Terms Used In Utah Code > Title 23A > Chapter 2 - Administration
- absent: means the failure of a school-age child assigned to a class or class period to attend a class or class period. See Utah Code 53G-6-201
- Address: includes :(1)(b)(i) a post office box number;(1)(b)(ii) a rural free delivery route number; and(1)(b)(iii) a street name and number. See Utah Code 16-6a-102
- Administrator: includes "executor" when the subject matter justifies the use. See Utah Code 68-3-12.5
- Advice and consent: Under the Constitution, presidential nominations for executive and judicial posts take effect only when confirmed by the Senate, and international treaties become effective only when the Senate approves them by a two-thirds vote.
- Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
- Affirmed: In the practice of the appellate courts, the decree or order is declared valid and will stand as rendered in the lower court.
- Allegation: something that someone says happened.
- Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
- Annual charter school enrollment: means the total enrollment of all students in the state enrolled in a charter school in grades kindergarten through grade 12, based on October 1 enrollment counts. See Utah Code 53G-5-601
- Annual state enrollment: means the total enrollment of all students in the state enrolled in a public school in grades kindergarten through grade 12, based on October 1 enrollment counts. See Utah Code 53G-5-601
- Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
- Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
- Appraisal: A determination of property value.
- Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
- Armed forces: means the United States Army, Navy, Air Force, Marine Corps, Space Force, and Coast Guard. See Utah Code 68-3-12.5
- Asset: means property of all kinds, real and personal, tangible and intangible, and includes:
(1)(a) cash;(1)(b) stock or other investments;(1)(c) real property;(1)(d) equipment and supplies;(1)(e) an ownership interest;(1)(f) a license;(1)(g) a cause of action; and(1)(h) any similar property. See Utah Code 53G-5-102- Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
- Assumed corporate name: means a name assumed for use in this state:
(4)(a) by a:(4)(a)(i) foreign corporation as described in Section16-10a-1506 ; or(4)(a)(ii) a foreign nonprofit corporation as described in Section16-6a-1506 ; and(4)(b) because the corporate name of the foreign corporation described in Subsection (4)(a) is not available for use in this state. See Utah Code 16-6a-102- Athletic association: means an association, as that term is defined in Section 53G-7-1101. See Utah Code 53G-6-1001
- Authority: means the Utah Charter School Finance Authority created by this part. See Utah Code 53G-5-601
- authorizer: means an entity listed in Section
53G-5-205 that authorizes a charter school. See Utah Code 53G-5-102- Bail: Security given for the release of a criminal defendant or witness from legal custody (usually in the form of money) to secure his/her appearance on the day and time appointed.
- Bankruptcy: Refers to statutes and judicial proceedings involving persons or businesses that cannot pay their debts and seek the assistance of the court in getting a fresh start. Under the protection of the bankruptcy court, debtors may discharge their debts, perhaps by paying a portion of each debt. Bankruptcy judges preside over these proceedings.
- Baseline: Projection of the receipts, outlays, and other budget amounts that would ensue in the future without any change in existing policy. Baseline projections are used to gauge the extent to which proposed legislation, if enacted into law, would alter current spending and revenue levels.
- Bequest: Property gifted by will.
- Big game: means species of hoofed protected wildlife. See Utah Code 23A-1-101
- Birth certificate: means an official record of an individual's date of birth, place of birth, sex, and parentage, including a supplementary certificate of birth or birth certificate amendment and amendment history as provided in Sections 26B-8-110 and 26B-8-111. See Utah Code 53G-6-1001
- Board: means the governing board of the authority described in Section 53G-5-602. See Utah Code 53G-5-601
- board of directors: means the body authorized to manage the affairs of a domestic or foreign nonprofit corporation. See Utah Code 16-6a-102
- board of trustees: means :
(3)(a) the board of trustees of:(3)(a)(i) the University of Utah;(3)(a)(ii) Utah State University;(3)(a)(iii) Weber State University;(3)(a)(iv) Southern Utah University;(3)(a)(v) Snow College;(3)(a)(vi) Utah Tech University;(3)(a)(vii) Utah Valley University; or(3)(a)(viii) Salt Lake Community College;(3)(b) a technical college board of trustees described in Section53B-2a-108 ; or(3)(c) a board of trustees of a private, nonprofit college or university in the state that is accredited by the Northwest Commission on Colleges and Universities. See Utah Code 53G-5-102- Bylaws: includes :
(6)(b)(i) amended bylaws; and(6)(b)(ii) restated bylaws. See Utah Code 16-6a-102- Certificate of registration: means a paper-based or electronic document issued under this title, or a rule or proclamation of the Wildlife Board granting authority to engage in activities not covered by a license, permit, or tag. See Utah Code 23A-1-101
- Charter school: means a school created under this chapter. See Utah Code 53G-5-601
- City: includes , depending on population, a metro township as defined in Section
10-3c-102 . See Utah Code 68-3-12.5- Class: means a group of memberships that has the same right with respect to voting, dissolution, redemption, transfer, or other characteristics. See Utah Code 16-6a-102
- Commission: means the School Activity Eligibility Commission created in Section 53G-6-1003. See Utah Code 53G-6-1001
- Common law: The legal system that originated in England and is now in use in the United States. It is based on judicial decisions rather than legislative action.
- Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
- Continuance: Putting off of a hearing ot trial until a later time.
- Contract: A legal written agreement that becomes binding when signed.
- Conviction: A judgement of guilt against a criminal defendant.
- Corporate name: means :
(13)(a) the name of a domestic corporation as stated in the domestic corporation's articles of incorporation;(13)(b) the name of a domestic nonprofit corporation as stated in the domestic nonprofit corporation's articles of incorporation;(13)(c) the name of a foreign corporation as stated in the foreign corporation's:(13)(c)(i) articles of incorporation; or(13)(c)(ii) document of similar import to articles of incorporation; or(13)(d) the name of a foreign nonprofit corporation as stated in the foreign nonprofit corporation's:(13)(d)(i) articles of incorporation; or(13)(d)(ii) document of similar import to articles of incorporation. See Utah Code 16-6a-102- Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
- County executive: means :
(7)(a) the county commission, in the county commission or expanded county commission form of government established under Title 17, Chapter 52a, Changing Forms of County Government;(7)(b) the county executive, in the county executive-council optional form of government authorized by Section17-52a-203 ; or(7)(c) the county manager, in the council-manager optional form of government authorized by Section17-52a-204 . See Utah Code 68-3-12.5- County legislative body: means :
(8)(a) the county commission, in the county commission or expanded county commission form of government established under Title 17, Chapter 52a, Changing Forms of County Government;(8)(b) the county council, in the county executive-council optional form of government authorized by Section17-52a-203 ; and(8)(c) the county council, in the council-manager optional form of government authorized by Section17-52a-204 . See Utah Code 68-3-12.5- Credit enhancement program: means the Charter School Credit Enhancement Program established in Section 53G-5-606. See Utah Code 53G-5-601
- Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
- Debt service reserve fund: means the reserve fund created or established by, or for the benefit of, a qualifying charter school for the purpose of paying principal of and interest on bonds issued under the credit enhancement program as the payments become due and other money of the qualifying charter school is not available to make the payments. See Utah Code 53G-5-601
- Debt service reserve fund requirement: means , as of a particular date of computation, and with respect to a particular issue of bonds, the amount required to be on deposit in the debt service reserve fund, which amount:
(8)(a) may be a sum certain or as set forth in a formula; and(8)(b) may not be less than the maximum annual debt service requirement for the related bonds. See Utah Code 53G-5-601- Deliver: includes delivery by mail or another means of transmission authorized by Section
16-6a-103 , except that delivery to the division means actual receipt by the division. See Utah Code 16-6a-102- Department: means the Department of Natural Resources. See Utah Code 23A-1-101
- Dependent: A person dependent for support upon another.
- Devise: To gift property by will.
- Director: means the director of the division appointed under Section
23A-2-202 . See Utah Code 23A-1-101- Director: means a member of the board of directors. See Utah Code 16-6a-102
- Division: means the Division of Wildlife Resources. See Utah Code 23A-1-101
- Division: means the Division of Corporations and Commercial Code. See Utah Code 16-6a-102
- Division: means the Criminal Investigations and Technical Services Division of the Department of Public Safety, established in Section 53-10-103. See Utah Code 53G-6-601
- Does not correspond with the sex designation: means that a student's sex designation for an interscholastic activity in which a student seeks participation does not correspond with the sex designation on the student's birth certificate or an amendment, including the amendment history, to the student's birth certificate that the Division of Vital Records and Statistics provides. See Utah Code 53G-6-1001
- domestic nonprofit corporation: means an entity that:
(37)(a) is not a foreign nonprofit corporation; and(37)(b) is incorporated under or subject to this chapter. See Utah Code 16-6a-102- Donor: The person who makes a gift.
