(1) The division shall permit a person to fish without a license if:

Terms Used In Utah Code 23A-4-303

  • Certificate of registration: means a paper-based or electronic document issued under this title, or a rule or proclamation of the Wildlife Board granting authority to engage in activities not covered by a license, permit, or tag. See Utah Code 23A-1-101
  • Contract: A legal written agreement that becomes binding when signed.
  • Department: means the Department of Natural Resources. See Utah Code 23A-1-101
  • Division: means the Division of Wildlife Resources. See Utah Code 23A-1-101
  • Fishing: means to take fish or crayfish by any means. See Utah Code 23A-1-101
  • Intellectual disability: means a significant, subaverage general intellectual functioning that:
         (16)(a) exists concurrently with deficits in adaptive behavior; and
         (16)(b) is manifested during the developmental period as defined in the current edition of the Diagnostic and Statistical Manual of Mental Disorders, published by the American Psychiatric Association. See Utah Code 68-3-12.5
  • Permit: means a paper-based or electronic document that grants authority to engage in specified activities under this title or a rule or proclamation of the Wildlife Board. See Utah Code 23A-1-101
  • Person: means an individual, association, partnership, government agency, corporation, or an agent of the individual, association, partnership, government agency, or corporation. See Utah Code 23A-1-101
  • State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
     (1)(a)

          (1)(a)(i) the person resides in:

               (1)(a)(i)(A) the Utah State Developmental Center in American Fork;
               (1)(a)(i)(B) the state hospital;
               (1)(a)(i)(C) a veterans hospital;
               (1)(a)(i)(D) a veterans nursing home;
               (1)(a)(i)(E) a mental health center;
               (1)(a)(i)(F) an intermediate care facility for people with an intellectual disability;
               (1)(a)(i)(G) a group home licensed by the Department of Health and Human Services and operated under contract with the Division of Services for People with Disabilities;
               (1)(a)(i)(H) a group home or other community-based placement licensed by the Department of Health and Human Services and operated under contract with the Division of Juvenile Justice and Youth Services;
               (1)(a)(i)(I) a private residential facility for at-risk youth licensed by the Department of Health and Human Services; or
               (1)(a)(i)(J) another similar institution approved by the division; or
          (1)(a)(ii) the person is a youth who participates in a work camp operated by the Division of Juvenile Justice and Youth Services;
     (1)(b) the person is properly supervised by a representative of the institution described in Subsection (1)(a); and
     (1)(c) the institution described in Subsection (1)(a) obtains from the division a certificate of registration that specifies:

          (1)(c)(i) the date and place where the person will fish; and
          (1)(c)(ii) the name of the institution’s representative who will supervise the person fishing.
(2) The institution described in Subsection (1) shall apply for the certificate of registration at least 10 days before the fishing outing.

     (3)(a) An institution that receives a certificate of registration authorizing at-risk youth to fish shall provide instruction to the youth on fishing laws and regulations.
     (3)(b) The division shall provide educational materials to the institution to assist the institution in complying with Subsection (3)(a).
