(1) There is established the COVID-19 Homeless Housing and Services Grant Program, a competitive grant program administered by the office and funded in accordance with 42 U.S.C. § 802.

Terms Used In Utah Code 35A-16-602

  • Board: means the Utah Homeless Services Board created in Section 35A-16-204. See Utah Code 35A-16-102
  • Deed: The legal instrument used to transfer title in real property from one person to another.
  • Grant program: means the COVID-19 Homeless Housing and Services Grant Program established in Section 35A-16-602. See Utah Code 35A-16-601
  • Office: means the Office of Homeless Services. See Utah Code 35A-16-102
  • Person: means :
         (24)(a) an individual;
         (24)(b) an association;
         (24)(c) an institution;
         (24)(d) a corporation;
         (24)(e) a company;
         (24)(f) a trust;
         (24)(g) a limited liability company;
         (24)(h) a partnership;
         (24)(i) a political subdivision;
         (24)(j) a government office, department, division, bureau, or other body of government; and
         (24)(k) any other organization or entity. See Utah Code 68-3-12.5
(2) The office shall distribute money to fund one or more projects that:

     (2)(a) include affordable housing units for households:

          (2)(a)(i) whose income is no more than 30% of the area median income for households of the same size in the county or municipality where the project is located;
          (2)(a)(ii) at rental rates no greater than 30% of the income described in Subsection (2)(a)(i) for a household of:

               (2)(a)(ii)(A) one person if the unit is an efficiency unit;
               (2)(a)(ii)(B) two people if the unit is a one-bedroom unit;
               (2)(a)(ii)(C) four people if the unit is a two-bedroom unit;
               (2)(a)(ii)(D) five people if the unit is a three-bedroom unit;
               (2)(a)(ii)(E) six people if the unit is a four-bedroom unit; or
               (2)(a)(ii)(F) eight people if the unit is a five-bedroom or larger unit; and
          (2)(a)(iii) that have been impacted by the COVID-19 emergency in accordance with 42 U.S.C. § 802; and
     (2)(b) have been approved by the board.
(3) The office shall:

     (3)(a) administer the grant program, including:

          (3)(a)(i) reviewing grant applications and making recommendations to the board; and
          (3)(a)(ii) distributing grant money to approved grant recipients; and
     (3)(b) in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, make rules to administer the program, including:

          (3)(b)(i) grant application requirements;
          (3)(b)(ii) procedures to approve a grant; and
          (3)(b)(iii) procedures for distributing money to grant recipients.
(4) When reviewing an application for approval, the board shall consider:

     (4)(a) an applicant’s rental income plan;
     (4)(b) proposed case management and service plans for households;
     (4)(c) any matching funds proposed by an applicant;
     (4)(d) proposed restrictions, including deed restrictions, and the duration of restrictions on housing units to facilitate long-term assistance to households;
     (4)(e) whether use of funds for the proposed project complies with 42 U.S.C. § 802; and
     (4)(f) any other considerations as adopted by the board.
(5) A grant award under this section shall comply with the requirements of 42 U.S.C. § 802.
