Utah Code 53-3-221.7. Disclosure of license information for the Utah White Collar Crime Offender Registry

(1) The division shall disclose to the attorney general, if requested, the following information for use in connection with the Utah White Collar Crime Offender Registry established by Title 77, Chapter 42, Utah White Collar Crime Offender Registry:

- Division: means the Driver License Division of the department created in Section
53-3-103 . See Utah Code 53-3-102 - driver: includes any person who is required to hold a CDL under Part 4, Uniform Commercial Driver License Act, or federal law. See Utah Code 53-3-102
- License: means the privilege to drive a motor vehicle. See Utah Code 53-3-102
(1)(a) all names and aliases under which an offender has obtained a driver license, but not including any online or Internet identifiers;
(1)(b) a physical description of an offender, including the offender’s:
(1)(b)(i) date of birth;
(1)(b)(ii) height;
(1)(b)(iii) weight;
(1)(b)(iv) eye color; and
(1)(b)(v) hair color;
(1)(c) the most current driver license photograph of an offender, as allowed in Subsection (2)(b)(ii); and
(1)(d) the last known address of an offender.

(2)(a) The information in Subsections (1)(a) and (c) may be publicly posted on the Utah White Collar Crime Offender Registry, pursuant to Subsection 77-42-104(4), in order to assist the public in the accurate identification of offenders.
(2)(b) The driver license photograph under Subsection (1)(c) may be publicly posted on the registry only if:
(2)(b)(i) the offender has not registered as required under Section 77-42-106;
(2)(b)(ii) the attorney general has attempted to contact the offender at the last known address listed in the division’s records regarding the failure to register; and
(2)(b)(iii) 30 or more days have passed since the most recent attempt to contact the offender.
(2)(c) The information in Subsection (1)(d) may only be used by the attorney general to assist in locating and communicating with an offender, and may not be publicly posted on the Utah White Collar Crime Offender Registry.
