As used in this chapter:
(1) “Advisory board” means:

- Administrator: includes "executor" when the subject matter justifies the use. See Utah Code 68-3-12.5
- Advisory board: means :(1)(a) for an agriculture protection area, the agriculture protection area advisory board created as provided in Section
17-41-201 ;(1)(b) for an industrial protection area, the industrial protection area advisory board created as provided in Section17-41-201 ; and(1)(c) for a critical infrastructure materials protection area, the critical infrastructure materials protection area advisory board created as provided in Section17-41-201 . See Utah Code 17-41-101- Agriculture protection area: means a geographic area created under the authority of this chapter that is granted the specific legal protections contained in this chapter. See Utah Code 17-41-101
- Board: means the Board of Oil, Gas, and Mining created in Section
40-6-4 . See Utah Code 17-41-101- City: includes , depending on population, a metro township as defined in Section
10-3c-102 . See Utah Code 68-3-12.5- Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
- Critical infrastructure materials: means sand, gravel, or rock aggregate. See Utah Code 17-41-101
- Critical infrastructure materials operations: means the extraction, excavation, processing, or reprocessing of critical infrastructure materials. See Utah Code 17-41-101
- Critical infrastructure materials protection area: means a geographic area created under the authority of this chapter on or after May 14, 2019, that is granted the specific legal protections contained in this chapter. See Utah Code 17-41-101
- Deposition: An oral statement made before an officer authorized by law to administer oaths. Such statements are often taken to examine potential witnesses, to obtain discovery, or to be used later in trial.
- Division: means the Division of Oil, Gas, and Mining created in Section
40-6-15 . See Utah Code 17-41-101- Executor: A male person named in a will to carry out the decedent
- Executor: includes "administrator" when the subject matter justifies the use. See Utah Code 68-3-12.5
- Fiduciary: A trustee, executor, or administrator.
- Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
- Guardian: includes a person who:
(14)(a) qualifies as a guardian of a minor or incapacitated person pursuant to testamentary or court appointment; or(14)(b) is appointed by a court to manage the estate of a minor or incapacitated person. See Utah Code 68-3-12.5- Industrial protection area: means a geographic area created under the authority of this chapter that is granted the specific legal protections contained in this chapter. See Utah Code 17-41-101
- Land: includes :
(18)(a) land;(18)(b) a tenement;(18)(c) a hereditament;(18)(d) a water right;(18)(e) a possessory right; and(18)(f) a claim. See Utah Code 68-3-12.5- Legislative: when used to describe the powers, duties, or functions of a county commission or council, refers to:
(3)(a) the power and duty to enact ordinances, levy taxes, and establish budgets; and(3)(b) those powers, duties, and functions that, under constitutional and statutory provisions and through long usage and accepted practice and custom at the federal and state level, have come to be regarded as belonging to the legislative branch of government. See Utah Code 17-50-101- Mine operator: means a natural person, corporation, association, partnership, receiver, trustee, executor, administrator, guardian, fiduciary, agent, or other organization or representative, either public or private, including a successor, assign, affiliate, subsidiary, and related parent company, that, as of January 1, 2019:
(13)(a) owns, controls, or manages a mining use under a large mine permit issued by the division or the board; and(13)(b) has produced commercial quantities of a mineral deposit from the mining use. See Utah Code 17-41-101- Mineral deposit: means the same as that term is defined in Section
40-8-4 . See Utah Code 17-41-101- Off-site: means the same as that term is defined in Section

40-8-4 . See Utah Code 17-41-101- Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
- Person: means :
(24)(a) an individual;(24)(b) an association;(24)(c) an institution;(24)(d) a corporation;(24)(e) a company;(24)(f) a trust;(24)(g) a limited liability company;(24)(h) a partnership;(24)(i) a political subdivision;(24)(j) a government office, department, division, bureau, or other body of government; and(24)(k) any other organization or entity. See Utah Code 68-3-12.5- Planning commission: means :
(21)(a) a countywide planning commission if the land proposed to be included in the agriculture protection area, industrial protection area, or critical infrastructure materials protection area is within the unincorporated part of the county and not within a planning advisory area;(21)(b) a planning advisory area planning commission if the land proposed to be included in the agriculture protection area, industrial protection area, or critical infrastructure materials protection area is within a planning advisory area; or(21)(c) a planning commission of a city or town if the land proposed to be included in the agriculture protection area, industrial protection area, or critical infrastructure materials protection area is within a city or town. See Utah Code 17-41-101- Political subdivision: means a county, city, town, school district, special district, or special service district. See Utah Code 17-41-101
- Property: includes both real and personal property. See Utah Code 68-3-12.5
- Road: includes :
(33)(a) a public bridge;(33)(b) a county way;(33)(c) a county road;(33)(d) a common road; and(33)(e) a state road. See Utah Code 68-3-12.5- State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
- Town: includes , depending on population, a metro township as defined in Section
10-3c-102 . See Utah Code 68-3-12.5- Trustee: A person or institution holding and administering property in trust.
