Terms Used In Utah Code 34A-2-603

  • Commission: means the Labor Commission created in Section 34A-1-103. See Utah Code 34A-1-102
  • Commissioner: means the commissioner of the commission appointed under Section 34A-1-201. See Utah Code 34A-1-102
  • Compensation: means the payments and benefits provided for in this chapter or Chapter 3, Utah Occupational Disease Act. See Utah Code 34A-2-102
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Order: means an action of the commission that determines the legal rights, duties, privileges, immunities, or other interests of one or more specific persons, but not a class of persons. See Utah Code 34A-2-102
  • Person: means :
         (24)(a) an individual;
         (24)(b) an association;
         (24)(c) an institution;
         (24)(d) a corporation;
         (24)(e) a company;
         (24)(f) a trust;
         (24)(g) a limited liability company;
         (24)(h) a partnership;
         (24)(i) a political subdivision;
         (24)(j) a government office, department, division, bureau, or other body of government; and
         (24)(k) any other organization or entity. See Utah Code 68-3-12.5
     (1)(a) On the filing of a claim for compensation for death under this chapter or Chapter 3, Utah Occupational Disease Act, when, in the opinion of the commissioner or the commissioner’s designee it is necessary to accurately and scientifically ascertain the cause of death, an autopsy may be ordered by the commissioner or the commissioner’s designee.
     (1)(b) The commissioner or the commissioner’s designee shall:

          (1)(b)(i) designate the certified pathologist to make the autopsy; and
          (1)(b)(ii) determine who shall pay the charge of the certified pathologist making the autopsy.
(2) Any person interested may designate a duly licensed physician to attend the autopsy ordered under Subsection (1).
(3) The findings of the certified pathologist performing the autopsy shall be filed with the commission.
(4) All proceedings for compensation shall be suspended upon refusal of a claimant or claimants to permit such autopsy when ordered under Subsection (1).
(5) When an autopsy has been performed pursuant to an order of the commissioner or the commissioner’s designee no cause of action shall lie against any person, firm, or corporation for participating in or requesting the autopsy.
