(1) As used in this section:
Terms Used In Utah Code 23A-4-304
- Division: means the Division of Wildlife Resources. See Utah Code 23A-1-101
- Fishing: means to take fish or crayfish by any means. See Utah Code 23A-1-101
- Permit: means a paper-based or electronic document that grants authority to engage in specified activities under this title or a rule or proclamation of the Wildlife Board. See Utah Code 23A-1-101
- Person: means an individual, association, partnership, government agency, corporation, or an agent of the individual, association, partnership, government agency, or corporation. See Utah Code 23A-1-101
- State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
- Wildlife: means :(61)(a) crustaceans, including brine shrimp and crayfish;(61)(b) mollusks; and(61)(c) vertebrate animals living in nature, except feral animals. See Utah Code 23A-1-101(1)(a) “School” means an elementary school or a secondary school that:(1)(a)(i) is a public or private school located in the state; and(1)(a)(ii) provides student instruction for one or more years of kindergarten through grade 9.(1)(b) “Youth organization” means a local Utah chapter of:(1)(b)(i) the Boy Scouts of America;(1)(b)(ii) the Girls Scouts of the USA; or(1)(b)(iii) an organization that:(1)(b)(iii)(A) is exempt from taxation under Section 501(c)(3), Internal Revenue Code; and(1)(b)(iii)(B) promotes character building through outdoor activities.
(2) The division shall permit a person to fish without a license during a youth organization or school activity if:
(2)(a) the person is:
(2)(a)(i)
(2)(a)(i)(A) a member of the youth organization; or
(2)(a)(i)(B) a student enrolled in the school; and
(2)(a)(ii) younger than 16 years old;
(2)(b) the fishing is in compliance with the fishing statutes and rules;
(2)(c) the activity is part of a recreational or instructional program of the youth organization or school; and
(2)(d) an adult leader of the activity obtains from the youth organization or school:
(2)(d)(i) a valid tour permit; or
(2)(d)(ii) documentation that specifies:
(2)(d)(ii)(A) the date and place of the fishing activity;
(2)(d)(ii)(B) the name of the adult leader that will supervise the fishing; and
(2)(d)(ii)(C) that the activity is officially sanctioned or authorized by the youth organization or school.
(3)
(3)(a) The adult leader shall:
(3)(a)(i) possess a valid Utah fishing or combination license; and
(3)(a)(ii) instruct the activity participants on fishing statutes and rules.
(3)(b) The division shall provide educational materials on the division’s website to assist the adult leader in complying with Subsection (3)(a).
(4) In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the Wildlife Board shall adopt rules specifying the form of the documentation required under Subsection (2)(d)(ii).
