(1) Except as provided in Subsection (2), the division may not approve an operation plan or issue a permit for construction of a new facility that:
Terms Used In Utah Code 19-6-125
- Division: means the Division of Waste Management and Radiation Control, created in Subsection 19-1-105(1)(d). See Utah Code 19-6-102
- Infectious waste: means a solid waste that contains or may reasonably be expected to contain pathogens of sufficient virulence and quantity that exposure to the waste by a susceptible host could result in an infectious disease. See Utah Code 19-6-102
- Permit: includes an operation plan. See Utah Code 19-6-102
(1)(a) incinerates infectious waste or chemotherapeutic agents; and
(1)(b) is located within a two-mile radius of an area zoned residential on January 1, 2014.
(2) The division may approve renewal or modification of an operation plan or a permit for a facility that is in operation as of May 13, 2014.
