- Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
- Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
- Apprentice: means a worker who:
(A) Is at least sixteen (16) years of age. See Tennessee Code 50-11-102 - Apprenticeship agreement: means a written agreement between an apprentice and a sponsor that contains the terms and conditions of the apprentice's employment and training consistent with 29 C. See Tennessee Code 50-11-102
- Apprenticeship council: means the Tennessee apprenticeship council established pursuant to §. See Tennessee Code 50-11-102
- Apprenticeship intermediary: means an entity that provides required technical instruction to an apprentice. See Tennessee Code 50-11-102
- Attorney general and reporter: means the Tennessee attorney general and reporter. See Tennessee Code 29-13-402
- Commissioner: means the commissioner of labor and workforce development. See Tennessee Code 50-11-102
- Commissioner: means the commissioner of labor and workforce development. See Tennessee Code 50-10-102
- Contract: A legal written agreement that becomes binding when signed.
- Conviction: A judgement of guilt against a criminal defendant.
- Court: means the circuit courts of the state of Tennessee, for the purposes of filing a claim, and any court of the state which has the jurisdiction to try a crime against person or property, for the purpose of assessing the costs provided for in §. See Tennessee Code 29-13-102
- Crime: means an offense under the laws of this state resulting in a specific physical, mental, or pecuniary injury, or death, to another person, and includes multiple crimes committed by a defendant. See Tennessee Code 29-13-402
- Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
- Defendant: means a person who:
(A) Is convicted of a crime in this state. See Tennessee Code 29-13-402 - Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
- Drug: means any controlled substance subject to testing pursuant to drug testing regulations adopted by the United States department of transportation. See Tennessee Code 50-9-103
- Employer: means a person employing an apprentice. See Tennessee Code 50-11-102
- Employer: means a person employing fifteen (15) or more employees. See Tennessee Code 50-10-102
- Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one. For example, a trial by jury is normally available in "law" cases but not in "equity" cases. Source: U.S. Courts
- Escrow: Money given to a third party to be held for payment until certain conditions are met.
- Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
- Nolo contendere: No contest-has the same effect as a plea of guilty, as far as the criminal sentence is concerned, but may not be considered as an admission of guilt for any other purpose.
- Office of apprenticeship: means the Tennessee office of apprenticeship established pursuant to §. See Tennessee Code 50-11-102
- On-the-job training: means training provided by an employer that:
(A) Is provided to a paid apprentice who is engaged in productive work in an occupation, and the work provides knowledge or skills essential to the full and adequate performance of the occupation. See Tennessee Code 50-11-102 - Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
- Person: includes a corporation, firm, company or association. See Tennessee Code 1-3-105
- Power of attorney: A written instrument which authorizes one person to act as another's agent or attorney. The power of attorney may be for a definite, specific act, or it may be general in nature. The terms of the written power of attorney may specify when it will expire. If not, the power of attorney usually expires when the person granting it dies. Source: OCC
- Pre-apprenticeship: means a program or set of services, in partnership with a registered apprenticeship program, designed to prepare individuals to enter and succeed in a registered apprenticeship program. See Tennessee Code 50-11-102
- Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
- Reporter: Makes a record of court proceedings and prepares a transcript, and also publishes the court's opinions or decisions (in the courts of appeals).
- Representative: when applied to those who represent a decedent, includes executors and administrators, unless the context implies heirs and distributees. See Tennessee Code 1-3-105
- Required technical instruction: means an organized and systematic form of instruction, other than on-the-job training, that:
(A) Is designed to provide an apprentice with knowledge of the subjects related to the apprentice's occupation. See Tennessee Code 50-11-102 - Sponsor: means a person operating a pre-apprenticeship or apprenticeship. See Tennessee Code 50-11-102
- State: when applied to the different parts of the United States, includes the District of Columbia and the several territories of the United States. See Tennessee Code 1-3-105
- State registration agency: means the Tennessee agency responsible for registering pre-apprenticeships, apprenticeships, and apprentices, and for reviewing pre-apprenticeships and apprenticeships for compliance with state law and the state plan for equal employment opportunities. See Tennessee Code 50-11-102
- test: means any chemical, biological or physical instrumental analysis administered by a laboratory authorized to do so pursuant to this chapter, for the purpose of determining the presence or absence of a drug or its metabolites pursuant to regulations governing drug testing adopted by the United States department of transportation or other recognized authority approved by rule by the commissioner of labor and workforce development. - Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
- Undue hardship: means an action requiring significant difficulty or expense. See Tennessee Code 50-10-102
- United States: includes the District of Columbia and the several territories of the United States. See Tennessee Code 1-3-105
- Victim: means :
(A) A person, not an accomplice of the defendant, who suffers a specific physical, mental, or pecuniary injury as a direct result of a crime. See Tennessee Code 29-13-402 - written: includes printing, typewriting, engraving, lithography, and any other mode of representing words and letters. See Tennessee Code 1-3-105
- Year: means a calendar year, unless otherwise expressed. See Tennessee Code 1-3-105
