Terms Used In Utah Code 41-1a-419 v2

  • Commission: means the State Tax Commission. See Utah Code 41-1a-102
  • Division: means the Motor Vehicle Division of the commission, created in Section 41-1a-106. See Utah Code 41-1a-102
  • Owner: means a person, other than a lienholder, holding title to a vehicle, vessel, or outboard motor whether or not the vehicle, vessel, or outboard motor is subject to a security interest. See Utah Code 41-1a-102
  • Person: means :
         (24)(a) an individual;
         (24)(b) an association;
         (24)(c) an institution;
         (24)(d) a corporation;
         (24)(e) a company;
         (24)(f) a trust;
         (24)(g) a limited liability company;
         (24)(h) a partnership;
         (24)(i) a political subdivision;
         (24)(j) a government office, department, division, bureau, or other body of government; and
         (24)(k) any other organization or entity. See Utah Code 68-3-12.5
  • Special group license plate: means a type of license plate designed for a particular group of people or a license plate authorized and issued by the division in accordance with Section 41-1a-418 or Part 16, Sponsored Special Group License Plates. See Utah Code 41-1a-102
  • State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
  • Symbol decal: means the decal that is designed to represent a special group and displayed on a special group license plate. See Utah Code 41-1a-102
  • Title: means the right to or ownership of a vehicle, vessel, or outboard motor. See Utah Code 41-1a-102
  • Vehicle: includes a motor vehicle, trailer, semitrailer, off-highway vehicle, camper, park model recreational vehicle, manufactured home, and mobile home. See Utah Code 41-1a-102
     (1)(a) In accordance with Subsection (1)(c), and except as provided in Subsection (1)(b), the division shall determine the design and number of numerals or characters on a special group license plate.
     (1)(b)

          (1)(b)(i) When the division has technology and processes in place to centrally distribute license plates, but no later than July 1, 2025, subject to Subsection (1)(c)(iii), an institution may design a collegiate special group license plate for the institution in accordance with Subsection (1)(c).
          (1)(b)(ii) If an institution chooses to design a collegiate special group license plate for the institution, the institution is responsible for any design costs.
     (1)(c)

          (1)(c)(i) Except as provided in Subsection (1)(c)(ii), each special group license plate shall display:

               (1)(c)(i)(A) the word Utah;
               (1)(c)(i)(B) the name or identifying slogan of the special group; and
               (1)(c)(i)(C) the combination of letters, numbers, or both uniquely identifying the registered vehicle.
          (1)(c)(ii) The division, in consultation with the Utah State Historical Society, shall design the historical support special group license plate, which shall:

               (1)(c)(ii)(A) have a black background;
               (1)(c)(ii)(B) have white characters; and
               (1)(c)(ii)(C) display the word Utah.
          (1)(c)(iii) The design of a special group license plate is subject to approval by the license plate design review board as described in Subsection 41-1a-402(3).

     (2)(a) The division shall, after consultation with a representative designated by the sponsoring organization as defined in Section 41-1a-1601, specify the word or words comprising the special group name and the symbol decal to be displayed upon the special group license plate.
     (2)(b) A special group license plate symbol decal may not be redesigned:

          (2)(b)(i) unless the division receives a redesign fee established by the division under Section 63J-1-504; and
          (2)(b)(ii) more frequently than every five years.
     (2)(c) A special group license plate symbol decal may not be reordered unless the division receives a symbol decal reorder fee established by the division in accordance with Section 63J-1-504.
(3) The license plates issued for horseless carriages prior to July 1, 1992, are valid without renewal as long as the vehicle is owned by the registered owner and the license plates may not be recalled by the division.
(4) A person who meets the requirements described in this part or Part 16, Sponsored Special Group License Plates, for a special group license plate may, apply for a personalized special group license plate in accordance with Sections 41-1a-410 and 41-1a-411.
(5) Subject to this chapter, the commission shall make rules in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, to:

     (5)(a) establish qualifying criteria for persons to receive, renew, or surrender special group license plates; and
     (5)(b) establish the number of numerals or characters for special group license plates.
