As used in this part:
(1) “Business day” means the same as that term is defined in Section 26B-9-301 .
Terms Used In Utah Code 26B-9-501 v2
- Child support: is a s defined in Section 26B-9-301. See Utah Code 26B-9-501
- Driver license: means a license, as defined in Section 53-3-102. See Utah Code 26B-9-501
- Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
- Office: means the Office of Recovery Services. See Utah Code 26B-9-501
- Person: means :(24)(a) an individual;(24)(b) an association;(24)(c) an institution;(24)(d) a corporation;(24)(e) a company;(24)(f) a trust;(24)(g) a limited liability company;(24)(h) a partnership;(24)(i) a political subdivision;(24)(j) a government office, department, division, bureau, or other body of government; and(24)(k) any other organization or entity. See Utah Code 68-3-12.5(2) “Child support” means the same as that term is defined in Section
26B-9-101 .(3) “Delinquent on a child support obligation” means that a person:(3)(a)(3)(a)(i) made no payment for 60 days on a current child support obligation as set forth in an administrative or court order;(3)(a)(ii) after the 60-day period described in Subsection (3)(a)(i), failed to make a good faith effort under the circumstances to make payment on the child support obligation in accordance with the order; and(3)(a)(iii) has not obtained a judicial order staying enforcement of the person’s child support obligation, or the amount in arrears; or(3)(b)(3)(b)(i) made no payment for 60 days on an arrearage obligation of child support as set forth in:(3)(b)(i)(A) a payment schedule;(3)(b)(i)(B) a written agreement with the office; or(3)(b)(i)(C) an administrative or judicial order;(3)(b)(ii) after the 60-day period described in Subsection (3)(b)(i), failed to make a good faith effort under the circumstances to make payment on the child support obligation in accordance with the payment schedule, agreement, or order; and(3)(b)(iii) has not obtained a judicial order staying enforcement of the person’s child support obligation, or the amount in arrears.(4) “Driver license” means a license, as defined in Section53-3-102 .(5) “Driver License Division” means the Driver License Division of the Department of Public Safety created in Section53-3-103 .(6) “Office” means the Office of Recovery Services.
