The department may deny or revoke a medical cannabis guardian card or a medical cannabis caregiver card if the applicant or cardholder:

(1) violates the requirements of this chapter; or

Terms Used In Utah Code 26B-4-246

  • Cannabis: means marijuana. See Utah Code 26B-4-201
  • Department: means the Department of Health and Human Services. See Utah Code 26B-4-201
  • Medical cannabis: means cannabis in a medicinal dosage form or a cannabis product in a medicinal dosage form. See Utah Code 26B-4-201
  • State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
(2) unless the individual completes any imposed sentence two or more years before the day on which the individual submits the application, has been convicted of any of the following under state or federal law:

     (2)(a) a drug distribution offense that is a felony within the preceding 10 years; or
     (2)(b) after December 3, 2018, a drug distribution offense that is a misdemeanor.
