Rhode Island General Laws 45-21-26. Ordinary death benefits
Upon the death of a member while in service, prior to retirement, from any cause other than accidental death arising directly out of and in the course of employment, a payment is made of the contributions of the member without interest. In addition, if the death of the member occurred while in an employee status, or while on an official leave of absence for illness from his or her position, which was not extended at the date of death for a continuous period in excess of one year, a death benefit is paid which equals eight hundred dollars ($800) for each completed year of total service, subject to a minimum payment of four thousand dollars ($4,000) and a maximum payment of sixteen thousand dollars ($16,000). The payment of the accumulated contributions of the member and the death benefit shall be made to the person that the member has nominated by written designation duly executed and filed with the retirement board or, if the member has filed no nomination, or if the person so nominated has died, then to the estate of the deceased member.

Terms Used In Rhode Island General Laws 45-21-26
- Accumulated contributions: means the sum of all amounts deducted from the compensation of a member and credited to his or her individual account in the members' contribution reserve account. See Rhode Island General Laws 45-21-2
- board: means the state retirement board created by chapter 8 of Title 36. See Rhode Island General Laws 45-21-2
- Employee: means any regular and permanent employee or officer of any municipality, whose business time at a minimum of twenty (20) hours a week is devoted to the service of the municipality, including elective officials and officials and employees of city and town housing authorities. See Rhode Island General Laws 45-21-2
- Member: means any person included in the membership of the retirement system as provided in §?45-21-8. See Rhode Island General Laws 45-21-2
- person: may be construed to extend to and include co-partnerships and bodies corporate and politic. See Rhode Island General Laws 43-3-6
- Service: means service as an employee of a municipality of the state of Rhode Island as defined in subdivision (7). See Rhode Island General Laws 45-21-2
- Total service: means prior service as defined in subdivision (15) plus service rendered as a member on or after the effective date of participation. See Rhode Island General Laws 45-21-2
