Terms Used In Utah Code 41-1a-803
- Division: means the Motor Vehicle Division of the commission, created in Section
41-1a-106 . See Utah Code 41-1a-102 - Identification number: includes a vehicle identification number, state assigned identification number, hull identification number, and motor serial number. See Utah Code 41-1a-102
- Manufacturer: means a person engaged in the business of constructing, manufacturing, assembling, producing, or importing new or unused vehicles, vessels, or outboard motors for the purpose of sale or trade. See Utah Code 41-1a-102
- Outboard motor: means a detachable self-contained propulsion unit, excluding fuel supply, used to propel a vessel. See Utah Code 41-1a-102
- Person: means :(24)(a) an individual;(24)(b) an association;(24)(c) an institution;(24)(d) a corporation;(24)(e) a company;(24)(f) a trust;(24)(g) a limited liability company;(24)(h) a partnership;(24)(i) a political subdivision;(24)(j) a government office, department, division, bureau, or other body of government; and(24)(k) any other organization or entity. See Utah Code 68-3-12.5
- State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
- Vehicle: includes a motor vehicle, trailer, semitrailer, off-highway vehicle, camper, park model recreational vehicle, manufactured home, and mobile home. See Utah Code 41-1a-102
- Vessel: means the same as that term is defined in Section
73-18-2 . See Utah Code 41-1a-102(1)(a) If a vehicle, vessel, or outboard motor has a permanent manufacturer‘s identification number, the number shall be used as the vehicle’s, vessel’s, or outboard motor’s identification number.(1)(b) If it has no permanent manufacturer’s identification number, the division shall assign an identification number to it.(1)(c) An identification number assigned by the division shall be permanently affixed or imprinted on the vehicle, vessel, or outboard motor as directed by the division.
(2) A person may not sell or offer for sale in this state a new vehicle, vessel, or outboard motor without an identification number.

(3)(a) Each permanent manufacturer’s identification number for a vehicle shall be clearly marked in an accessible place on a vehicle.
(3)(b)
(3)(b)(i) Each permanent manufacturer’s identification number for a vessel shall be clearly marked in an accessible place on the starboard outboard side of the transom or to the starboard outboard side of the hull.
(3)(b)(ii) If the permanent manufacturer’s identification number is displayed in a location other than on or near the starboard outboard side of the transom, the manufacturer shall notify the division of its location.
(4) A person may not destroy, remove, alter, or cover an identification number.
(5) A violation of this section is an infraction, except that Subsection (4) is a class C misdemeanor.
