(1) To provide an adequate and flexible system of protection, propagation, introduction, increase, control, harvest, management, and conservation of protected wildlife in this state and to provide for the use and development of protected wildlife for public recreation and food supply while maintaining a sustainable population of protected wildlife, the Wildlife Board shall determine the circumstances, time, location, means, and the amounts and numbers of protected wildlife that may be taken.

Terms Used In Utah Code 23A-2-305

  • Certificate of registration: means a paper-based or electronic document issued under this title, or a rule or proclamation of the Wildlife Board granting authority to engage in activities not covered by a license, permit, or tag. See Utah Code 23A-1-101
  • Fishing: means to take fish or crayfish by any means. See Utah Code 23A-1-101
  • Hunting: means to take or pursue a reptile, amphibian, bird, or mammal by any means. See Utah Code 23A-1-101
  • Permit: means a paper-based or electronic document that grants authority to engage in specified activities under this title or a rule or proclamation of the Wildlife Board. See Utah Code 23A-1-101
  • Possession: means actual or constructive possession. See Utah Code 23A-1-101
  • Protected wildlife: means wildlife, except as provided in Subsection (43)(b). See Utah Code 23A-1-101
  • State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
  • Tag: means a card, label, or other paper-based or electronic means of identification used to document harvest of protected wildlife. See Utah Code 23A-1-101
  • Trapping: means taking protected wildlife with a trapping device. See Utah Code 23A-1-101
  • Wildlife: means :
         (61)(a) crustaceans, including brine shrimp and crayfish;
         (61)(b) mollusks; and
         (61)(c) vertebrate animals living in nature, except feral animals. See Utah Code 23A-1-101
  • Wildlife Board: means the board created in Section 23A-2-301. See Utah Code 23A-1-101
  • Wildlife parts: means biological material derived from the body or anatomy of wildlife, including:
         (63)(a) an antler or horn;
         (63)(b) a hide;
         (63)(c) a bone; or
         (63)(d) meat. See Utah Code 23A-1-101
(2) The Wildlife Board shall, except as otherwise specified in this title:

     (2)(a) fix seasons and shorten, extend, or close seasons on any species of protected wildlife in any locality, or in the entire state, if the Wildlife Board finds that the action is necessary to effectuate proper wildlife management and control;
     (2)(b) close or open areas to fishing, trapping, or hunting;
     (2)(c) establish refuges and preserves;
     (2)(d) regulate and prescribe the means by which protected wildlife may be taken;
     (2)(e) regulate the transportation and storage of protected wildlife, or the wildlife parts, within the boundaries of the state and the shipment or transportation out of the state;
     (2)(f) establish or change bag limits and possession limits;
     (2)(g) prescribe safety measures and establish other regulations as may be considered necessary in the interest of wildlife conservation and the safety and welfare of hunters, trappers, fishermen, landowners, and the public;
     (2)(h)

          (2)(h)(i) prescribe when a license, permit, tag, or certificate of registration is required and procedures for their issuance and use; and
          (2)(h)(ii) establish forms and fees for a license, permit, tag, or certificate of registration; and
     (2)(i) make rules, in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, as the Wildlife Board may consider necessary to control the use and harvest of protected wildlife by private associations, clubs, partnerships, or corporations, provided the rules do not preclude the landowner from personally controlling trespass upon the owner’s properties nor from charging a fee to trespass for purposes of hunting or fishing.
(3) The Wildlife Board may allow a season on protected wildlife to commence on any day of the week except Sunday.
(4)

     (4)(a) The Wildlife Board shall establish fees for licenses, permits, tags, and certificates of registration in accordance with Section 63J-1-504.
     (4)(b) The Wildlife Board may adjust the amount for an electronic duck stamp fee as provided in Section 23A-4-211.
(5) The Wildlife Board may not issue a license, permit, tag, or certificate of registration as a reward for an individual’s assistance with a prosecution for violation of Section 76-6-111.
