(a) This part shall be known as the “Three Stars of Tennessee Award.”

Terms Used In Tennessee Code 4-1-501

  • Decedent: A deceased person.
  • Representative: when applied to those who represent a decedent, includes executors and administrators, unless the context implies heirs and distributees. See Tennessee Code 1-3-105
  • Surviving next of kin: means the following persons in the order named:
    (A) The surviving spouse. See Tennessee Code 4-1-501
  • Year: means a calendar year, unless otherwise expressed. See Tennessee Code 1-3-105
(b) The award shall consist of a plaque and a medal.
(c) The governor or the governor’s designee shall present a Three Stars of Tennessee Award to each recipient or surviving next of kin during a public ceremony held on, or as near as practicable to, September 11 of each year.
(d) The homeland security council, created by Executive Order No. 8 of 2003, within the department of safety, shall:

(1) Select the recipients of the Three Stars of Tennessee Award; and
(2) Organize a ceremony in accordance with subsection (c).
(e) The commissioner of safety may, in collaboration with the homeland security council, promulgate rules to effectuate the purposes of this part. All rules must be promulgated in accordance with the Uniform Administrative Procedures Act, compiled in chapter 5 of this title.
(f) As used in this part, unless the context otherwise requires:

(1) “In the line of duty” means in the course of employment and in the actual discharge of the duties of the position; and
(2) “Surviving next of kin” means the following persons in the order named:

(A) The surviving spouse;
(B) The oldest surviving child of the decedent;
(C) The surviving parent or parents of the decedent;
(D) The oldest surviving sibling of the decedent;
(E) The oldest surviving grandchild of the decedent; or
(F) A representative of the agency of government in which the peace officer served at the time of the officer’s death, after attesting in writing that a good faith effort has been made to no avail to contact the individuals listed in subdivisions (f)(2)(A)-(E).