- Educational neglect: means the same as that term is defined in Section
80-1-102 . See Utah Code 53G-6-201- Eligible entity: means :
(1)(a) a city or town with a population density of 3,000 or more people per square mile; or(1)(b) a county whose unincorporated area includes a qualifying planning advisory area. See Utah Code 53G-4-901- Endangered: means wildlife designated as endangered according to Section 3 of the federal Endangered Species Act of 1973. See Utah Code 23A-1-101
- Equal: means , with respect to biological sex, of the same value. See Utah Code 68-3-12.5
- Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
- Executive director: means the executive director of the Department of Natural Resources. See Utah Code 23A-1-101
- Fair market value: The price at which an asset would change hands in a transaction between a willing, informed buyer and a willing, informed seller.
- Father: means a parent who is of the male sex. See Utah Code 68-3-12.5
- Federal law: means :
(1)(a) a statute passed by the Congress of the United States; or(1)(b) a final regulation:(1)(b)(i) adopted by an administrative agency of the United States government; and(1)(b)(ii) published in the code of federal regulations or the federal register. See Utah Code 53G-6-801- fee: means the same as that term is defined in Section
53G-7-501 . See Utah Code 53G-6-701- Fee simple: Absolute title to property with no limitations or restrictions regarding the person who may inherit it.
- Female: means the characteristic of an individual whose biological reproductive system is of the general type that functions in a way that could produce ova. See Utah Code 68-3-12.5
- Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
- Fishing: means to take fish or crayfish by any means. See Utah Code 23A-1-101
- Foreign nonprofit corporation: means an entity:
(28)(a) incorporated under a law other than the laws of this state; and(28)(b) that would be a nonprofit corporation if formed under the laws of this state. See Utah Code 16-6a-102- Game: means wildlife normally pursued, caught, or taken by sporting means for human use. See Utah Code 23A-1-101
- Gender identity: means the same as that term is defined in Section 34A-5-102. See Utah Code 53G-6-1001
- Gender-designated: means that an interscholastic activity or facility is designated specifically for female or male students. See Utah Code 53G-6-1001
- Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
- Grantor: The person who establishes a trust and places property into it.
- Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
- Guardian: includes a person who:
(14)(a) qualifies as a guardian of a minor or incapacitated person pursuant to testamentary or court appointment; or(14)(b) is appointed by a court to manage the estate of a minor or incapacitated person. See Utah Code 68-3-12.5- Highway: includes :
(15)(a) a public bridge;(15)(b) a county way;(15)(c) a county road;(15)(d) a common road; and(15)(e) a state road. See Utah Code 68-3-12.5- Home-based microschool: means an individual or association of individuals that:
(3)(a)(i) registers as a business entity in accordance with state and local laws; and(3)(a)(ii) for compensation, provides kindergarten through grade 12 education services to 16 or fewer students from an individual's residential dwelling, accessory dwelling unit, or residential property. See Utah Code 53G-6-201- Hunting: means to take or pursue a reptile, amphibian, bird, or mammal by any means. See Utah Code 23A-1-101
- Individual: means :
(31)(a) a natural person;(31)(b) the estate of an incompetent individual; or(31)(c) the estate of a deceased individual. See Utah Code 16-6a-102- Interest rate: The amount paid by a borrower to a lender in exchange for the use of the lender's money for a certain period of time. Interest is paid on loans or on debt instruments, such as notes or bonds, either at regular intervals or as part of a lump sum payment when the issue matures. Source: OCC
- Interrogatories: Written questions asked by one party of an opposing party, who must answer them in writing under oath; a discovery device in a lawsuit.
- Interscholastic activity: means an activity in which a student represents the student's school in the activity in competition against another school. See Utah Code 53G-6-1001
- Interscholastic athletic activity: means that a student represents the student's school or LEA in competition against another school or LEA in an athletic or sporting activity. See Utah Code 53G-6-901
- Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
- Land: includes :
(18)(a) land;(18)(b) a tenement;(18)(c) a hereditament;(18)(d) a water right;(18)(e) a possessory right; and(18)(f) a claim. See Utah Code 68-3-12.5- Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
- Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.
- Lien: A claim against real or personal property in satisfaction of a debt.
