(1) Within appropriations from the Legislature, the division shall establish a program to assist municipalities to comply with the moderate income housing requirements described in Section 10-9a-403 and counties to comply with the moderate income housing requirements described in Section 17-27a-403.
Terms Used In Utah Code 35A-8-804
- Department: means the Department of Workforce Services created in Section 35A-1-103. See Utah Code 35A-1-102
- Division: means the Housing and Community Development Division. See Utah Code 35A-8-101
- Moderate income housing: means housing occupied or reserved for occupancy by households with a gross household income equal to or less than 80% of the median gross income for households of the same size in the county in which the housing is located. See Utah Code 35A-8-101
- State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
(2) Assistance under this section may include:
(2)(a) financial assistance for the cost of developing a plan for low and moderate income housing;
(2)(b) information on how to meet present and prospective needs for low and moderate income housing; and
(2)(c) technical advice and consultation on how to facilitate the creation of low and moderate income housing.
(3) The division shall submit an annual report to the department regarding the scope, amount, and type of assistance provided to municipalities and counties under this section, including the number of low and moderate income housing units constructed or rehabilitated within the state, for inclusion in the department’s annual written report described in Section 35A-1-109.