- Unincorporated: means not within a city or town. See Utah Code 17-41-101
- Vested mining use: means a mining use:
(26)(a) by a mine operator; and(26)(b) that existed or was conducted or otherwise engaged in before a political subdivision prohibits, restricts, or otherwise limits a mining use. See Utah Code 17-41-101(1)(a) for an agriculture protection area, the agriculture protection area advisory board created as provided in Section17-41-201 ;(1)(b) for an industrial protection area, the industrial protection area advisory board created as provided in Section17-41-201 ; and(1)(c) for a critical infrastructure materials protection area, the critical infrastructure materials protection area advisory board created as provided in Section17-41-201 .(2)(2)(a) “Agriculture production” means production for commercial purposes of crops, livestock, and livestock products.(2)(b) “Agriculture production” includes the processing or retail marketing of any crops, livestock, and livestock products when more than 50% of the processed or merchandised products are produced by the farm operator.(3) “Agriculture protection area” means a geographic area created under the authority of this chapter that is granted the specific legal protections contained in this chapter.(4) “Applicable legislative body” means:(4)(a) with respect to a proposed agriculture protection area, industrial protection area, or critical infrastructure materials protection area:(4)(a)(i) the legislative body of the county in which the land proposed to be included in the relevant protection area is located, if the land is within the unincorporated part of the county; or(4)(a)(ii) the legislative body of the city or town in which the land proposed to be included in the relevant protection area is located; and(4)(b) with respect to an existing agriculture protection area, industrial protection area, or critical infrastructure materials protection area:(4)(b)(i) the legislative body of the county in which the relevant protection area is located, if the relevant protection area is within the unincorporated part of the county; or(4)(b)(ii) the legislative body of the city or town in which the relevant protection area is located.(5) “Board” means the Board of Oil, Gas, and Mining created in Section40-6-4 .(6) “Critical infrastructure materials” means sand, gravel, or rock aggregate.(7) “Critical infrastructure materials operations” means the extraction, excavation, processing, or reprocessing of critical infrastructure materials.(8) “Critical infrastructure materials operator” means a natural person, corporation, association, partnership, receiver, trustee, executor, administrator, guardian, fiduciary, agent, or other organization or representative, either public or private, including a successor, assign, affiliate, subsidiary, and related parent company, that:(8)(a) owns, controls, or manages a critical infrastructure materials operation; and(8)(b) has produced commercial quantities of critical infrastructure materials from the critical infrastructure materials operations.(9) “Critical infrastructure materials protection area” means a geographic area created under the authority of this chapter on or after May 14, 2019, that is granted the specific legal protections contained in this chapter.(10) “Crops, livestock, and livestock products” includes:(10)(a) land devoted to the raising of useful plants and animals with a reasonable expectation of profit, including:(10)(a)(i) forages and sod crops;(10)(a)(ii) grains and feed crops;(10)(a)(iii) livestock as defined in Section59-2-102 ;(10)(a)(iv) trees and fruits; or(10)(a)(v) vegetables, nursery, floral, and ornamental stock; or(10)(b) land devoted to and meeting the requirements and qualifications for payments or other compensation under a crop-land retirement program with an agency of the state or federal government.(11) “Division” means the Division of Oil, Gas, and Mining created in Section40-6-15 .(12) “Industrial protection area” means a geographic area created under the authority of this chapter that is granted the specific legal protections contained in this chapter.(13) “Mine operator” means a natural person, corporation, association, partnership, receiver, trustee, executor, administrator, guardian, fiduciary, agent, or other organization or representative, either public or private, including a successor, assign, affiliate, subsidiary, and related parent company, that, as of January 1, 2019:(13)(a) owns, controls, or manages a mining use under a large mine permit issued by the division or the board; and(13)(b) has produced commercial quantities of a mineral deposit from the mining use.