- mailing: includes registered or certified mail for which the proper fee is paid. See Utah Code 16-6a-102
- Male: means the characteristic of an individual whose biological reproductive system is of the general type that functions to fertilize the ova of a female. See Utah Code 68-3-12.5
- Member: includes :
(34)(b)(i) "voting member"; and(34)(b)(ii) a shareholder in a water company. See Utah Code 16-6a-102- Micro-education entity: means a person or association of persons that:
(5)(a)(i) registers as a business entity in accordance with state and local laws; and(5)(a)(ii) for compensation, provides kindergarten through grade 12 education services to 100 students or fewer. See Utah Code 53G-6-201- Minor: means an individual who is under 18 years old. See Utah Code 53G-6-201
- Month: means a calendar month, unless otherwise expressed. See Utah Code 68-3-12.5
- Mother: means a parent who is of the female sex. See Utah Code 68-3-12.5
- Municipality: means the same as that term is defined in Section
10-1-104 . See Utah Code 53G-3-102- New school district: means a school district created under Section
Utah Code 53G-3-102 - Nolo contendere: No contest-has the same effect as a plea of guilty, as far as the criminal sentence is concerned, but may not be considered as an admission of guilt for any other purpose.
- Nominating committee: means the Wildlife Board Nominating Committee created in Section
23A-2-302 . See Utah Code 23A-1-101- Notice: means the same as that term is defined in Section
16-6a-103 . See Utah Code 16-6a-102- Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
- Oversight: Committee review of the activities of a Federal agency or program.
- Parent: includes :
(7)(a) a custodial parent of the minor;(7)(b) a legally appointed guardian of a minor; or(7)(c) any other person purporting to exercise any authority over the minor which could be exercised by a person described in Subsection (7)(a) or (b). See Utah Code 53G-6-201- Permit: means a paper-based or electronic document that grants authority to engage in specified activities under this title or a rule or proclamation of the Wildlife Board. See Utah Code 23A-1-101
- Person: means an individual, association, partnership, government agency, corporation, or an agent of the individual, association, partnership, government agency, or corporation. See Utah Code 23A-1-101
- Person: means an:
(40)(a) individual; or(40)(b) entity. See Utah Code 16-6a-102- Person: means :
(24)(a) an individual;(24)(b) an association;(24)(c) an institution;(24)(d) a corporation;(24)(e) a company;(24)(f) a trust;(24)(g) a limited liability company;(24)(h) a partnership;(24)(i) a political subdivision;(24)(j) a government office, department, division, bureau, or other body of government; and(24)(k) any other organization or entity. See Utah Code 68-3-12.5- Personal property: All property that is not real property.
- Personal property: includes :
(25)(a) money;(25)(b) goods;(25)(c) chattels;(25)(d) effects;(25)(e) evidences of a right in action;(25)(f) a written instrument by which a pecuniary obligation, right, or title to property is created, acknowledged, transferred, increased, defeated, discharged, or diminished; and(25)(g) a right or interest in an item described in Subsections (25)(a) through (f). See Utah Code 68-3-12.5- Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court.
- Possession: means actual or constructive possession. See Utah Code 23A-1-101
- Power of attorney: A written instrument which authorizes one person to act as another's agent or attorney. The power of attorney may be for a definite, specific act, or it may be general in nature. The terms of the written power of attorney may specify when it will expire. If not, the power of attorney usually expires when the person granting it dies. Source: OCC
- Precedent: A court decision in an earlier case with facts and law similar to a dispute currently before a court. Precedent will ordinarily govern the decision of a later similar case, unless a party can show that it was wrongly decided or that it differed in some significant way.
- Principal office: means :
(41)(a) the office, in or out of this state, designated by a domestic or foreign nonprofit corporation as its principal office in the most recent document on file with the division providing that information, including:(41)(a)(i) an annual report;(41)(a)(ii) an application for a certificate of authority; or(41)(a)(iii) a notice of change of principal office; or(41)(b) if no principal office can be determined, a domestic or foreign nonprofit corporation's registered office. See Utah Code 16-6a-102- Probable cause: A reasonable ground for belief that the offender violated a specific law.
