(1) As used in ORS § 273.805 to 273.825, ‘common school grazing lands’ means lands owned by the State of Oregon and under the control of the Department of State Lands that are chiefly suitable for the grazing of animals, as determined by the department, and which are within, but not limited to, the following land classifications:

Terms Used In Oregon Statutes 273.805

  • Department: means the Department of State Lands. See Oregon Statutes 273.006
  • Land: includes water, water rights, easements of every nature and all appurtenances to land. See Oregon Statutes 273.006
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC

(a) Lands defined by ORS § 273.251 as indemnity lands, school lands or farmlands.

(b) Lands which have escheated to the state.

(2) Nothing in ORS § 273.805 to 273.825 is intended to be an express or implied limitation upon the powers of the department to acquire, lease, manage, control or protect land pursuant to authority otherwise granted by law. ORS § 273.805 to 273.825 and 327.430 are not the result of a legislative intent or belief that the department is without authority to acquire, lease, manage, protect or control common school grazing lands.
