewage treatment system is located. See Ohio Code 3718.01
  • Manufacturer: means any person that manufactures sewage treatment systems or components of systems. See Ohio Code 3718.01
  • Person: includes an individual, corporation, business trust, estate, trust, partnership, and association. See Ohio Code 1.59
  • Probable cause: A reasonable ground for belief that the offender violated a specific law.
  • Probate: Proving a will
  • Property: means real and personal property. See Ohio Code 1.59
  • Prosecute: To charge someone with a crime. A prosecutor tries a criminal case on behalf of the government.
  • Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
  • Rule: includes regulation. See Ohio Code 1.59
  • Septage hauler: means any person who engages in the collection, transportation, disposal, and land application of domestic septage. See Ohio Code 3718.01
  • Service provider: means any person who services, but does not install or alter, sewage treatment systems. See Ohio Code 3718.01
  • Sewage: includes liquids containing household chemicals in solution commonly discharged from a residence or from commercial, institutional, or other similar facilities. See Ohio Code 3718.01
  • Sewage treatment system: means a household sewage treatment system, a small flow on-site sewage treatment system, or both, as applicable. See Ohio Code 3718.01
  • Small flow on-site sewage treatment system: means a system, other than a household sewage treatment system, that treats not more than one thousand gallons of sewage per day and that does not require a national pollutant discharge elimination system permit issued under section 6111. See Ohio Code 3718.01
  • Soil: means the naturally occurring pedogenically developed and undeveloped regolith overlying bedrock. See Ohio Code 3718.01
  • state: means the state of Ohio. See Ohio Code 1.59
  • Vertical separation distance: means the distance of the infiltrative surface of the distribution system of a soil absorption system, or component thereof, to a limiting condition in the soil. See Ohio Code 3718.01
  • Water table: means the surface of the saturated zone below which all interconnected voids are filled with water and at which the pressure is atmospheric. See Ohio Code 3718.01