(14) “Mineral deposit” means the same as that term is defined in Section40-8-4 .(15) “Mining protection area” means land where a vested mining use occurs, including each surface or subsurface land or mineral estate that a mine operator with a vested mining use owns or controls.(16) “Mining use”:(16)(a) means:(16)(a)(i) the full range of activities, from prospecting and exploration to reclamation and closure, associated with the exploitation of a mineral deposit; and(16)(a)(ii) the use of the surface and subsurface and groundwater and surface water of an area in connection with the activities described in Subsection (16)(a)(i) that have been, are being, or will be conducted; and(16)(b) includes, whether conducted on-site or off-site:(16)(b)(i) any sampling, staking, surveying, exploration, or development activity;(16)(b)(ii) any drilling, blasting, excavating, or tunneling;(16)(b)(iii) the removal, transport, treatment, deposition, and reclamation of overburden, development rock, tailings, and other waste material;(16)(b)(iv) any removal, transportation, extraction, beneficiation, or processing of ore;(16)(b)(v) any smelting, refining, autoclaving, or other primary or secondary processing operation;(16)(b)(vi) the recovery of any mineral left in residue from a previous extraction or processing operation;(16)(b)(vii) a mining activity that is identified in a work plan or permitting document;(16)(b)(viii) the use, operation, maintenance, repair, replacement, or alteration of a building, structure, facility, equipment, machine, tool, or other material or property that results from or is used in a surface or subsurface mining operation or activity;(16)(b)(ix) any accessory, incidental, or ancillary activity or use, both active and passive, including a utility, private way or road, pipeline, land excavation, working, embankment, pond, gravel excavation, mining waste, conveyor, power line, trackage, storage, reserve, passive use area, buffer zone, and power production facility;(16)(b)(x) the construction of a storage, factory, processing, or maintenance facility; and(16)(b)(xi) an activity described in Subsection40-8-4 (19)(a).(17)(17)(a) “Municipal” means of or relating to a city or town.(17)(b) “Municipality” means a city or town.(18) “New land” means surface or subsurface land or mineral estate that a mine operator gains ownership or control of, whether that land or mineral estate is included in the mine operator’s large mine permit.(19) “Off-site” means the same as that term is defined in Section40-8-4 .(20) “On-site” means the same as that term is defined in Section40-8-4 .(21) “Planning commission” means:(21)(a) a countywide planning commission if the land proposed to be included in the agriculture protection area, industrial protection area, or critical infrastructure materials protection area is within the unincorporated part of the county and not within a planning advisory area;(21)(b) a planning advisory area planning commission if the land proposed to be included in the agriculture protection area, industrial protection area, or critical infrastructure materials protection area is within a planning advisory area; or(21)(c) a planning commission of a city or town if the land proposed to be included in the agriculture protection area, industrial protection area, or critical infrastructure materials protection area is within a city or town.(22) “Political subdivision” means a county, city, town, school district, special district, or special service district.(23) “Proposal sponsors” means the owners of land in agricultural production, industrial use, or critical infrastructure materials operations who are sponsoring the proposal for creating an agriculture protection area, industrial protection area, or critical infrastructure materials protection area.(24) “State agency” means each department, commission, board, council, agency, institution, officer, corporation, fund, division, office, committee, authority, laboratory, library, unit, bureau, panel, or other administrative unit of the state.(25) “Unincorporated” means not within a city or town.(26) “Vested mining use” means a mining use:(26)(a) by a mine operator; and(26)(b) that existed or was conducted or otherwise engaged in before a political subdivision prohibits, restricts, or otherwise limits a mining use.