- Process: means a writ or summons issued in the course of a judicial proceeding. See Utah Code 68-3-12.5
- Proclamation: means the publication that is:
(41)(a) used to convey a statute, rule, policy, or pertinent information related to wildlife; and(41)(b) issued in accordance with a rule made by the Wildlife Board under this title. See Utah Code 23A-1-101- Project: means :
(10)(a) any building, structure, or property owned, to be acquired, or used by a charter school for any of its educational purposes and the related appurtenances, easements, rights-of-way, improvements, paving, utilities, landscaping, parking facilities, and lands; or(10)(b) any capital equipment owned, to be acquired, or used by a charter school for any of its educational purposes, interests in land, and grounds, together with the personal property necessary, convenient, or appurtenant to them. See Utah Code 53G-5-601- Property: includes both real and personal property. See Utah Code 68-3-12.5
- Protected wildlife: means wildlife, except as provided in Subsection (43)(b). See Utah Code 23A-1-101
- Purchase price: means the greater of:
(2)(a) an amount that is the average of:(2)(a)(i) the appraised value of the surplus property, based on the predominant zone in the surrounding area, as indicated in an appraisal obtained by the eligible entity; and(2)(a)(ii) the appraised value of the surplus property, based on the predominant zone in the surrounding area, as indicated in an appraisal obtained by the school district; and(2)(b) the amount the school district paid to acquire the surplus property. See Utah Code 53G-4-901- Qualifying charter school: means a charter school that:
(11)(a) meets standards adopted by the authority for participation in the credit enhancement program; and(11)(b) is designated by the authority as a qualifying charter school for purposes of participation in the credit enhancement program. See Utah Code 53G-5-601- Qualifying planning advisory area: means a planning advisory area under Section 17-27a-306 that has a population density of 3,000 or more people per square mile within the boundaries of the planning advisory area. See Utah Code 53G-4-901
- Quorum: The number of legislators that must be present to do business.
- Reasonably accommodate: means an LEA shall make its best effort to enable a parent to exercise a parental right specified in Section 53G-6-803:
(2)(a) without substantial impact to staff and resources, including employee working conditions, safety and supervision on school premises and for school activities, and the efficient allocation of expenditures; and(2)(b) while balancing:(2)(b)(i) the parental rights of parents;(2)(b)(ii) the educational needs of other students;(2)(b)(iii) the academic and behavioral impacts to a classroom;(2)(b)(iv) a teacher's workload; and(2)(b)(v) the assurance of the safe and efficient operation of a school. See Utah Code 53G-6-801- Receive: when used in reference to receipt of a writing or other document by a domestic or foreign nonprofit corporation, means the writing or other document is actually received:
(43)(a) by the domestic or foreign nonprofit corporation at:(43)(a)(i) its registered office in this state; or(43)(a)(ii) its principal office;(43)(b) by the secretary of the domestic or foreign nonprofit corporation, wherever the secretary is found; or(43)(c) by another person authorized by the bylaws or the board of directors to receive the writing or other document, wherever that person is found. See Utah Code 16-6a-102- Regional advisory council: means a council created under Section
23A-2-303 . See Utah Code 23A-1-101- Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
- Reserve account: means the Charter School Reserve Account created in Section 53F-9-303. See Utah Code 53G-5-601
- resident: means a person who:
(47)(a) has been domiciled in the state for six consecutive months immediately preceding the purchase of a license; and(47)(b) does not claim residency for hunting, fishing, or trapping in another state or country. See Utah Code 23A-1-101- School day: means the portion of a day that school is in session in which a school-age child is required to be in school for purposes of receiving instruction. See Utah Code 53G-6-201
- School year: means the period of time designated by a local school board or charter school governing board as the school year for the school where the school-age child:
(9)(a) is enrolled; or(9)(b) should be enrolled, if the school-age child is not enrolled in school. See Utah Code 53G-6-201- School-age child: means a minor who:
(10)(a) is at least six years old but younger than 18 years old; and(10)(b) is not emancipated. See Utah Code 53G-6-201- Sex: means the biological, physical condition of being male or female, determined by an individual's genetics and anatomy at birth. See Utah Code 53G-6-901
- Sex: means , in relation to an individual, the individual's biological sex, either male or female, at birth, according to distinct reproductive roles as manifested by:
(34)(a) sex and reproductive organ anatomy;(34)(b) chromosomal makeup; and(34)(c) endogenous hormone profiles. See Utah Code 68-3-12.5- Signature: includes a name, mark, or sign written with the intent to authenticate an instrument or writing. See Utah Code 68-3-12.5
- State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
- State registrar: means the State Registrar of Vital Statistics within the Department of Health and Human Services. See Utah Code 53G-6-601
- Statute: A law passed by a legislature.
- Student: means a student who is enrolled in a public school that participates in interscholastic activities. See Utah Code 53G-6-1001
- Summons: Another word for subpoena used by the criminal justice system.
- Surplus property: means land owned by a school district that:
(4)(a) was purchased with taxpayer money;(4)(b) is located within a city or town that is an eligible entity or within a qualifying planning advisory area;(4)(c) consists of one contiguous tract at least three acres in size; and(4)(d) has been declared by the school district to be surplus. See Utah Code 53G-4-901- Tag: means a card, label, or other paper-based or electronic means of identification used to document harvest of protected wildlife. See Utah Code 23A-1-101
- Take: means to:
(54)(a) hunt, pursue, harass, catch, capture, possess, gather, angle, seine, trap, or kill protected wildlife; or(54)(b) attempt an action referred to in Subsection (54)(a). See Utah Code 23A-1-101- Threatened: means wildlife designated as threatened pursuant to Section 3 of the federal Endangered Species Act of 1973. See Utah Code 23A-1-101
- Tort: A civil wrong or breach of a duty to another person, as outlined by law. A very common tort is negligent operation of a motor vehicle that results in property damage and personal injury in an automobile accident.
- Town: includes , depending on population, a metro township as defined in Section
10-3c-102 . See Utah Code 68-3-12.5- Trapping: means taking protected wildlife with a trapping device. See Utah Code 23A-1-101
- Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
- Truant: means a condition in which a school-age child, without a valid excuse, and subject to Subsection (11)(b), is absent for at least:
(11)(a)(i) half of the school day; or(11)(a)(ii) if the school-age child is enrolled in a learner verified program, as that term is defined by the state board, the relevant amount of time under the LEA's policy regarding the LEA's continuing enrollment measure as it relates to truancy. See Utah Code 53G-6-201- Truant minor: means a school-age child who:
(12)(a) is subject to the requirements of Section53G-6-202 or53G-6-203 ; and(12)(b) is truant. See Utah Code 53G-6-201- Trustee: A person or institution holding and administering property in trust.
- Uniformed services: means :
(40)(a) the armed forces;(40)(b) the commissioned corps of the National Oceanic and Atmospheric Administration; and(40)(c) the commissioned corps of the United States Public Health Service. See Utah Code 68-3-12.5- United States: includes each state, district, and territory of the United States of America. See Utah Code 68-3-12.5
- Uphold: The decision of an appellate court not to reverse a lower court decision.
- Utah Code: means the 1953 recodification of the Utah Code, as amended, unless the text expressly references a portion of the 1953 recodification of the Utah Code as it existed:
(42)(a) on the day on which the 1953 recodification of the Utah Code was enacted; or(42)(b)(42)(b)(i) after the day described in Subsection (42)(a); and(42)(b)(ii) before the most recent amendment to the referenced portion of the 1953 recodification of the Utah Code. See Utah Code 68-3-12.5- Valid excuse: means :
(13)(a)(i) an illness, which may be either mental or physical, regardless of whether the school-age child or parent provides documentation from a medical professional;(13)(a)(ii) mental or behavioral health of the school-age child;(13)(a)(iii) a family death;(13)(a)(iv) an approved school activity;(13)(a)(v) an absence permitted by a school-age child's:(13)(a)(v)(A) individualized education program; or(13)(a)(v)(B) Section 504 accommodation plan;(13)(a)(vi) an absence permitted in accordance with Subsection53G-6-803 (5); or(13)(a)(vii) any other excuse established as valid by a local school board, charter school governing board, or school district. See Utah Code 53G-6-201- Venue: The geographical location in which a case is tried.
- Veteran: means an individual who:
(44)(a)(i) has served in the United States Armed Forces for at least 180 days:(44)(a)(i)(A) on active duty; or(44)(a)(i)(B) in a reserve component, to include the National Guard; or(44)(a)(ii) has incurred an actual service-related injury or disability while in the United States Armed Forces regardless of whether the individual completed 180 days; and(44)(a)(iii) was separated or retired under conditions characterized as honorable or general. See Utah Code 68-3-12.5- voting member: includes a "shareholder" if the nonprofit corporation has shareholders. See Utah Code 16-6a-102
- Wildlife: means :
(61)(a) crustaceans, including brine shrimp and crayfish;(61)(b) mollusks; and(61)(c) vertebrate animals living in nature, except feral animals. See Utah Code 23A-1-101- Wildlife Board: means the board created in Section
23A-2-301 . See Utah Code 23A-1-101- Wildlife parts: means biological material derived from the body or anatomy of wildlife, including:
(63)(a) an antler or horn;(63)(b) a hide;(63)(c) a bone; or(63)(d) meat. See Utah Code 23A-1-101- Writing: includes :
(48)(a) printing;(48)(b) handwriting; and(48)(c) information stored in an electronic or other medium if the information is retrievable in a perceivable format. See Utah Code 68-3-12.5
